HomeMy WebLinkAboutCONSENT Resolution re Road Fund Diversion and Letter to Assessor Consent Agenda Item Commissioners Office JEFFERSON COUNTY BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST TO: Board of County Commissioners FROM: Adiel McKnight, Deputy Clerk of the Board DATE: December 15,2025 SUBJECT: RESOLUTION re: In the Matter of Amending Resolution No. 48-0721-25R and Repealing Resolution No. 78-1117-25R Regarding Road Fund Diversion and amended LETTER to the Assessor STATEMENT OF ISSUE: Annually the Commissioners review levy amounts (Real and Personal Property) for the next tax year. Levies have been set in accordance with law. On July 21, 2025 the County Commissioners approved Resolution No. 48-0721-25R and on November 17, 2025 Resolution No. 78-1117-25R. The purpose of this resolution is to amend Resolution No. 48-0721-25R, repeal Resolution No. 78-1117-25R, and not divert any portion of the County Road property taxes to Current Expense. ANALYSIS: Resolution 48-0721-25R is hereby amended to delete the sentence in item #7 Road Fund, which reads: "In 2026, $520,000 of the Road Fund levy shall continue to be diverted to the General Fund to be used only for road traffic safety enforcement consistent with state law." Resolution 78-1117-25R is hereby repealed. There shall be no diversion from the county road fund. All funds collected from property taxes for the county road fund will remain with the county road fund. RECOMMENDATION: Approve a Resolution Amending Resolution No. 48-0721-25R and Repealing Resolution No. 78-1117-25R Regarding Road Fund Diversion, and approve an amended Letter to the Assessor dated December 15, 2025. Peters, County Administrator Date STATE OF WASHINGTON County of Jefferson In the Matter of Amending Resolution No.48- 0721-25R and Repealing Resolution No. 78- RESOLUTION NO. 1117-25R Regarding Road Fund Diversion WHEREAS, RCW 36.33.220 authorizes the Board of County Commissioners to divert a portion of the County Road property taxes to provide traffic law enforcement services in the unincorporated areas of the County; and WHEREAS,by Resolution No.48-0721-25R adopted on July 21,2025 the Board of County Commissioners approved a plan for a diversion from the Road fund to the General Fund; and WHEREAS,by Resolution No. 78-1117-25R adopted on November 17,2025 the Board of County Commissioners approved the Road Tax Levy collected in 2026 be divided with$470,000 deposited in the Current Expense Fund and identified as revenue code 311.20, and the remainder deposited in the County Road Fund; and WHEREAS,the Board of County Commissioners now desires to amend Resolution No.48- 0721-25R and repeal Resolution No. 78-1117-25R; and NOW, THEREFORE, THE BOARD OF COUNTY COMMISSIONERS OF JEFFERSON COUNTY, WASHINGTON,HEREBY RESOLVES AS FOLLOWS: Section 1: Whereas Clauses Adopted as Facts. The Jefferson County Board of Commissioners hereby adopts the above "Whereas"clauses as Findings of Fact. Section 2:Purpose. The purpose of this resolution is to amend Resolution No.48-0721-25R,repeal Resolution No. 78-1117-25R, and not divert any portion of the County Road property taxes to Current Expense. Section 3: Amendment of Resolution No. 48-0721-25R. Resolution No. 48-0721-25R is hereby amended to delete the sentence in item#7 Road Fund,which reads:"In 2026, $520,000 of the Road Fund levy shall continue to be diverted to the General Fund to be used only for road traffic safety enforcement consistent with state law." Section 4:Repeal of Resolution No. 78-1117-25R. Resolution No.78-1117-25R is hereby repealed. There shall be no diversion from the county road fund. All funds collected from property taxes for the county road fund will remain with the county road fund. Section 5: Effective Date. This resolution shall take effect immediately upon adoption. Section 6. SEPA Categorical Exemption. This Resolution is categorically exempt from the State Environmental Policy Act under WAC 197-11-800 (19).
