Home My WebLink About58-0825-25RSTATE OF WASHINGTON County of Jefferson A Resolution Adopting a Fee Schedule for �RESOLUTIONNO- 58-0825-25R the County Clerk WHEREAS, Jefferson County is a political subdivision of the state of Washington as provided by title 36 RCW and the Washington State Constitution Article 11, and may impose fees to recoup the costs of providing services to the public; and WHEREAS, the Jefferson County Board of County Commissioners (BoCC) may impose fees charged by the County Clerk to implement the code and statutory duties; and WHEREAS, section 3.80.020 of the Jefferson County Code (JCC) authorizes the County Clerk to request adoption of its fee schedule by resolution; and WHEREAS, the new fee schedule will comply with the changes to RCW 36.18.020; and, WHEREAS, BoCC recognizes the Clerk's need to assess a reasonable fee for fulfilling customer requests for sending copies of documents via the mail; and WHEREAS, basic operating expenses require this new document handling fee to be seven dollars per transaction and unless postage is provided by the customer with postage being charged at a rate of three dollars per transaction; and WHEREAS, the adoption of the new clerk fees is consistent with RCW 36.18.020 and chapter 3.80 of the Jefferson County Code; and NOW, THEREFORE, THE BOARD OF COUNTY COMMISSIONERS OF JEFFERSON COUNTY, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: Section 1. The Jefferson County Board of Commissioners hereby adopts the above "Whereas" clauses and Findings of Fact supporting this Resolution. Section 2. The 2025 Clerk Fee Schedule attached in the Appendix A is hereby adopted. Section 3. This Resolution Repeals and Replaces Resolution No. 57-23. Section 4. If any section, subsection, sentence, clause, phrase of this Resolution or its application to any person or circumstance is held invalid, the remainder of this Resolution or its application to other persons or circumstances shall be fully valid and shall not be affected. Section 5. This Resolution is categorically exempt from the SEPA under WAC 197-1 1-800(19). 1 of 4 Section 6. This Resolution shall take effect and be in full force immediately upon passage by BoCC. ANAYLSIS: Second substitute House Bill 1207 was passed as an act relating to superior court clerk fees, and amended RCW 36.18.020 to add a $50 surcharge to civil filing fees, effective July 27, 2025. In addition, with the advent of electronic filing, there is an increased demand for mailing copies of filed documents with no clear supporting fee structure in place. Fees have been added to the schedule in order to cover the cost of mailing and handling document requests. FISCAL IMPACT: There is a revenue benefit to the county. Of the recently adopted $50 surcharge, $5 is designated to stay locally in a county clerk administrative assistance fund to be used for the statutory obligations of the county clerk. Imposing a reasonable fee for the physical handling and mailing of public documents will help cover the associated costs.
