The application was reviewed by the Jefferson County Department of Community Development staff on 7/20/04 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: Shoreline (conservancy), seismic hazard, eagle habitat, and stormwater. 2.) The Shoreline CUP for the stairs to the beach (SDP 03-38) included a Notice of Application and Preliminary Threshold Determination. The Notice of Application and Preliminary Threshold Determination of a Determination of Non-Significance (DNS)was published in the Port Townsend/Jefferson County Leader on January 21, 2004. The optional DNS process of WAC 197-11-355 (SEPA Rules)was utilized. Agencies and adjacent property owners were sent notice of the proposal on January 20, 2004. The property was posted on February 10, 2004. The comment period for the Threshold Determination expired on February 4, 2004. No comments were received on the Threshold Determination. Notice of Public Hearing and Final Threshold Determination: A Public Hearing before the Hearing Examiner was scheduled for April 6, 2004 at 1 p.m. in the First Floor Conference room of the Jefferson County Courthouse. The Notice of Public Hearing and Final Threshold Determination of a DNS was published in the Port Townsend/Jefferson County Leader on March 3, 2004. The optional DNS process of WAC 197-11-355 was utilized. Agencies and adjacent property owners were sent notice of the public hearing on March 1, 2004. The property was posted on March 3, 2004. The deadline to appeal the Final Threshold Determination was March 17, 2004. No appeals were received by this deadline. SDP 03-38 was approved with 14 conditions of approval on April 21, 2004. A residence (BLD 04-165)was approved on May 4, 2004 that also included a consistency review. 3.) The site plan as submitted with the building permit application (BLD 04-451) on July 1, 2004 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated July 21, 2004 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 4.) This approval is for an eight foot high set of stairs to the beach only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 5.) The proposal shall be implemented in conformance with the conditions of approval from SDP 03-38. See attached document in Permit Plan dated July 20, 2004 from the Tom Lawrence. No trees or native vegetation will be removed during the course of construction. 2. All debris will be disposed of in such a manner to prevent any debris from entering the adjacent water. 3. Best Management Practices as approved by the Washington Department of Fish and Wildlife will be followed to prevent chemicals and/or preservatives from leaching into the water or shore bed. 4. As is indicated in the drawings submitted, the stairway will be constructed to harmonize with the local shoreline environment to the maximum extent practicable. 5. Construction will be in substantial compliance with the site plan submitted during the permit process or as it may be amended hereafter by Jefferson County and/or Washington State Department of Ecology. 6. Prior to construction, Jefferson County Department of Community Development will be contacted with estimated timelines for monitoring and plan compliance. 10. The contractor,who will be performing this work,is SeaHome Services, Inc., 7425 Thorndyke Road, Quilcene, WA 98376 (License number SEAHOS 1077KS) 11. The applicant will investigate utilizing this structure as a joint use facility/joint ownership facility with neighboring property owners. 12. No construction, equipment, or materials will be located waterward of the OHWM. 13. If archeological resources are encountered in the course of development activities,work will cease immediately and the Jefferson County Department of Community Development, the Washington Office of Archeology and Historic Preservation, and the Skykomish Tribe will be noticed. No work will proceed until the site has been examined by a professional Archeologist and appropriate measures are taken to avoid impacts to the archeological resources. 14. The work will comply with the conditions of the WDFW eagle management plan approved March 17, 1993.
