Howard and Flora Barnhouse Case # MLA07-00563/CUA07-00003 STATEMENT OF ISSUE: Applicants own two parcels totaling approximately 82.60 acres at 6200 and 6464 Center Road, Chlmacum. A Grant Deed of Conservation Easement was recorded under Auditor's File Number 433315 on May 2,2000, which transfers development rights of 35.03 acres to Jefferson land Trust. Applicants wish to place this 35.03 acres in current use taxation assessment as open space open space under the provisions of RCW 84.34. ANALYSIS/STRATEGIC GOALS: The Jefferson County Hearing Examiner conducted an Open Record PubIc Hearing on March 23, 2010 considering the request of Howard and Flora Bamhouse to transfer 35.03 acres to open space open space under provisions of RCW 84.34. The heart of the analysis for an application under the Open Space Tax Program is the Public Benefit Rating System. The Hearing Examiner reviewed the staff report, testimony and the Public Benefit Rating System worksheet and concurred with the staff evaluation and assignment of 10 points for the public benefit rating. ALTERNATIVES: The requested action is a Board of Commissioners legislative action to approve the applicant's request to transfer and designate 35.03 acres for current use tax assessment as Open Space Open Space, remand to the Hearing Examiner, or deny the application. FISCAL IMPACT: In exchange for transferring and designating the 35.03 acres for current use assessment, the property owner will receive a benefit of reduced property taxes; the public will benefit In long-term open space of the subject property. 1 !, ,'.. Consent Agenda RECOMMENDATION: Per the recommendation of the Jefferson County Hearing Examiner, approval is recommended subject to the applicant's compliance with conditions and entering into an Open Space Taxation Agreement with the Jefferson County Board of Commissioners and recorded at the expense of the applicant.
