<br />JEFFERSON COUNTY <br />STATE OF WASHINGTON <br /> <br />In the Matter of <br />ADA Interim Grievance <br />Procedure <br /> <br />} <br />} <br />} <br /> <br />RESOLUTION NO. <br /> <br />19-92 <br /> <br />WHEREAS, the Americans with Disabilities Act (ADA) - Public Law 101-336 -was enacted on July 26, <br />1990; and, <br /> <br />WHEREAS, this landmark legislation provides comprehensive civil rights protection to individuals with <br />disabilities in the areas of employment, public accommodations, state and local government services and <br />programs, and telecommunications; and, <br /> <br />WHEREAS, said law designates the U.S. Department of Justice as the federal agency to enforce the <br />provisions of the act; and, <br /> <br />WHEREAS, the law stipulates that all public jurisdictions with 50 or more employees will establish a <br />complaint procedure to resolve grievances in a prompt and equitable manner; and, <br /> <br />WHEREAS, Department of Justice regulations strongly encourage the use of dispute resolution mechanisms <br />other that the federal court system; and, <br /> <br />WHEREAS, Jefferson County is moving towards full compliance with the provisions of ADA, <br /> <br />NOW THEREFORE BE IT RESOLVED, that Jefferson County does hereby establish the following as a <br />interim procedure until such time as a permanent grievance procedure is put into place: <br /> <br />Step 1. All complaints regarding access or discrimination shall be submitted to the Director of <br />Community Services in writing for resolution. A record of the complaint and action taken will be <br />maintained. A decision by the Director of Community Services will be rendered in writing within <br />ten (10) working days from the from the date the complaint is received. <br /> <br />Step 2. If the complaint is not resolved to the complainants satisfaction, the decision of the Director <br />of Community Services may be appealed to the Jefferson County Board of Commissioners. Said <br />appeal shall be in writing and received by the Board within ten working days from the decision date <br />of the Director of Community Services. After receiving the appeal, the Board of Commissioners will <br />review it within ten working days. Following their review, the Board shall set a date to hear the <br />matter in a open public meeting. After giving proper public notice and hearing the matter, the Board <br />shall make a written decision within thirty days from the date of the hearing. <br /> <br />Step 3. If the complaint is not satisfactorily resolved by the Board of Commissioners, the complainant <br />may request for independent arbitration to resolve the dispute. Said arbitration shall be the same as <br />is provided in the Jefferson County Personnel Policy Resolution 74-88 filed with the Jefferson County <br />County Commissioners' Office in Vol. 14, Pages 2378-2389.
