A. The right-of-way that leads to (and passes by) their parcel was created via plat.
B. Due to the landslide hazard the right-of-way was 'temporarily' closed per resolution and has never been, nor ever will,
be fully reopened.
C. Nothing can be built, stored, staged, etc. in the right-of-way.
D. Although we don't currently have a mechanism (permit/risk waiver) to allow the closed right-of-way to be used for
access (only), it may be possible to create one. This permit would specify the access conditions and include
indemnification and hold -harmless language that would need to be approved by the PAO's office.
D. All of this was covered in a letter dated 8/4/2020 from Debra Murdock to the same applicant. Is there an active
permit you are currently billing against?

Hi Eric:
This email pertains to Killapie Beach Road and a shoreline application to use the road. Attached is the most recent site
plan showing some of the unpermitted development that the applicant says is needed for the aquaculture
operation. Also attached is a photo of the gear he intends to use for the shellfish farm stockpiled near the road.
Based on emails with you from December 16, 2024, 1 asked the applicant to address aquaculture gear that has been
stored in the right-of-way, and I have questions about the response I received from the attorney representing the
applicant (Robert Carson). The responses do not appear to be consistent with previous communications I have had with
you. I have summarized two questions that I sent to the attorney about the ROW and have included the response from
the applicant and follow up my questions for you.
1. 1 asked the applicant to clarify where the gear that is currently stockpiled in the ROW will be placed on the three
parcels (965100009, -010, and -011). Here is the response:
Regarding the road right-of-way, as mentioned in my December 23 email, the centerline of the right-of-way is not located
at the center of the paved roadway but is rather to the north of it. The right-of-way extends only approximately 6 feet
beyond the paved roadway. Mr. Carson reports that he has no materials in the right-of-way. There are survey markers still
present that can be referenced to identify the boundary between the properties and the right-of-way.
Does PW works agree that the ROW is only six feet from the paved road (and, therefore, all the gear in the attached
photo is outside of the ROW)?
As mentioned the right of way is platted at 60'-0" wide. Without a survey we have no way of knowing where the road
was built within the right of way. Does the applicant have a recent survey?
2. 1 asked the attorney to contact you about using the road. Here is his response:
In terms of use of the right-of-way, the Carsons have received communications earlier from the County administrator
indicating continued use of the right-of-way is permissible. In fact, the County has indicated it would be usable even if
there were a permanent closure, which has not happened.
Is this correct? Has PW given Carson the okay to use the road and ROW to access three of his parcels, which will be used
in support of the shellfish farm?
I can't speak for the County Administrator; please ask Mark.
PW has not given the applicant the okay to use the right of way, although an access permit may be possible as
mentioned on 12/16/24.
