The letter affirms that “any policies or requirements not based in statute or regulation relating or referring to climate change, ‘greenhouse gas’ emissions, racial equity, gender identity, ‘diversity, equity, and inclusion’ goals, environmental justice, and the Justice40 Initiative” that the previous Administration had “incorporated into the terms, schedules, exhibits, and attachments of its Federal financial assistance agreements” are “null and void and of no effect.” The letter states that the agency “will not enforce or require adherence” to these policy requirements. Project sponsors may contact their designated DOT representative for further clarification regarding these federal assistance obligations. We would note that prospective funding recipients should be aware that there are policies and requirements codified in statute or regulation across various programs, so please be mindful of those considerations and review each grant solicitation carefully. Build America Bureau * The Build America Bureau (BAB) issued <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=efee42ea23&e=7ccb4f03e2> a policy update stating that all types of transportation infrastructure projects will now be eligible to finance up to 49 percent of eligible costs under the Transportation Infrastructure Finance and Innovation Act (TIFIA) Program. Previously, only certain transit and transit-oriented development (TOD) projects were eligible for 49 percent financing, while most other transportation infrastructure projects could only receive financing of up to 33 percent. Project sponsors interested in accessing TIFIA credit assistance may find additional information on the program website <https://watransit. us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=6cc174d287&e=7ccb4f03e2> . This change should be helpful to project sponsors. Federal Transit Administration * The Federal Transit Administration (FTA) finalized <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=4f9c15999e&e=7ccb4f03e2> changes to its National Transit Database (NTD) reporting requirements for Report Years (RY) 2025 and 2026. According to an agency Notice, the updates are intended to “improve reporting standards and ensure data alignment and consistency with FTA’s final rule for State Safety Oversight published on October 18, 2024.” See the Notice for further detail on those changes that will apply in Calendar Year (CY) 2025, RY 2025, or RY 2026. Energy and Environment U.S. Department of the Treasury Internal Revenue Service * As we have reported previously, the One Big Beautiful Act (P.L. 119-21) phases out the Section 45Y Clean Electricity Production Credit and Section 48E Clean Electricity Investment Tax Credit for wind and solar technology. Wind and solar facilities beginning construction after July 4, 2026 must be placed in service by December 31, 2027 to be eligible for either credit. The law also restricts access to the credits to certain Foreign Entities of Concern (FEOC). Following the signing of the law last week, President Donald Trump signed <https://watransit.us12. list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=95c2254f0e&e=7ccb4f03e2> an Executive Order (EO) <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=8078828 289&e=7ccb4f03e2> directing the Secretary of the Treasury within 45 days of enactment to “take all action…to strictly enforce the termination” of the credits for wind and solar facilities, including by issuing new and revised guidance to “ensure that policies concerning the ‘beginning of construction’ are not circumvented” and implement the FEOC provisions of the law. The Secretary of the Interior is separately directed in the EO to review agency regulations, guidance, policies, and practices to eliminate any preferential treatment for wind and solar facilities over “dispatchable energy sources.” <https://maassets.higherlogic.com/image/APTA/Executive_Action_Update_650x200_Final_3009955.png> Impacts of Executive Actions on Public Transportation: Since January 20, President Trump has issued almost 100 Executive Orders, Memoranda, and Proclamations to carry out his Administration’s policy goals and agenda. Many of these directives, together with U.S. Department of Transportation (DOT) actions, directly impact the public transportation industry. These Executive Orders and other directives pause some transportation funding; terminate diversity, equity, and inclusion programs; impose new tariffs; and establish priorities for DOT competitive grants.
