17 1. The above -captioned matter was filed on March 25, 2025, under Washington's Land

Use Petition Act ("LUPA"), Chapter 36.70C RCW, challenging a building permit issued by
19
Jefferson County to Respondent Richard Rathvon on March 6, 2025.

2. Prior to Petitioners' filing of this LUPA appeal, on March 13, 2025, Jefferson
21
22 County withdrew the challenged building permit.
23 3. Respondent Richard Rathvon has agreed that he will not challenge Jefferson
24 County's withdrawal of the building permit.
25 4. Based on Mr. Rathvon's agreement that he will not challenge the County's
26
withdrawal of the building permit, Petitioners John DiMaggio and Michelle Oliver have agreed to

5. Based on Lite above stipulation, Petitioners John DiMaggio and Michelle Oliver,
Respondent Richard Rathvon, and Respondent Jefferson County now seek a stipulated order of
dismissal pursuant to CR 41(a)(1)(A)0 The Parties agree that the dismissal will be without prejudice
to refiling if and when the challenged building permit is re -issued.
Agreed to this 28th day of April, 2025.
