No. 77-01) <br /> <br />Dear Mr. Stewart: <br /> <br />As a member of the Olympic Stewardship Foundation, I request that the comments submitted by Attorney <br />Dennis D. Reynolds on behalf of the OSF be incorporated in full as my comments. <br /> <br />In addition, I wish to emphasize the following: <br /> <br /> • The proposed SMP amendment incorporates liberal construction. I insist that liberal construction must <br />also apply to the laws and rules that have forced the SMP amendment to occur. This has not been done. <br /> <br /> • As an owner of common shoreline property that will be affected by the proposed SMP amendment, I <br />contend that <br />shoreline residents and shoreline property owners were deliberately excluded from the planning <br />process in violation of the intent of the legislature. The ability of a public comment option is not adequate <br />compensation for the failure to include affected landowners in the committee process. <br /> <br />• The county was not diligent in using science to determine text in the proposed SMP amendment. The <br /> <br />county failed to identify and assemble the most current, accurate, and complete scientific and technical <br />information available that is applicable to the issues of concern. <br /> <br /> • Under the guise of providing planning assistance to the county, emboldened by a substantial sum of <br />money paid to the county by the Department, Ecology inappropriately dictated provisions of the proposed SMP <br />amendment that reflected personal views of Ecology’s representative in what the legislature intended to be a <br />local planning effort. <br /> <br />Respectfully submitted, <br /> <br />Dick Bergeron <br />240 Elk Dr. <br />Brinnon WA 98320 <br /> <br />1 <br />
