Unfortunately, Mr. Carson recently suffered a family tragedy (his mother suddenly passed away) that is requiring much of his time and attention. He cannot attend a site visit on Jan. 27 at 2:15, and his schedule and demands for his time are such that he cannot now say with confidence when he will be personally available the weeks of Feb. 3 and 10. I, however, am available for the Jan. 27 site visit. I am familiar with the ROW survey markers, and Mr. Carson said that he will be able to get out to the property before the site visit to place markers at the boundaries of three parcels to ensure that DCD staff stays onside during the site visit. I look forward to seeing DCD staff at the Jan. 27 2:15 site visit. I have attached an updated site plan that contains new shoreline buffer and jurisdiction layers based on County mapping resources. The rock gabions support the aquaculture use. The gabion south of the parking area defines and supports the parking area, helping ensure vehicles and equipment stay in this area and do not go into adjacent downhill areas. The gabion near container A protects that container and ensures dirt and other materials do not damage it. The parking lot is used for vehicles used in conjunction with the aquaculture activity to park at the property, and the containers are used to store materials for the aquaculture farm. The trails have all been present at the site since Mr. Carson acquired it and are used to walk around the property when conducting farming activities. I am surprised to hear reference to a possible geotechnical report, which I do not recall hearing about earlier and imagine would require significant costs and delays. Regarding the road right-of-way, as mentioned in my December 23 email, the centerline of the right-of- way is not located at the center of the paved roadway but is rather to the north of it. The right-of-way extends only approximately 6 feet beyond the paved roadway. Mr. Carson reports that he has no materials in the right-of-way. There are survey markers still present that can be referenced to identify the boundary between the properties and the right-of-way. In terms of use of the right-of-way, the Carsons have received communications earlier from the County administrator indicating continued use of the right-of-way is permissible. In fact, the County has indicated it would be usable even if there were a permanent closure, which has not happened. Rock Island Shellfish has an urgent need to conclude the review without losing an entire planting season. While the company would prefer to move forward with concluding the review absent another site visit, if that is necessary and deemed to be an effective way to resolve any outstanding issues (including items covered in your email below and this response), please let me know and I would be happy to schedule a site visit with you at the earliest convenience. While DCD understands why the applicant is interested in getting the proposal to a public hearing as soon as possible, the department needs clear responses to the following to ensure compliance with all applicable regulations. I have reviewed the most recently submitted site plan and the location of the ordinary high water mark (OHWM) appears to be correct. However, the site plan is not matching with county GIS mapping (as it pertains to distances of the shoreline buffer and limits of shoreline jurisdiction from OHWM) so I also looked at the Jefferson County Assessor Parcel Map. Using the scale bar shown on the submitted site plan, the depth of the parcel (and, therefore, the location of the shoreline buffer and extent of shoreline jurisdiction) does not match county GIS mapping or the Assessor Parcel Map. County mapping indicates that most, if not all, of the three parcels and a portion of the Killapie Beach Road right-of-way would be within the shoreline buffer and that shoreline jurisdiction extends well into the Killapie Beach Road right-of-way. Submit a site plan that is correctly scaled and shows the extent of the 150-foot-wide shoreline buffer and 200-foot limit of shoreline jurisdiction relative to parcel boundaries, parcel depth, OHWM, and existing development (which includes areas where rock and gravel have been placed). It is not clear from the information submitted to date how the rock gabions or the gravel path to the beach would support the aquaculture proposal. Both appear to meet the definition of fill, which is prohibited in the Natural shoreline environment designation. Unless it can be clearly demonstrated that the fill materials placed on the property support the aquaculture proposal, they will be reviewed as fill material placed within shoreline jurisdiction. Be advised that the three parcels and the area upslope are mapped as geologically hazardous areas and that development, including the construction of rock gabions, triggers the requirement to submit a geotechnical report. A photograph attached to the December 16, 2024 email that I sent shows a number of items stored in the road right-of-way. Identify what will be permanently removed and what will remain onsite temporarily or permanently. All development must be addressed for permitting, and the response to this will be used to specify what development is being permitted as part of the current shoreline application. The most recent submittal states some of the stored gear will be removed soon. Has the gear been removed from the road right-of-way? If not, when will it be removed? Since no aquaculture gear can be built, stored, or staged in the right-of-way, the revised site plan should show where the items that are currently stored in the road right-of-way and will be used as part of the aquaculture operation (either on a permanent or temporary basis) will be placed on the three parcels. Have you contacted Jefferson County Public Works about using the closed road for this proposal? If not, indicate when (or if) you are intending to do so. Once DCD has received your responses to the above, I will contact you about making a site visit to the three parcels.
