No. 77-01) Dear Mr. Stewart: As a member of the Olympic Stewardship Foundation, I request that the comments submitted by Attorney Dennis D. Reynolds on behalf of the OSF be incorporated in full as my comments. In addition, I wish to emphasize the following: • The proposed SMP amendment incorporates liberal construction. I insist that liberal construction must also apply to the laws and rules that have forced the SMP amendment to occur. This has not been done. • As an owner of common shoreline property that will be affected by the proposed SMP amendment, I contend that shoreline residents and shoreline property owners were deliberately excluded from the planning process in violation of the intent of the legislature. The ability of a public comment option is not adequate compensation for the failure to include affected landowners in the committee process. • The county was not diligent in using science to determine text in the proposed SMP amendment. The county failed to identify and assemble the most current, accurate, and complete scientific and technical information available that is applicable to the issues of concern. • Under the guise of providing planning assistance to the county, emboldened by a substantial sum of money paid to the county by the Department, Ecology inappropriately dictated provisions of the proposed SMP amendment that reflected personal views of Ecology’s representative in what the legislature intended to be a local planning effort.
