Dear STATE OF WASHINGTON-FISH/WDLF:
The Department of Community Development is in the process of reviewing your application. The
following information is needed to continue review of your project.
The plan sheets show mean higher high water (MHHW) for federal permitting but do not show the
ordinary high water mark (OHWM), which is used for local and state permitting. Please revise the
sheets to show OHWM in addition to MHHW.
DCD received the Eelgrass Delineation reports prepared by GeoEngineers dated July 13, 2018 and
February 18, 2021. Eelgrass is a fish and wildlife habitat conservation area (FWHCA) regulated
under county critical area regulations; however, other FWHCAs and associated buffers are also
regulated under Chapter 18.22 of the Jefferson County Code (JCC). Submit a Habitat Management
Plan (HMP), prepared by a qualified professional, that complies with JCC 18.25.270 and with Articles
VI (FWHCAs) and IX (Special Reports) of Chapter 18.22 JCC.
It is my understanding that some regrading of the point has been conducted in the past and that
WDFW would like this to serve as some of the mitigation that would be required for the current
application. To receive mitigation credit, submit documentation that shows compliance with JCC
18.25.270(2)(g). This documentation should be included in the HMP.
It is also my understanding that WDFW would like to use the In -lieu Fee Mitigation program through
Hood Canal Coordinating Council (HCCC). DCD will need a detailed impact assessment, which
should be included in the HMP, in order to determine how mitigation credits would be needed. The
impact assessment should clearly identify which project -related impacts WDFW would like to receive
mitigation credit (using JCC 18.25.270(2)(g)) and which impacts would be mitigated through HCCC.
Submit a stormwater calculation worksheet along with other required stormwater forms to the
department. The stormwater forms are needed for the portion of the project that occurs landward of
OHWM. These forms are available from the Jefferson County DCD land use permitting portal.

Please submit the above information to the Department of Community Development within 90 days
of the date of this letter which would be 7/20/2021. Please call 360-379-4450 to speak with the
assigned planner if you have any questions.
