Scott (DOH) Subject:Update on water rights for the Pleasant Harbor Marine and Golf Resort Attachments:2025 05 01 TMcDonald Ltr to MGallagher_.pdf Hello Ben, This email provides an update on the status of the Department of Ecology’s assessment of water rights proposed for use by the Pleasant Harbor Marina & Golf Resort (PHMGR) near Brinnon, Je&erson County. On July 31, 2024, Ecology issued a “show cause” letter to PHMPR, sharing our preliminary findings that Water Right Certificate G2-20465C, originally issued to American Campground, had been wholly or partially relinquished, and requesting that PHMGR show cause why the right should not be relinquished. Certificate G2-20465C was issued on May 9, 1975 for 55 gallons per minute with an annual limitation of 25 acre- feet for the purpose of community domestic use. On May 1, 2025, the Department of Ecology received a request from PHMGR to voluntarily relinquish the majority of Water Right Certificate G2-20465C. PHMGR has agreed to relinquish 19.4 acre feet and 40 gallons per minute, while retaining 5.6 acre feet per year and 15 gallons per minute. See attached file. This letter and the accompanying partial relinquishment form satisfy Ecology’s July 31, 2024 request to PHMPR to show cause whether this water right should not be wholly or substantially relinquished. The remaining allocation will be available for use by PHMGR, in addition to the surface and groundwater permits, S2-30437 and G2-30436. The total domestic use will be limited to the amount authorized for community domestic purposes by groundwater permit G2-30436 (121 acre-feet per year, 300 gallons per minute) in addition to the amount remaining with groundwater certificate G2-20465C (5.6 acre feet year, 15 gallons per minute), for a total of 126.6 acre feet per year. The project as a whole, including the irrigation use authorized by surface water permit S2-30437, may not exceed 254 acre-feet per year, with a maximum pumping rate of 300 gallons per minute under the two groundwater rights and the surface water right. This limitation is for the purpose keeping the project in compliance with the overall allocation authorized for the project in surface and groundwater permits S2-30437 and G2-30436. Those permits provided that, “Groundwater withdrawals under all water rights for this project shall not exceed an instantaneous rate of 300 gallons per minute and a total annual quantity of 254 acre-feet per year.” (Superseding permit G2- 30436, issued November 23, 2022). This limitation does not foreclose the Project from obtaining additional water supply from other sources if necessary for the development of the full project. Per our discussions and review of historical use, Garth Mann, owner to the water right agrees to relinquish 40 gallons per minute (gpm) and 19.4 acre feet/year (afy). The remaining 15 gpm and 5.6 afy will remain available as a valid portion of the Water Right for the Pleasant Harbor development for domestic water supply at the authorized point of withdrawal and place of use. Will you please inform the Department of Health of this resolution for the purposes of Ecology’s review of the water rights assessment for the Pleasant Harbor Draft Water System Plan.
