The Senate adjourned for the long holiday weekend without a resolution. On Wednesday, the chamber once again failed to reach the 60-vote threshold needed to advance the House-passed Continuing Resolution (CR), which would fund the government through late November, in a 54–45 vote. Democrats remain steadfast in their demands of seeking an extension of Affordable Care Act (ACA) healthcare subsidies and proposing safeguards in the budget and appropriations process. Senate Republicans and Democrats are apparently working privately on a potential deal renew those expiring ACA tax credits in hopes of reaching a resolution before the open enrollment period begins November 1st. However, some Republican leaders contend that healthcare demands should be addressed separately once the government reopens. House Appropriations Committee Chairman Tom Cole has asserted that “we should not be handling Medicaid on my committee. And we should not be handling Obamacare subsidies on my committee. We simply don’t have the expertise or the jurisdiction to do anything on either one of those things.” The military is scheduled to receive a payday on October 15th next week, adding pressure on lawmakers to either end the shutdown or pass standalone legislation to provide those paychecks to nearly 2 million service members. Some smaller airports are beginning to report staffing issues with Air Traffic Control (ATC). Other lawmakers are concerned that expired authorizations for cybersecurity programs and the National Flood Insurance Program increase our vulnerabilities. House Speaker Mike Johnson, for the time being, has maintained his stance against reconvening the House of Representatives. Lawmakers remain on a “48-hour notice to return if something changes.” Federal Funding * Twenty-nine cities and counties across California, Washington, and Arizona filed a lawsuit <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=97dee6abcd&e=7ccb4f03e2 > last week in the U.S. District Court for the Northern District of California against the U.S. Department of Homeland Security (DHS), challenging the withholding of $350 million in federal grants administered by the Federal Emergency Management Agency (FEMA). The local governments contest that the funding – designated for disaster preparedness, emergency response, terrorism prevention, cybersecurity improvements, and first responder staffing – has long served as a critical lifeline for their communities and that the new conditions imposed by the Trump-Vance Administration are unlawful. Reductions in Force * Democratic members of the Senate Banking, Housing, and Urban Affairs Committee and the House Financial Services Committee filed <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22f e2ef2a8361&id=c4c8bc61e6&e=7ccb4f03e2> an amicus brief <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=0e3c1a69cb&e=7ccb4f03e2> urging the U.S. Court of Appeals for the D.C. Circuit to rehear a case challenging the Trump-Vance Administration’s attempt to unlawfully terminate large numbers of employees at the Consumer Financial Protection Bureau (CFPB). Lawmakers stressed that “Shuttering the CFPB would not just run afoul of the Constitution, it would also destroy the framework Congress created to safeguard the finances of American consumers. That framework has been a resounding success, with the Bureau delivering billions back to consumers who have been defrauded.” Transportation U.S. Department of Transportation Office of the Secretary * Last Friday, the U.S. Department of Transportation (DOT) published an Interim Final Rule (IFR) <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=e56521b5a4&e=7ccb4f 03e2> substantially revising its regulations governing the Disadvantaged Business Enterprise (DBE) and Airport Concession Disadvantaged Business Enterprise (ACDBE) Programs. According to the Federal Register Notice, the rule is intended to ensure that the programs are operated in a “nondiscriminatory fashion - in line with law and the U.S. constitution” moving forward. It seeks to accomplish this goal by removing “race- and sex-based presumptions of social and economic disadvantage that violate the U.S. Constitution” from DOT regulations. It then mandates that each state's United Certification Program (UCP) reevaluate each existing DBE and ACDBE based on new certification standards and then recertify or decertify them accordingly. Current certifications are suspended pending recertification, and newly applying DBEs or ACDBEs must also meet the revised standards for certification. The IFR became effective on October 3, 2025, but DOT will accept public comments from stakeholders until November 3, 2025. * DOT shared <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=9b247be5bc&e=7ccb4f03e2> on Wednesday that the agency secured $41 million in additional funding to sustain the Essential Air Service (EAS) program through early November. The Department had previously warned EAS-eligible communities and air carriers on Monday of a potential suspension of EAS contracts and Alternate Essential Air Service (AEAS) Grant reimbursements as soon as next week due to the current government shutdown. In a statement, Transportation Secretary Sean Duffy emphasized the importance of the program to “American communities relying on services like EAS to connect their rural neighborhoods with vital services and opportunities.” * The Senate confirmed <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=80a9bf4e6b&e=7ccb4f03e2> CSX Vice President Michael Rutherford to serve as the first Assistant Secretary for Multimodal Freight Infrastructure and Policy at DOT. The role was created by Congress in 2021, and Mr. Rutherford will lead the agency’s efforts to develop national freight policy and data-sharing initiatives while overseeing freight-related grant programs, research efforts, and working groups. These Executive Orders and other directives pause some transportation funding; terminate diversity, equity, and inclusion programs; impose new tariffs; and establish priorities for DOT competitive grants.
