JEFFERSON COUNTY INTEV TO V CATF INTENT AND VACATION DESCRIPTION: The Jefferson County Board of Commissioners intend to vacate that portion'of the old Beaver Valley road running through property owned by Pope and Talbot, Inc.: • All that portion of the Beaver Valley Road (FAS 496) in Section 19, Township 28, Range 1 East, W.M. from engineering station 31+00 to engineering station 145+00 in Section 32, Township 28, Range 1 East, W.M., lying outside of the existing right-of-way of the present Beaver Valley Road (County Road No. 12) That portion of the old Beaver Valley road is not being used for public access. In January, 1979, the new Beaver Valley road was constructed under County Road Project #427. The new road has been used for public access since fall 1979. According to a previous agreement with Pope and Talbot, Inc., the old Beaver Valley road was to revert back to the company upon completion of the new road. Utility poles and lines run along the old road. The land is in timber production. DEPARTMENT AND AGENCY FINDINGS: 1. Jefferson County Public Works Department: This road proposed for vacation is no longer needed due to a newly constructed alignment connecting the Beaver Valley Road to State Highway 104. The use of this vacated road for utility easement and ingress and egress for utility maintenance is.to be retained. 2+ Puget Sound Power and Light Company: No objection provided a utilities easement is retained. 3. Pacific Northwest Bell Company: No comment. Telephone lines do not run along that road. 4. Jefferson County Sheriff's Department: No objection. 5. Jefferson County Planning Department: a. The optimum land use map of he Jefferson County Comprehensive Plan designates the area as resource product on. b. The proposed vacation is des gnated as a horse trail according the to Jefferson Count Park, Recre tion, and 0 en Space Plan. c. A public hearing will be held by the Jefferson County Board of Commissioners on December 8.9 1980, at 11:3 a.m. in their chambers at the Courthouse, Port Townsend. Public notice of the hearing will be in the November 19 and 265 1980 edit ions of the Port Townsend Leader. d. Pope and Talbot, Inc. was contacted and is in favor of the road vacation. SUGGESTED CONDITIONS FOR APPROVAL: 1. The County shall retain a utility easement, pursuant to R.C.W. 36.87.140. 2. The designated horse trail in the Jefferson County Park, Recreation, and Open Space Plan should be moved to that portion of the new Beaver Valley Road; Resolution No. 21-78 should be amended to reflect the change in the Beaver Valley road route. PLANNING COMMISSION ACTION: At their meeting December 3, 1980, the commission reviewed the roa vacation proposa , department and agency findings, and public testimony. By formal motion, the commission recommended to the Board of Commissioners to vacate that portion of the Old Beaver Valley Road as described, subject to the two suggested conditions. BOARD OF COMMISSIONERS ACTION: At the public hearing December 8, 1980, the Board reviewed the findings from departments and agencies and the recommendation from the Planning Commission. By formal motion, the Board accepted the recommendation from the Planning Commission to approve the intent to vacate subject to the two suggested conditions as stated above. VIGINII'?
