Hunsucker, Chief Civil DPA1November 10, 2025 OPIOIDS STATUS Jefferson County sued manufacturers, distributors, and pharmacies who created the opioid crisis in the MDL in the U.S. District Court for the Northern District of Ohio.Keller Rohrback represents Jefferson County and other Washington municipalities on a contingent fee.Jefferson County joined because big pharma created a public nuisance in Jefferson County and the PAO determined there was a potential for recovery.One Washington Settlement created an allocation model for distribution of 0.4417137380%to Jefferson County of settlement amounts paid to WA State.Salish Behavioral Health Administrative Services Organization (SBH-ASO) ensures all settlements are used for Opioid Abatement, which is broadly defined.Opioid Litigation OverviewNovember 10, 20252SBH-ASOOPIOIDS STATUS All SettlementsMust Be Used for Opioid AbatementNovember 10, 20253“All Opioid Funds, regardless of allocation, shall be utilized pursuant to Approved Purposes as defined herein and set forth in Exhibit A. Annual Payments to the CountyNovember 10, 20255OPIOIDS STATUS Opioid Litigation – 9 New SettlementsThe Sacklerswill pay $1.5 billionand Purduewill pay approximately $900 million in the first payment, followed by $500 million after one year, an additional $500 million after two years, and $400 million after three years. The AGO values the Washington payout on this settlement at “$105.6 million payable over 15 years.” This settlement is the nation’s largest settlement to date with companies responsible for the opioid crisis.Alvogen, Inc. to immediately pay up to approximately $19 million.Amneal Pharmaceuticals, Inc. to pay up to approximately $74 million over 10 years, and to provide either approximately $177 million of its generic version of the drug Narcan or up to an additional approximately $44 million in cash.November 10, 20256OPIOIDS STATUS Opioid Litigation – 9 New SettlementsAponte Inc. to immediately pay up to approximately $65 million.Hikma Pharmaceuticals USA Inc. to immediately pay up to approximately $98 million, and to provide either approximately $35 million of its naloxone product or up to an additional approximately $7 million in cashIndivior Inc. to pay up to approximately $75 million over five years, a portion of which, at the election of the state, could be paid in the form of Indivior’s branded buprenorphine or nalmefene products with a value of up to $140 million.November 10, 20257OPIOIDS STATUS Opioid Litigation – 9 New SettlementsMylan Pharmaceuticals Inc. to pay up to approximately $290 million over nine years.Sun Pharmaceutical Industries, Inc. to immediately pay up to approximately $32 million.Zydus Pharmaceuticals (USA), Inc. to immediately pay up to approximately $15 million.November 10, 20258OPIOIDS STATUS Opioid Litigation – 9 New SettlementsWashington Attorney General’s Office (AGO): Since all cities and counties participatein all of the settlements, local governments in Washington “will collectively receive approximately $61.1 million over 15 years.” The AGO estimates that the Jefferson County’s shareof the 9 settlements will be $2,556,418.26, paid out over time.The Purdue Pharma/Sackler depends on Purdue’s ongoing bankruptcy proceedings, which could be subject to a lengthy appeals process, we do not yet know when payments are likely to begin. However, the bankruptcy plan received support from more than 99% of voting creditors, according to Purdue’s website.*G8 settlements are expected to be finalized in early January 2026 with payments potentially starting in the first quarter of 2026.
