HomeMy WebLinkAboutResponse from HX re_ WSDOTHi Mo-chi, Please see the response below and I’ll drop this into the correspondence folder for this case: “The Examiner has reviewed DCD’s request for Hearing Examiner confirmation of the appropriate WSDOT witness and provides the following clarification on what is requested for WSDOT testimony at hearing: * The subject matter of the requested WSDOT testimony is described in Section II(G), beginning on Page 8, and in Section III(B), beginning on Page 10, of the Status Conference Order. The intent of the WSDOT witness testimony is to obtain detailed answers on the record concerning WSDOT’s evaluation and position on the SR19/SR116 intersection; lack of knowledge or incomplete answers can result in continuation of a hearing in order to locate the correct witness capable of answering questions about details. * At the top of Page 11 of the order, the Clerk was directed to contact Casey Chilton to request the testimony of “the WSDOT point of contact for this project.” The Examiner intended for WSDOT itself to determine the appropriate witness to testify, as "the WSDOT point of contact,” recognizing that the person may or may not be Casey Chilton. * The Examiner further clarifies that agency personnel charged with supervisory responsibility or policy duties may be the appropriate "point of contact” to testify in place of staff administering the Department’s policy, provided the designated witness has first hand knowledge of the details involved in the Department's actions “on the ground” of a particular project and the reasons for the position taken. * The goal is for the hearing to contain a clear and complete record on the WSDOT/State Highway mitigation issue.” This was in response to DCD Staff Mo-chi’s email below: Good afternoon Carolyn. Could you please confirm with the Hearing Examiner whether Sarah Ott, WSDOT’s Olympic Region Traffic Engineer, or Manuel Abarca can represent WSDOT in place of Casey Chilton at the upcoming hearing?
