JCC 18.15.315 Table 3-2 requires a 150 ft. buffer froir a Type 1 Stream (Little Quilcene River) which has a Conservancy Shoreline Designation. The building permit for the existing residence was issued on March 15, 1978 (Permit#2119). The existing residence does not meet the above buffer and setback requirements. Per WAC 173-27-080 structures that were legally established and are used for a conforming use but which are non-conforming with regard to setbacks, buffers or yards; area; bulk; height or density may be maintained and repaired and may be enlarged or expanded provided that said enlargement does not increase the extent of nonconformity by further encroaching upon or extending into areas where construction or use would not be allowed for new development or uses. The proposal is to demolish a portion of the existing residence, remodel the residence using the existing foundation and construct and addition. The residence and addition will remain 78 feet from the ordinary high water mark of the Little Quilcene River. The administrator has determined this proposal is not increasing the extent of non-conformity with regards to setbacks. THE VESTING OF THE SETBACK OF THE RESIDENCE FROM THE LITTLE QUILCENE RIVER WAS BASED ON THE NEW PROPOSAL USING THE EXISTING FOUNDATION. IF DURING DEMOLITION OR CONSTRUCTION THE BUILDING OFFICIAL DETERMINES THE EXISTING FOUNDATION CAN NOT BE USED THE PROJECT SHALL STOP WORK. THE PROPOSAL SHALL LOSE ITS VESTING AND BE REQUIRED TO MEET THE BUFFERS AND SETBACKS WHICH WERE IN PLACE ON MARCH 17, 2006. A NEW SITE PLAN SHALL BE SUBMITTED TO THE DEVELOPMENT REVIEW DIVISION OF COMMUNITY DEVELOPMENT DEMONSTRATING THE PROJECT MEETS THESE REQUIREMENTS. 2.) PRIOR TO FINAL INSPECTION/CERTIFICATE OF OCCUPANCY THE OWNER SHALL PROVIDE A POST CONSTRUCTION FLOOD ELEVATION CERTIFICATE PREPARED BY A LICENSED SURVEYOR DEMONSTRATING THE: STRUCTURE WAS CONSTRUCTED A MINIMUM OF ONE (1) FOOT ABOVE THE BASE FLOOD ELEVATION. 3.) A permanent physical separation along the boundary of the buffer area shall be installed and permanently maintained. Such separation can include installing logs, trees, a hedgerow, or any other prominent physical marking approved by the UDC Administrator. 4.) Buffer perimeters shall be marked with temporary signs at an interval of one per parcel or every one hundred (100) feet, whichever is less. Signs shall be in place prior to and during construction activities. The signs shall contain the following statement: "Buffer- Do Not Remove or Alter Existing Vegetation." 5.) An additional setback of five (5) feet is required from the edge of the buffer area to the proposed residence. 6.) The project shall adhere to the Best Management Practices (BMPs) to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. 7.) The project shall comply with Construction Stormwater Pollution Prevention (SWPP) Elements #1 through#12 of the Department of Ecology's Stormwater Management Manual for Western Washington to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. 8.) Outdoor residential storage shall be maintained in an orderly manner and shall create no fire, safety, health or sanitary hazard. I 9.) Not more than two(2) unlicegld or inoperable vehicles shall be stored on any lot less than one-half acre unless totally screened from view of neighboring dwellings and rights-of-way. Such screening shall meet all applicable performance and development standards specific to the district in which the storage is kept, and shall be in keeping with the character of the area. Screening shall meet the requirements of Unified Development Code (UDC) Section 6. Outdoor storage of thirteen (13) or more unlicensed or inoperable vehicles is prohibited except in those districts where specified as an automobile wrecking yard or junk (or salvage) yard and allowed as a Permitted Use in Table 3-1 of the UDC, and such storage shall meet the requirements of UDC Section 4.10. In no case, shall any such unlicensed or inoperable vehiclesbe stored in an Environmentally Sensitive Area (ESA). 10.) Maximum lot coverage is not to exceed 25%. Lot coverage is defined as amount of impervious surface which includes roof tops, driveways, concrete, etc. 11.) The building height is not to exceed 35 feet. 12.) Exterior lighting for residential uses shall not exceed twenty feet(20') in height from the finished grade, excepting when such lighting is an integral part of a building or structure. Ground level lighting is encouraged. 13.) Lighting fixtures shall be designed and hooded to prevent the light source from being directly visible from outside the boundaries of the property. The intensity or brightness of all lighting, during construction and after project completion shall not adversely affect the use of surrounding properties or adjoining rights-of-way. 14.) Setback from Highway 101 right-of-way is no less than 50 ft., side setbacks are no less than 5 ft. The setback from the ordinary highwater mark of the Little Quilcene River is no less than 78 ft. If an environmentally sensitive area (ESA) is present, then the more restrictive setback shall apply. 15.) A minimum of two (2) on-site parking spaces is required for the single-family residence. 16.) Stormwater shall be retained and infiltrated on site. The owner shall control all sedimentation and erosion on the property. 17.) Flood proofing measures are to be used as required by the Jefferson County Flood Damage Prevention Ordinance. 18.) All new construction shall use construction methods which minimize flood damage. 19.) New construction shall have the lowest floor elevated to at least one foot above base flood elevation. 20.) Fully enclosed areas below the lowest floor that are subject to flooding are prohibited unless designed to automatically equalize hydrostatic flood forces on exterior walls by allowing for the entry and exit of floodwater. Designs for meeting this requirement must either be certified by a registered professional engineer or architect or must meet or exceed the following criteria: a. A minimum of two openings having a total net area of not less than one square inch for every square foot of enclosed area subject to flooding shall be provided. b. The bottom of all openings shall be no higher than one foot above grade. c. Openings may be equipt with screens, louvers, or other coverings or devices provided that they permit the automatic entry and exit of floodwater. 21.) All new construction shall: a. be anchored to prevent flotation, collapse, or lateral movement of the sturcture. b. be constructed with materials and utility equipment resistant to flood damage and potential damage to adjacent properties. c. be constructed using methods and practices that minimize flood damage. d. have structural components capable of resisting hydrostatic and hydrodynamic loads and the effects of buoyancy. e. electrical, heating, ventilation, plumbing, air-conditioning equipment, and other service facilities shall be designed and/or otherwise elevated or located so as to prevent water from entering or accumulating within the components during conditions of flooding. 22.) Flood proofing of structures sill be provided by one or more of the following methods: a. Landfill: (Note: Landfills are not permitted in the floodway.) The placement of fill may be utilized to elevate the structure and must comply with the standards and policies of the Jefferson County Shoreline Master Program, if applicable. b. Pole, pier or piling construction: The use of poles, piers, or piles for the foundation of the structure may be used to allow the unrestricted flow of flood waters during periods at a base flood. The lowest floor must be one foot above the base flood level. c. Parallel Foundation Walls: Foundation walls may be designed and constructed to provide open spaces through which water can flow unrestricted to equalize pressure. In velocity flood situations, it is important that all foundation walls be parallel to the flow of the floodwaters. d. Extended Foundation Walls and Basements: (Note: Extended foundation walls and basements are not permitted in the floodway.) The lowest habitable floor of a residence may be constructed on foundation walls that extend above grade to one foot above the height of the base flood provided that residential construction complies with the requirment of Section 5.101(2), "Residential Construction,"regarding the design of enclosed areas.
