The project shall adhere to the Best Management Practices (BMPs) to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. 2.) A vegetative buffer of 30-feet shall be permanently maintained from the top or edge of the Landslide Hazard Area. All buffers shall be measured perpendicularly from the top of the Landslide Hazard Area. 3.) Landslide Hazard Areas and their associated buffers shall remain naturally vegetated. Should buffer disturbance occur during construction, the Unified Development Code (UDC)Administrator shall require replanting with native vegetation. No alterations shall be made to the Landslide Hazard Area or its associated buffer without prior authorization by the UDC Administrator. 4.) Prior to and during approved construction activities, the perimeter of the landslide hazard area buffer shall be marked with a temporary sign. The sign shall be placed in such a manner that it can be directly observed from the construction area. The sign shall contain the following statement: "Landslide Hazard Area and Buffer- Do not Remove or Alter Existing Vegetation." 5.) All construction activities shall not encroach upon the buffer. This includes the storage or preparation of materials. 6.) The applicant shall permanently separate the boundary of the Landslide Hazard Area Buffer from the remainder of the subject property through installing logs, trees, a hedge row, or any other prominent physical marking approved by the UDC Administrator. 7.) The identified Fish and Wildlife Habitat Area (Type I Stream), shall maintain a vegetative buffer setback of 150 feet. The setback shall be measured horizontally from the Ordinary High Water Mark (OHWM) to the carport. 8.) An additional setback of five (5) feet is required from the edge of the buffer area to the proposed carport. 9.) A permanent physical separation along the boundary of the buffer area shall be installed and permanently maintained. Such separation can include installing logs, trees, a hedgerow, or any other prominent physical marking approved by the UDC Administrator. 10.) Buffer perimeters shall be marked with temporary signs at an interval of one per parcel or every one hundred (100) feet, whichever is less. Signs shall be in place prior to and during construction activities. The signs shall contain the following statement: "Buffer- Do Not Remove or Alter Existing Vegetation." 11.) Outdoor residential storage shall be maintained in an orderly manner and shall create no fire, safety, health or sanitary hazard. 12.) Not more than two (2) unlicensed or inoperable vehicles shall be stored on any lot less than one-half acre unless totally screened from view of neighboring dwellings and rights-of-way. Such screening shall meet all applicable performance and development standards specific to the district in which the storage is kept, and shall be in keeping with the character of the area. Screening shall meet the requirements of Unified Development Code (UDC) Section 6. Outdoor storage of thirteen (13) or more unlicensed or inoperable vehicles is prohibited except in those districts where specified as an automobile wrecking yard or junk (or salvage) yard and allowed as a Permitted Use in Table 3-1 of the UDC, and such storage shall meet the requirements of UDC Section 4.10. In no case, shall any such unlicensed or inoperable vehiclesbe stored in an Environmentally Sensitive Area (ESA). 13.) Maximum lot coverage is not to exceed 25%. Lot coverage is defined as amount of impervious surface which includes roof tops, driveways, concrete, etc. 14.) The building height is not to exceed 35 feet. 15.) Minimum setback from Valley View Ln right-of-way shall be 20 ft. Minimum side and rear setbacks shall be 5 ft unless an environmentally sensitive area (ESA) exists, then the stricter setback shall apply. 16.) Lighting fixtures shall be designed and hooded to prevent the light source from being directly visible from outside the boundaries of the property. The intensity or brightness of all lighting, during construction and after project completion shall not adversely affect the use of surrounding properties or adjoining rights-of-way. 17.) Exterior lighting for residential s shall not exceed twenty feet(20') in heig t from the finished grade, excepting when such lighting is an integral part of a building or structure. Ground level lighting is encouraged. 18.) A minimum "no touch" buffer of 100 feet shall be established along the Duckabush River to protect mature conifer and future loafing sites for Harlequin Ducks. Minimum human disturbance within and adjacent to this riparian buffer during the April through June breeding season is recommended. 19.) Human disturbance shall be kept at a minimum to ensure the health and reproductive success of the Roosevelt Elk. The property shall retain to the greatest extent practicable any existing native vegetation. The landowners shall be very aware that any landscaping would likely become an attractant to elk. The elk habitat will likely have some damages to the property due to foraging. 20.) The development shall assure that surface water runoff does not pollute adjacent waters or cause soil or breach erosion either during or after construction. 21.) All trees and understory lying outside of road rights-of-way and utility easements shall be retained (except for hazard trees) during clearing for roadways and utilities, provided that understory damaged during approved clearing operations may be pruned. Damage to vegetation retained during initial clearing activities shall be minimized by directional felling of trees to avoid critical areas and vegetation to be retained. Activities and improvements which do not significantly affect the function of the Fish and Wildlife Habitat Area or Stream Buffer(s) (including viewing structures, outdoor scientific or interpretive facilities, trails, etc) may be permitted in Fish and Wildlife Habitat Areas or Stream Buffers. Trails and other activities shall be planned to minimize removal of trees, shrubs, snags and important wildlife habitat. 22.) Viewing platforms, interpretive areas, benches and access to them, shall be designed and located to minimize impacts to wildlife, fish, or their habitat and/or critical characteristics of the affected conservation area. Trails, in general, shall be set back from stream so that there will be minimal impact to the stream from trail use or maintenance. Trails shall be constructed with pervious surfaces when feasible and trails within the Fish and Wildlife Habitat Area are not intended to be used by motorized vehicles. 23.) Chemical applications are not permitted with the Fish and Wildlife Habitat Area unless expressly approved as part of a farm plan, forest practices application, or for the control of invasive or noxious plant species. In cases where approved chemical applications occur as part of a forest practices application, proper reporting procedures shall be followed. Chemical storage shall not be permitted in a the Fish and Wildlife Habitat Area or the Stream Buffers. 24.) No land use or development activity, even if the activity does not require a permit, shall be allowed that alters the function or character of the Fish and Wildlife Habitat Area or its buffers. This includes, but is not limited to activities involving: (1) The removal, excavation, grading, dumping, discharging, or filling of any material unless part of a project which has been permitted pursuant to the Jefferson County Unified Development Code. (2) The destruction or alteration of the Fish and Wildlife Habitat Area or its buffers through clearing, grading, harvesting, shading, intentional burning, vegetation removal or planting of vegetation that would alter the character of the Fish and Wildlife Habitat Areas or its buffers, unless part of a project which has been permitted pursuant to the Jefferson County Unified Development Code. 25.)
