On January 28, 2008, Jefferson County's Board of County Commissioners (BoCC) adopted Ordinance No. 01-0128-08, a site-specific Comprehensive Plan amendment, establishing a Master Planned Resort 1 on the Black Point peninsula in the unincorporated Brinnon community and requiring a development agreement, among other conditions of approval.2 Then, after a project level environmental impact statement was completed in 2015, an approximately 1,000 page development agreement was negotiated. On June 4, 2018, Ordinance No. 03-0604-18 approved development regulations, in the form of amendments to titles 1l and j_l! of the Jefferson County Code (JCC). The same day, Ordinance No. 04-0604-18 approved the required development agreement for execution and recording. The development agreement was modified after a decision by the Kitsap County Superior Court3 that the phasing plan in the development agreement adopted via Ordinance No. 04-0604-18 was inadequate to satisfy legal requirements for a phased master planned resort (MPR). A revised phasing plan (including a revised Exhibit 4) was adopted on July 22, 2019, via Ordinance No. 08-0722-19. The revised development agreement and the development regulations in Ordinance No. 03-0604-18 control the development of the PHMPR. RCW 36.70.B.180 requires vesting to the development standards in the development agreement. The development standards in the development agreement are listed in section 8.
