Section 8.8.3 of the development agreement requires a cultural resources management plan that supports tribal access and community education opportunities. Please provide a narrative or similar information explaining how the project is consistent with these requirements. PHMPR may choose to highlight features of site design and layout, plans to install educational signage, agreements with affected tribes, or similar information that may exist. Please note that appendix Q of the Development Agreement is an archaeological monitoring plan with inadvertent discovery protocol and does not explain how the project achieves the project requirements outlined in the Development Agreement. PHMPR RESPONSE In an effort to support Tribal access and cultural education opportunities PHMPR has reconfigured the development to preserve kettle “B” in a natural state and relocate the stormwater retention pond to kettle ”C”. We have invited the Port Gamble SKlallam Indian tribe and the Skokomish Indian tribe to participate in the design of signage for this feature describing its cultural significance. This feature is located in the publicly accessible portion of the Development. We have not received any feedback from either tribe in response to our invitation however we were copied on a government-to-government correspondence that states the property in question was in the area traditionally occupied by the Skokomish tribe. The project also includes a 200-foot-wide conservation easement along the bluff above the tidelands on the southern edge of the development. This easement was incorporated specifically to protect the shellfish beds of the Duckabush delta traditionally used by the Skokomish tribe. The tribe made a request for this easement. Exhibit 42
