SUBJECT: Final Short Plat Approval for Marina Short Plat SUB2024-00028
STATEMENT OF ISSUE: Staff is requesting final approval and signing of a four(4) lot short subdivision
located at 3 Pintail Road, Port Ludlow, WA 98365, per Chapter 18.35 JCC and RCW 58.17.170. The
Parcels are 968600010 and 968600002, owned by Port Ludlow Associates.

ANALYSIS:
Staff has determined that the application as submitted on November 6, 2024 and deemed complete on
December 10, 2024, meets the required criteria of Chapter 18.35.130 as addressed in written Findings
and Conclusions and Preliminary Plat Approval SUB2024-00015. Written Findings and Conclusions are
required per RCW 58.17.195, which state in part that a county makes a formal written finding of fact that
the proposed subdivision or proposed short subdivision is in conformity with applicable zoning ordinance
or other land use controls which may exist.
ALTERNATIVES:
The requested action is mandatory per RCW 57.17.170 and Chapter 18.35 JCC.
FISCAL IMPACT/COST BENEFIT ANALYSIS:
There is no identifiable fiscal impact related to this request for final plat approval. New tax parcels will
generate property tax revenue for the County.
RECOMMENDATION:
Per Jefferson County Ordinance and State Law, DCD requests that the BoCC grant final short plat
approval by signing the final Plat mylar.

PROJECT DESCRIPTION: SHORT SUBDIVISION — MARINA SHORT PLAT a proposed four-lot short
subdivision of .45 acres +/- within the existing Ludlow Bay Village Short Plat, MPR— RC/CF Master
Planned Resort Complex/Community Facilities zone of the Port Ludlow Master Planned Resort. This

FINDINGS:
1. The Administrator finds that this application complies with applicable provisions of the Port
Ludlow Development Agreement (AFN 435974), all other applicable ordinances and
regulations, and is consistent with the Jefferson County Comprehensive Plan and Land Use
map.
2. The application was received on November 6, 2024 and deemed complete on December 10,
2024.
3. The application is a re-platting of the Ludlow Bay Village Long Plat, Volume 6, page 231, May
1994, to re-create four separate parcels from two parcels that resulted from a lot consolidation
of the original four lots (SF1 —4) and partial lot 11M-1" under Boundary Line Adjustment
(SUB2018-00021).
4. The site is within the MPR Resort Complex Zone (MPR-RC/CF).
5. A Site Development Review(SDR2024-00221) was submitted for the site on December 10,
2024.
6. Potable water sewer to be served by Olympic Water and Sewer(OWSI).
7. Access to lots to be served by existing and approved road system.
8. Stormwater management review by the Public Works Department, and will be reviewed again
at time on building permit application.

