Hello, Phil- Through this email Pleasant Harbor agrees to stop or toll the deadline imposed by RCW 58.17.140 upon the County to approve, disapprove or modify the preliminary plat application until further notice which Pleasant Harbor reserves the right to provide in its sole and absolute discretion. This agreement to toll the review period relates back to the submission or our responses to the County comments last Friday. Please let me know if you need anything further from me. Exhibit 62 2 JT: There are two issues that need immediate attention: (1) Whether BHC is an “other consultant” or a “Building Inspector” under the Future Staffing and Consulting Agreement (FCS &A) or an “other consultant.” (2) Stopping the “Clock.” (1) Building Inspector v. Other Consultant issue. John and Ryan think that BHC is an “other consultant” and not a “building inspector” under FS&CA. John and Ryan are arguing that they didn’t have a say in hiring BHC because BHC is an “other consultant.” But the FCS &A is to the contrary. BHC is the Building Inspector here: The FS&C Agreement does not require pre-approval for a “Building Inspector: BHC does not need PHMPR’s approval to use BHC. Also, it is my understanding than John was introduced to Shane at BHC previously. We need a quick resolution of this issue because BHC is who has been reviewing the Agri- building permit documents. I am sure you recall our discussion about getting a meeting with Shane, Phil C. and us as quickly as possible after BHC got its draft letter to the county. We now have the draft letter. (2) Stopping the “Clock.” When PHMPR submitted its documents for preliminary plat completeness, it included a revised preliminary plat. This was not what the county was expecting based on our discussions. I did not know this when I sent my email to you yesterday (below), which said in part, “Ryan submitted PHMPR’s remaining documentation, less the revised preliminary plat on Friday in an electronic form. Hard copies are expected today. I will confirm with Cristina and George that they believe all the expected documents were received. It would be great if you could send the letter we discussed acknowledging the clock is not running yet.” We were expecting the revised plat in about two weeks, with you writing a letter addressing the “clock issue.” Also, John’s approval of Otak to do the work instead of SCJ on February 3, 2025 also required the county to suspend the clock. (“Cristina I approve OTAK for the civil review of our preplat subject to an approved scope and budget.”) Since the clock would have started running yesterday the county had to address the “clock” issue. The attached letter from Cristina is the vehicle by which the county stopped the clock. Separately, I sent you the key documents for understanding how building fees work. They are all copied on this email for convenience. Do you have a few minutes this afternoon after 4 p.m. to discuss this? If not, would you please suggest other times in the next couple of days? I was looking at current fee information for DCD for building fees (attached) in connection with the BHC contract I sent you last week (attached). I think we should talk about these documents when convenient. Ryan submitted PHMPR’s remaining documentation, less the revised preliminary plat on Friday in an electronic form. Hard copies are expected today. I will confirm with Cristina and George that they believe all the expected documents were received. John confirmed in writing that PHMPR prefers OTAK to SCJ for civil review of any remaining preliminary plat documents. As I understand it, John and Ryan had a good meeting with on Friday with Josh and Phil Cecere. They worked through issues on the Agri-Building. Still pushing for a meeting with Shane Daugherty and Phil C. on building permits, etc. You can expect the next draft of the FS&C Agreement by close of business on Friday.
