Statement of Issue: Operations and Maintenance costs for the County's Moderate Risk Waste
Fadlity have been funded, in part, through a biannual grant from the Department of fcology
(fCY) known as the Coordinated Prevention Grant (CPG). This grant money was dertved from
the Model Toxies Control Act (MTCA), enacted through voter Initiative 97 in 1989, and
codified as chapter 70.1050 RCW, which imposes a tax on the first in-state possessor of
hazardous substances at the rate of 0.7 percent, or $7 per $1,000.
In 2009, funding for the CPG was moved out of the MTCA Account and is now provided through
the State Building Construction Account. fCY forecast some difficulty in managing grant
funding through this account and for this reason the current CPG Agreement (attached for
reference) divided the grant cycle into two phases with funding for the second phase
conditioned on legislative budget dedsions to be made later.
fCY has requested an Amendment to the current CPG which would allow for spending in
Phase One of the Agreement to occur for up to six months into the Phase Two cycle. This is
being done to increase the benefit of the Agreement to the County in advance of a potential
funding shortfall for the Phase Two cycle.
Fiscal Impact/Cost Benefit Analysis: Public Works antidpated a budget shortfall for CPG
funding for Phase Two of the CPG and developed a spending plan accordingly. All available
funding will have been spent in Phase One of the CPG and there will be no finandal impact
assodated with this contract amendment.
Recommendation: Staff recommends approval of the attached Amendment No.1 to
Agreement No. G1000-400.
