Subject: Immediate Request to Pause the Evans Vista Removal and Align with Lawful Process

Dear Councilmembers and City Manager,
At Monday’s meeting, several contradictions became clear. City Manager Mauro described the planned November 3 removal as an act of “compassionate urgency,” yet service providers and
residents made it clear that there is no lawful, supported alternative site ready. The Behavioral Health Consortium has confirmed they will not have a site by that date, and the public
record now reflects this.
Mayor Faber stated that removing residents without an available site would be “morally unjustifiable,” but then said the City’s “hands are tied.” Multiple Councilmembers also noted that
for 18 months, they had asked the City Manager to pause enforcement at this same location, and he did. That establishes both discretion and precedent.
If that discretion existed before, it exists now. The next step is clear: convene the housing and behavioral health consortium to determine a realistic, evidence-based timeline for relocation,
and use the City’s existing legal tools to align with that plan.
We are not asking for an indefinite delay, but for a short, structured pause developed with local service providers to prevent predictable harm.
We have attached a formal response letter to this email that outlines these points in detail, including the legal, administrative, and public health pathways available to lawfully pause
enforcement under RCW 35A.13.080, RCW 35A.63.220, and PTMC 17.62.
We urge the City to act now: issue a brief administrative stay, adopt an interim ordinance, and work with the Behavioral Health Consortium to set a humane and lawful timeline. The authority
exists. The question is whether we will use it to protect life, dignity, and due process.
