Good Afternoon,
Either in person or remote both work just as well so the choice is yours. We are moving future
hearing to fully remote because several examiners are from out of the area. Yes the notice that was
posted should be very similar to the mailed letter & it is a statutory requirement we post those
notices even though it is not an actively traveled road.
We did receive the attached public comments from PUD regarding retainage of an easement for
utilities. However, an easement was already granted July 27, 1994 to Puget Sound Power & Light
Company AFN 374562 of which Jefferson County Public Utility District #1 is the successor in interest
and a consent to use of easement was granted January 29, 2013 to Jefferson County Public Utility
District #1 for their fiber internet (both documents are also attached). While these provide a right for
continued use for power and fiber even after the vacation there may be a future need for water &
sewer to utilize the same area for those utilities as well so we will recommend an easement for all
public utilities be retained.

Joshua,
I am now back from being overseas since 7/27. I got my physical mail today and received a
letter from you that says I can also be in person (rather than zoom) on August 15th. Is it ok if I
attend in person or would you prefer I join the meeting via zoom? My father said there are
signs posted near the vacate properties which match the letter that I received. I will view that
in person this week as I have time (most likely on Wednesday or Thursday).

Hi Joshua!
I did receive the Zoom conference invite from Carolyn. Sorry for delay as I was enroute to
India. I'll be returning on July 27th.
I was not able to contact Case Swanson in person before I left for India. I mailed a letter and
hope he will reply while I am gone. I am very open to a restrictive covenant for the one parcel
that I own if I happen to sell it separately from the others. I am also open to that with Case
Swanson too although his two parcels have easy access from the road next to one of his.

Were you able to get ahold of Case Swanson Owner of parcels 942903703; 942903803 to see if they
would like to join or oppose the vacation request? An item to be aware of is:
Jefferson County Code section 12.10.110(7) states: A road vacation should not landlock any parcel or
property. This is an issue for your parcel 942-903-704 because if it was conveyed to a third party, it
will become landlocked unless it is merged with parcel 942-903-705, 942-903-706, or 942-903-801,
or legal access is provided via a recorded easement across one of those parcels. A work around for
this issue is the Board of County Commissioners could approve your request conditioned on one of
the following: They might require a recorded restrictive covenant providing an easement for parcel
942-903-704 if it's no longer owned with parcels 942-903-705, 942-903-706, and 942-903-801.
Alternatively, they might require approval of a boundary line adjustment/merger that ensures access
to all parcels in the revised layout. You had mentioned wanting to combine the parcels and or
request a boundary line adjustment so this may not be an issue for you but wanted to bring it to
your attention.

Hi Joshua,
I am very glad to hear from you. In mid-2023, I became very sick and it took me nearly all of
2024 to fully recover. In 2025, I am attempting to pick up on things that were left behind/off
in 2023. I am currently out of the country returning May 31. I would love to meet you in early
June to get the ball rolling again. I do have the appraisal report.

Our records indicate that in April of 2023, a petition to vacate Simms Rd was sent to you. I do not
show the petition form was fully completed & the appraisal report was not received. The County’s
policy is that if no action is taken within one (1) year of issuance of the petition, the application
expires. Please advise whether you intend to pursue the vacation. If I do not hear from you by June
15th 2025, I will assume that you do not wish to complete this process and the petition will be
removed from our files.