9. Any future structures will require building permits and individual 911 addressing.
10. The application was duly noticed as a revised notice of application for a 10 day public comment
on January 15, 2025. DCD received three (3) written comments from the public: Alan Kiesler,
Twyla Jackson, and Katie Smith, and comments from the Assessor's Office and the
Department of Public Works.
11. Public Comments were in opposition to the plat due to the following:
a. Residential use inconsistent with current historic and commercial development. Staff
Response: The application is a re-platting of the Ludlow Bay Village plat from 1994
which is vested development that is returning to its original lot configuration after being
reduced from four separate developable lots to two parcels under a boundary line
adjustment. Residential use is an allowed use in the Resort Complex Zone.
b. Shoreline Setback should be 150 feet. Staff Response: The application was deemed
complete and as a subdivision, was vested under the Port Ludlow Development
Agreement before its expiration on May 8, 2025, and therefore, is vested to the
shoreline setback of 15 feet from the ordinary high water mark under Appendix F, Urban
Shoreline Designation, Performance Standards, Section 4, page 32.
c. Critical Areas and Flood Zones preclude development. Staff Response: Staff will
address critical areas in a separate section below.
d. Rezone or Variance. Staff Response: The application is neither a re-zone or a variance,
but a re-platting of a legal subdivision with vested development rights.
e. Lots are too small for residential development. Staff Response: There is no lot size
limitation under JCC 17.25.050 for the Resort Complex zone.
f. Stormwater runoff and pollution. Staff Response: The developer is required to comply
with the most current version of the Washington State Department of Ecology
Stormwater Management Manual for Western Washington, which may necessitate an
engineered plan per the Jefferson County Public Works Department.
g. The site is currently being used by residents of Port Ludlow, and if developed, they
would have no other place to gather at the marina. Staff Response: The developer has
generously allowed public use of their private property until such time as they could
develop the site. The site was intended and vested for development and the developer
has the right to do so.
12. Critical Area Review: Staff reviewed the site using the County's GIS critical area mapping
layers, and conducted a site visit to determine if any critical areas could be identified to have a
potential negative impact to the development. These GIS map layers are for informational
purposes only, and are useful in helping to identify potential critical areas that may need closer
inspection by staff, or evaluation by a professional in the field. The site has gone through critical
area review for the original plat and the boundary line adjustment in 2018. Although listed on or
near the site, staff determined the listed critical areas would not require further analysis by an
expert in the field, require mitigation to approve the subject application, or preclude approval.
The site will be reviewed again at time of building permit application for specific development.
a. FEMA Flood Zone—although along the shoreline at or slighting above ordinary high
water mark, the building site is not within the flood zone.
b. Flood Hazard Zone - This overlay is derived from the Sea Level Rise Study. It shows the
extent of sea level rise projected along county marine shorelines. The Flooding Hazard
Zone is for information only; we do not regulate the projected increase.
c. Geohazard Area —the site was modified many years ago by cutting the slope to create
the flat buildable area where the Marina office and the subject building site. This site
was evaluated and approved for development under the Ludlow Bay Village plat, and
has not changed geologically since that modification. Seismic code requirements will be
review at time of building permit application.
d. Wetlands—although mapped along the shoreline, are not present on-site.

e. SIPZ—Saltwater Intrusion Protect Zone applies only to well water use and does not
apply when using an approved public water source.
13. Shoreline Designation and Regulations. The site is identified as Urban Shoreline Designation
under Appendix F of the Development Agreement, corresponding to the High Intensity
Shoreline Designation currently under Chapter 18.25 of the Unified Development Code.
14. Corresponding shoreline setback shall be 15 feet from the ordinary high water mark per
performance standards#4 on page 32 of Appendix F of the Development Agreement.
15. This approval for preliminary plat only, subject to the following conditions prior to final plat
recording
CONDITIONS:
1. Remove the word "preliminary" from the top of each page of the face of the plat.
2. Replace "MLA24-000XX" and "SUB24-000XX" from the top right of each page of the face of the
plat with "SUB2024-00028."
3. Change the year date from 2024 to 2025 from the Community Development signature block,
and wherever applicable.
4. It is the responsibility of the applicant to ensure that the final plat is submitted in accordance
with the conditions of this preliminary approval, and the requirements of 18.35.200 Final Short
Plat. This includes paying annual property taxes, paying all recording fees, and submitting a
Mylar suitable for recording.
5. Preliminary plat approval shall expire July 18, 2030. The Department of Community
Development shall not be responsible for notifying the applicant of impending preliminary short
plat approval expiration.
6. Prior to conducting land disturbing activity on the subject parcels, the proponent shall receive
County approval of a Stormwater Site Plan with Stormwater Management Permit, and/or a
building permit reviewed for stormwater.
The decision of the Director is the final decision of the County unless a timely appeal is filed with the
Hearing Examiner in accordance the procedures below.
APPEAL PERIOD: Any appeal of this decision must be filed in writing with the Department of
Community Development' within fourteen (14) calendar days of the date of the decision. The appellant
shall pay the required fee and submit an appeal document that identifies the decision appealed, the
date of the decision, and includes a summary of the grounds for appeal. The requirements for filing an
appeal are found in Section 17 of the Land Use Procedures Code, Ordinance No. 04-0828-98, a copy
of which is available on request from the Department of Community Development or you can find it
online here (applicable pursuant to the Port Ludlow Development Agreement).
