LICENSE and OPERATING AGREEMENT for <br />JEFFERSON COUNTY EQUESTRIAN EVENTS CENTER AND PARK <br />WHEREAS, a priority for Jefferson County (the County) is the general well -being of the <br />community, family and children, and the County wishes to maintain the quality of life and <br />amenities of the community, if not solely through County efforts, then through partnerships with <br />public private entities that can help the County achieve its goal of a high quality of life for its <br />citizens; and <br />WHEREAS. the Jefferson Equestrian Association (JEA or Operator) has long been desirous of <br />operating and managing an equestrian events center and park for the benefit and pleasure of its <br />members and the general public; and <br />WHEREAS, the JEA at one time intended to install, operate and manage an equestrian events <br />center and park upon a site that is now the Cape George Road trail head parking lot but instead <br />informally agreed that the County could place its trail head facility at that location if another <br />location was found for the equestrian events center and park; and <br />WHEREAS, on June 6, 2007, the Jefferson County Parks Advisory Board reviewed an <br />Equestrian Park Master Plan for the County property subject to this License and Operating- <br />Agreement and recommended it for review by the Board of County Commissioners, and on July <br />17, 2007, the Board of County Commissioners reviewed and approved by motion said Equestrian <br />Park Master Plan; and <br />WHEREAS, the County has made drastic cuts to its parks and recreation budget for 2010 and the <br />reduced budget amounts will continue for the foreseeable future; and <br />WHEREAS, the JEA would, pursuant to the terms and obligations of this Operating Agreement, <br />install, maintain and operate equestrian events center and park facilities for the benefit of the <br />general public and the equestrian community, in essence stepping in where the County cannot, at <br />present, do so to provide recreational opportunities for citizens of the County; and <br />WHEREAS, because the installation, maintenance and operation of an equestrian events center <br />and park by a volunteer organization such as the JEA is of benefit to all of the County's citizens <br />including, but not limited to, the youth of this County, said benefit to the citizenry constitutes <br />good and valuable consideration running to the County for allowing the equestrian events center <br />and park to exist on real property owned by the County; and <br />WHEREAS, the County owns real property that would be suitable for the installation, <br />maintenance and operation of an equestrian events center and park; and <br />WHEREAS, authorization of an equestrian events center and park at the county's real property <br />pursuant to the terms and obligations agreed to in this License and Operating Agreement, would <br />and does constitute good and valuable consideration running to the JEA as operators of the <br />equestrian events center and park; <br />Page - 1 - (Rev.
