No. 01 -0128-08, notes the project area the condition applies to, notes the phase of project development the condition applies to, and provides a completion status supporte d by staff analysis. The conditions are listed in the order they appear in the FSEIS. No. 01-0128-08 Earth, Water Resources 63(h) The possible ecological impact of the development’s water plan that alters kettles for use as water storage must be examined, and possibly one kettle preserved. Resort Environmental Review Complete (per FSEIS) The FSEIS includes a grading and drainage report (FSEIS Appendix E) that analyzes the interconnection between stormwater, water storage, irrigation, groundwater recharge, and wetlands. The project proposal preserves Kettle B, which includes a wetland at the bottom. The 2015 FSEIS analyzed an alternative that preserved Kettle C and converted Kettle B to stormwater storage. The current proposal preserves Kettle B and converts Kettle C to stormwater storage. The condition remains satisfied. Ord. No. 01-0128-08 Earth, Utilities 63(m) No deforestation or grading will be permitted prior to establishing adequate water rights and an adequate water supply. Resort Construction Permits Complete (per FSEIS) Water rights were granted by DOE in 2010. The Water System Plan identifies a deficiency in water rights necessary to serve the projected ERUs; PHMPR, however, has indicated they will seek a performance-based reduction in water usage and the water rights will be sufficient. The existing American Campground Well will be rehabilitated for use as a water supply. Ord. No. 01-0128-08 Earth, Water Resources 63(q) Stormwater discharge from the golf course shall meet requirements of zero discharge into Hood Canal. To the extent necessary to achieve the goal of designing and installing stormwater management infrastructures and techniques hat allow no stormwater runoff into Hood Canal, Statesman shall prepare a soil study of the soils present at the MPR location. Soils must be proven to be conducive to the intended Resort Construction Permits Complete (per FSEIS) Soils information was analyzed in the 2007 EIS and the 2015 SEIS. An updated geotechnical report was submitted with the preliminary plat application and validates prior analyses of soil conditions on the upland site. The stormwater report for the project affirms that PHMPR can achieve net zero discharge into Hood Canal. This will be verified with construction permits. The design and construction of the upland resort, as well as the operation of the marina, must meet the best management practices adopted in Appendix 1 of Amendment 1 to the FS&CA. Resort Site Design, Construction Permits Complete The geotechnical report requires a setback of 100 feet from the top of the coastal bluff for buildings, roadways and infrastructure facilities. No buildings, roadways or infrastructure facilities will be allowed within 100 feet of the landslide hazard area and further geotechnical review is not required. 2015 SEIS Earth Construction activities shall be completed in accordance with the recommendations in the 2008 Geotechnical Report (SEIS Appendix E) for erosion control, site drainage, and earthwork and in accordance with the Jefferson County Critical Areas Ordinance. Adherence to the geotechnical report is a required condition of each issued construction permit for the project. 2007 EIS Water Resources, Utilities Any project approval for the resort shall contain a condition that the applicant demonstrates entitlement to sufficient water rights to serve the approved phase from WDOE (water right, transfer, and/or rainwater harvesting rights and use conditions) prior to preliminary plat approval and construction of any facilities on the property. Resort Preliminary Plat Complete (per FSEIS) Water rights were granted by DOE in 2010. In addition to the FSEIS, the applicant has submitted a Technical Memorandum from Steven D. Hatton P.E. that further outlines that resort has sufficient water rights to service the MPR. 2007 EIS Water Resources Stormwater management plans for clearing and grading and for construction and operation phases must be approved and systems in place prior to land disturbing activities to assure control of the stormwater as provided above. The golf course will be managed under the Best Management Practices for Golf Course Development and Operation guidelines published by King County in 1993. A Water Quality Monitoring Plan was adopted as Appendix N to the Development Agreement, and it includes adaptive management procedures to maintain groundwater quality and quantity. While the Monitoring Plan is complete for purposes of the condition, the monitoring obligations are ongoing and the Applicant has already commenced the monitoring. 2007 EIS Water Resources Groundwater and water quality monitoring will be performed at monitoring wells installed along the bluff and interior of the project site. Surface water sampling locations and groundwater monitoring wells were established to create the Water Quality Monitoring Plan adopted as Appendix N to the Development Agreement. The Applicant has been conducting groundwater monitoring and reporting results as required by Appendix N. Ord. No. 01-0128-08 Water Resources, Plants 63(a) Any analysis of environmental impacts is to be based on science and data pertinent to the Brinnon site. The developer will bear the financial cost of these reports. analysis was performed by the Pacific Groundwater Group in 2009. These analyses were confirmed by the Department of Ecology in 2010. The confirmed analyses were also incorporated into the FSEIS as Appendix F. Ord. No. 01-0128-08 Water Resources 63(r) A County-based comprehensive water quality monitoring plan specific to Pleasant Harbor requiring at least monthly water collection and testing