In a ten-page ruling <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d7 6c22fe2ef2a8361&id=4f3d07fdfc&e=7ccb4f03e2> , the judge argued that the directive is outside the statutory authority of the agency and is “arbitrary and capricious in its scope and lacks specificity.” In a statement <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=58121423fb&e=7ccb4f03e2> , Transportation Secretary Sean Duffy responded that the ruling was “judicial activism pure & simple and I will continue to fight in the courts.” Federal Motor Carrier Safety Administration * The Federal Motor Carrier Safety Administration (FMCSA) began <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=8917aec319&e=7ccb4f03e2> implementation of the final phase of the Medical Examiner’s Certification Integration (NRII) rule this week. Initially published in 2015, the rule mandates <https://watransit.us12.list-manage.com/track/click?u=6c7 0c3a1d76c22fe2ef2a8361&id=cae831d82c&e=7ccb4f03e2> the electronic transmission of examination results performed for commercial driver’s license (CDL) applicants from the National Registry to State Driver’s Licensing Agencies (SDLAs). The agency argues that “this new process will replace outdated paper documents that are ripe for fraud, a hassle for truck drivers to maintain, and harder for law enforcement to assess.” Congress * House Transportation and Infrastructure Committee Sam Graves previewed legislative priorities for the surface transportation reauthorization measure under development in a Washington Times op-ed <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=2a109e0a02&e=7ccb4f03e2> this week. The Chair offered that the legislation will represent a “return to basics” and “focus on our most fundamental infrastructure needs” without “expanding and creating more programs, spending money we don’t have, and losing money to project approval inefficiencies” and “additional requirements…[that] increase project costs and lead to delays.” The reauthorization will instead focus on expanding flexibility to states in implementing federal funding, reforming permitting processes and strengthening the solvency of the Highway Trust Fund (HTF) through a “sustainable solution that maintains the conservative user-pays principle.” * Meanwhile, the House Transportation and Infrastructure Subcommittee on Railroads, Pipelines, and Hazardous Materials held a hearing <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d7 6c22fe2ef2a8361&id=075c07572e&e=7ccb4f03e2> this week to review potential proposals for the surface transportation reauthorization related to rail innovation and technology. Subcommittee Chair Daniel Webster argued <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=e05633851c&e=7ccb4f03e2> at the session that “much of the Federal Railroad Administration’s (FRA’s) regulatory framework remains a relic of the past” and the current waiver process for railroads to test new processes and technologies is “less than transparent and subject to political interference.” * Congressman David Valadao led <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=f25cb960d6&e=7ccb4f03e2> a group of Republican lawmakers from across California in urging state leaders to suspend a scheduled increase of the state gasoline excise tax and the implementation of approved updates to the State’s Low Carbon Fuel Standard (LCFS) planned for this Tuesday, July 1, 2025. In a letter <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=df49fc2ed6&e=7ccb4f03e2> to Governor Gavin Newsom, the group argued that projected increases in gasoline prices resulting from the two measures is “simply unsustainable for the communities we represent.” Governor Newsom issued a press release <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=2f2b87f9ab&e=7ccb4f03e2> in response to the letter and other media reports. <https://maassets.higherlogic.com/image/APTA/Executive_Action_Update_650x200_Final_3009955.png> Impacts of Executive Actions on Public Transportation: Since January 20, President Trump has issued almost 100 Executive Orders, Memoranda, and Proclamations to carry out his Administration’s policy goals and agenda. Many of these directives, together with U.S. Department of Transportation (DOT) actions, directly impact the public transportation industry. These Executive Orders and other directives pause some transportation funding; terminate diversity, equity, and inclusion programs; impose new tariffs; and establish priorities for DOT competitive grants.
