LEGAL COUNSEL: Philip C. Hunsucker, Chief Civil Deputy Prosecuting Attorney
Melissa Pleimann, Civil Deputy Prosecuting Attorney
STAFF: Adiel McKnight, Deputy Clerk of the Board/Claims Administrator
CALL TO ORDER: Chair Melancon called the meeting to order at the appointed time. In attendance were
Members Peters, Frederick, Martine, and Prada. Also in attendance: Legal Counsel Melissa Pleimann.
PUBLIC COMMENT PERIOD: Chair Melancon called for public comments, and no comments were
received.
REORGANIZATION OF THE BOARD re: Appointment of new member: Member Peters announced
Resolution 63-0902-25R appointing Central Services Director Shawn Frederick as Safety Officer and
thanked Willie Bence for his commitment to the committee.
APPROVAL OF MINUTES: Member Prada moved to approve regular meeting minutes of August 5,
2025. Member Martine seconded the motion which carried by a unanimous vote.
NEW BUSINESS: DISCUSSION re: CLAIM(s)
• Claim C-02-25; Harry Hansen; Windshield damage with rock dings to RV; In the amount of
$10,698.99: Member Prada noted Public Works recommendation and moved to pay the claim as
presented in the amount of$10,698.99. Member Frederick seconded the motion. Chair Melancon
opened the floor for public comments, and no comments were received. Chair Melancon called for a
vote on the motion. The motion carried.
• Claim C-05-25; JNR Lumen; 6 pair buried cable and 200 pair buried cable located at 1130
Van Trojen Rd, Chimacum WA; In the amount of$2,306.65: Member Prada noted Public Works
recommendation to deny the claim of cable damaged by not burying it deep enough. After
discussion, Member Prade moved to deny the claim per recommendation of Public Works. Member
Peters seconded the motion. Chair Melancon opened the floor for public comments, and no
comments were received. Chair Melancon called for a vote on the motion. The motion carried.

• Claim C-06-25; JNR Lumen; 25 pair buried cable located at 3511 Paradise Bay Road, Port
Ludlow, WA 98365; In the amount of$7,527.23: Member Prada noted Public Works
recommendation to deny the claim of damaged cable. Member Peters moved to deny the claim based
on Public Works recommendation. Legal Pleimann noted that lumen did not comply with county
code and supports recommendation to deny. Member Martine seconded the motion. Chair Melancon
opened the floor for public comments, and no comments were received.
After further discussion, Member Peters withdrew his motion and moved to deny claim C-06-25
from JNR lumen due to failing to have a Franchise agreement with the County and not burying cable
deep enough per state law. Member Frederick seconded the motion. Chair Melancon opened the
floor for comments, and no comments were received. Chair Melancon called for a vote on the
motion. The motion carried.

• Legal update on case law
• Review and discuss RMC duties re: Article 6.3; Risk Management Policy approved on October 22,
2019;
• Review of Directs and Electeds Official Bond