will be developed and approved in concert with an adaptive management program prior to any site-specific action, utilizing best available science and appropriate state agencies. The monitoring plan shall be funded by a yearly reserve, paid for by Statesman, that will include regular offsite sampling of pollution, discharge, and/or contaminant loading, in addition to any onsite monitoring regime. Marina All Complete A Water Quality Monitoring Plan was adopted as Appendix N to the Development Agreement, and it includes monthly monitoring requirements. The Applicant has been monitoring as required by the plan. Ord. No. 01-0128-08 Water Resources 63(p) A [neighborhood water policy] shall be established that requires Statesman to provide access to the water system by any neighboring parcels if saltwater intrusion becomes an issue for neighboring wells on Resort Development Agreement, Preliminary Plat Ongoing A Neighborhood Water Supply Plan was adopted as Appendix O to the Development Agreement. Final infiltration rates and stormwater system/facility sizing and design will be reviewed with construction permits. 2015 SEIS Water Resources Measures such as rainwater harvesting (i.e., collecting and storing stormwater for beneficial use, such as irrigation, fire flow, etc.), and drought-tolerant landscaping could minimize requirements for irrigation with potable water. Although Resort Site Design, Construction Permits Ongoing The site design accommodates stormwater storage in Kettle C, and PHPMR has indicated it will implement rainwater harvesting and water reuse for irrigation and other nonpotable uses on the site. Certain areas of the site not planned for development could be reserved for maintaining or adding vegetation to maximize evapotranspiration. Reduction of roadway width to the minimum acceptable to Jefferson County and the local fire district would reduce runoff quantities. Resort Site Design, Construction Permits Ongoing The project proposes a modest amount of impervious surface, with substantial portions of the site reserved in passive or active open space areas and natural vegetation areas. Proposed roadway widths appear to be narrower than typical Jefferson County public road standards, and review and approval of a narrower road section is required during construction permits. 2015 SEIS Water Resources Periodic monitoring of groundwater levels, chloride concentrations, and specific conductance in select wells will be conducted to monitor potential seawater intrusion. A Water Quality Monitoring Plan was adopted as Appendix N to the Development Agreement, and it includes periodic groundwater monitoring requirements. 2015 SEIS Water Resources Implement the best management practices within the Pleasant Harbor Golf Course BMP Plan (GeoEngineers, 2012) as applied to water use, water quality, and construction management. Resort Operation Not Complete Not applicable to preliminary plat. Implementation of the BMPs is required during operation of the resort. No. 01-0128-08 Plants, Shorelines, Rural Character and Population, Aesthetics 63(s) The developer will ensure that natural greenbelts will be maintained on US Highway 101 and as appropriate on the shoreline. Statesman shall record a conservation easement protecting greenbelts and buffers to include, but not be limited to a 200 foot riparian buffer along the steep bluff along the south Canal shoreline, the strop of mature trees between US 101 and the Maritime Village, wetlands and wetland buffers. Easements shall be perpetual and irrevocable recordings dedicating the property as natural forest land buffers. Statesman at its expense shall manage these easements including removing, when appropriate, naturally fallen trees and replanting to retain a natural visual separation of the development form Highway 101. All Development Agreement Not Complete A conservation easement was recorded on February 29, 2024, to protect the area within 200 feet of the ordinary high water mark of Hood Canal and the area within 10 feet of frontage along US Highway 101 right-of-way. Wetlands and their buffers will be placed into easements as a condition of final plat approval. Ord. No. 01-0128-08 Plants, Shorelines, Aesthetics 63(u) In keeping with the MPR designation as located in a setting of natural amenities, and in order to satisfy the requirements of the Shoreline Master Program, the greenbelts of the shoreline should be retained and maintained as they currently exist in order to provide for screening of facilities and amenities so that all the uses within the MPR are harmonious with each other, Resort Site Design Unknown A conservation easement was recorded on February 29, 2024, to protect the area within 200 feet of the ordinary high water mark of Hood Canal. The easement includes language to protect and maintain, in perpetuity, healthy native vegetation in the easement area. The easement is identified on the preliminary plat. The proposal complies with this part of Condition 63(u). In keeping with the Comprehensive Plan Land Use Policy 24.9, the site plan for the MPR shall be designed to blend with the natural setting and to the maximum extent possible, screen the development and its impacts from the adjacent rural areas. Evergreen trees and understory should remain as undisturbed as possible. Statesman shall infill plants where appropriate with indigenous trees and shrubs. preservation of natural features, and blending of buildings into the landscape. Ord. The landscape plan indicates undisturbed natural vegetation will exist between some buildings. These standards are recommended for “areas with intrinsically dark landscapes” such as national parks, areas of outstanding natural beauty, or residential areas where inhabitants have expressed a desire that all light trespass be limited.
