Subject: Code Interpretation: JCC 17.65.040(1) Setback requirements
I.Summary and Background
The Pleasant Harbor Master Planned Resort (PHMPR) project has been planned,
discussed, and authorized at various planning levels for over 20 years, beginning with the
Brinnon Subarea Plan adopted in 2002.
On January 28, 2008, Jefferson County's Board of County Commissioners (BoCC)
adopted Ordinance No. 01-0128-08, a site-specific Comprehensive Plan amendment,
establishing a Master Planned Resort 1 on the Black Point peninsula in the unincorporated
Brinnon community and requiring a development agreement, among other conditions of
approval.2 Then, after a project level environmental impact statement was completed in
2015, an approximately 1,000 page development agreement was negotiated.
On June 4, 2018, Ordinance No. 03-0604-18 approved development regulations, in the
form of amendments to titles 1l and j_l! of the Jefferson County Code (JCC). The same
day, Ordinance No. 04-0604-18 approved the required development agreement for
execution and recording. The development agreement was modified after a decision by
the Kitsap County Superior Court3 that the phasing plan in the development agreement
adopted via Ordinance No. 04-0604-18 was inadequate to satisfy legal requirements for
a phased master planned resort (MPR). A revised phasing plan (including a revised
Exhibit 4) was adopted on July 22, 2019, via Ordinance No. 08-0722-19. The revised
development agreement and the development regulations in Ordinance No. 03-0604-18
control the development of the PHMPR. RCW 36.70.B.180 requires vesting to the
development standards in the development agreement. The development standards in
the development agreement are listed in section 8. Appendices A through G of the
