Dear Mr. Stewart,
I represent and manage property for several individuals and entities in Jefferson County. We have a long
history of protecting the environment and water quality. We are opposed to the Critical Areas requiring 150
foot setbacks and 10 foot buffers. Those distances appear arbitrarily established and subjectively determined
and are over designating huge areas which may subject the document to legal challenge. The Planning
Commission suggested 50 foot maximum setbacks. At 50 foot, a regulatory taking is less likely, would be
supported by the Planning Comm. and if supported by science the setback could/should be less than 50 foot. I
am concerned that both an Environmental Impact Statement and an Economic Impact Analysis have not been
completed. How will these huge setbacks impact not only the properties I manage but those of the county and
