Hello Chris,
WDFW had a public hearing this morning for the Pt. Whitney boat launch project. The hearing
examiner had some questions regarding ownership of the water in this area. Are you able to provide
anything showing DNR ownership in this area? This project is located at 47.761842, -122.851330.
According to our previous correspondence, a right of entry license and lease are no longer needed
for work conducted above the MLLW but he would like to see that DNR has ownership of the water
in this area.

Hi Michelle,
Thanks for the clarification. After doing some research on this location and looking through your
JARPA, I have some good news. RCW 79.125.740 withdrew from sale and lease the second class
tidelands at Pt. Whitney down to MLLW. This area is reserved as a public area for recreational use.
Since the boat ramp, according to the survey attached to the JARPA, does not extend past MLLW,
no authorization will be necessary. In other words, you will not need a lease for the improvement
and will not need a right of entry license to perform any work on the ramp UNLESS you extend the
ramp below MLLW.

Hello Chris,
Thank you for your response. This project will focus on improving the existing boat launch. The current
launch will be left in place and new planks will be placed on top of the launch. The ramp will remain the
same length but will be expanded slightly on each side. Attached are the JARPA and project plans that
were previously submitted. Nothing has changed. We had a pause in the project because our team was
trying to acquire additional funding for mitigation. We have now received that funding so we are
proceeding with the project. Please let me know if you need any additional information.

Hi Michelle,
I remember speaking with you about the WDFW Right of Entry License for geotechnical borings out
at Snow Creek. Currently, there’s no lease in place for this. My predecessor, Bridget Kaminski-
Richardson, left the agency in 2021. She didn’t leave very many notes on this and it looks like there
may have been a question about whether or not it could even be leased. I’ll need to research this a
little more and then get back to you. In the meantime, what were DFW’s plans for the boat ramp out
there?

Hello Chris,
I’m an Environmental Planner with WDFW and I recently inherited a boat ramp project at Point Whitney
in Jefferson County. An Aquatic Lands Lease application (No. 20-101802) was submitted in January 2021
by a previous planner. I’m wondering if that lease was authorized. The DNR contact in the attached
letter is Bridget Kaminski-Richardson but I’m not sure if she’s still on this project.
