STATEMENT OF ISSUE:
To achieve required budget savings in 2026, the Sheriff's Office identified the need to lay off one Courthouse
Security position within the Jefferson County Sheriff's Office Uniformed Support Services(Association)bargaining
unit. During discussions, the Association proposed a job-share arrangement between two Courthouse
Security/Corrections Deputy as an alternative to lay off.The job-share arrangement would provide an opportunity for
two employees to work half time, with the remaining portion of their wages paid through the Washington State's
Employment Security Department's Shared-Work Program.
ANALYSIS:
Jefferson County Personnel Administration Manual Chapter 11, Section 1.4.3 authorizes job sharing arrangements
between two employees when mutually agreed upon by the Employer and the employees involved. Washington
State's Employment Security Department (ESD) administers a Shared-Work Program (SW Program). The SW
Program,during economic downturns,allows employers to reduce employee hours between 10%and 50%,maintain
employment status and permits employees to receive prorated unemployment benefits to offset lost wages.
This MOA 2025-2 formalizes
• A temporary job share arrangement between Courthouse Security Gordon Tamura and Darryl Elmore
• Participation in the ESD SW Program
• Avoiding a full layoff
• Maintaining operational continuity
The Parties agree that this arrangement must not cost the County more than the equivalent of one(1)FTE,inclusive
of wages,benefits, and all associated costs.
FISCAL IMPACT:
Achievement of required savings equivalent to one(1)FTE.
RECOMMENDATION:
Approve and sign the MOA 25-2 between Jefferson County and FOP/JCSOUSS for a Job-Share and Shared
Work Arrangement.

Background
A.The Employer and the Association are Parties to a Collective Bargaining Agreement(CBA) in
effect through December 31, 2027.
B.On December 11, 2025,the County notified the Association of the need to achieve budget
savings equivalent to the elimination of one(1)FTE within the JCSOUSS bargaining unit
pursuant to CBA Article 7.1.1 (Seniority and Layoffs).
C. During discussions between the Parties, the Association proposed a job-share arrangement
between Deputy Gordon Tamura and Deputy Darryl Elmore as an alternative to layoff.
D.Jefferson County Personnel Manual Chapter 11, Section 1.4.3 authorizes job-sharing
arrangements between two employees when mutually agreed upon by the Employer and the
employees involved.
E.Washington State's Employment Security Department(W ESD)administers the Shared-Work
Program,which allows employers to reduce employee hours between 10%and 50%, maintain
employment status, and permit employees to receive prorated unemployment benefits to offset
lost wages.
F.The Parties agree that a temporary job-share arrangement, combined with participation in the
ESD Shared-Work Program,will achieve the required savings equivalent to one(1)FTE while
avoiding a full layoff and maintaining operational continuity.
G.The Parties further agree that this arrangement must not cost the County more than the
equivalent of one(1)FTE, inclusive of wages, benefits, and all associated costs.
1. Status of Employees
1.1 Effective January 2, 2026, Deputy Gordon Tamura's work hours shall be reduced pursuant
to the W-ESD's Shared-Work Program except as modified by this MOA.
1.2 Deputy Darryl Elmore shall remain in active employment status.
1.3 Both employees shall participate in a shared work rotation as described in Section 2.
1.4 In the event this MOA and the W-DES approval are not achieved prior to Jan 2, 2026 Deputy
Elmore shall continue to be employed until such approval is achieved whereupon Deputy Elmore
shall be assigned"off work"rotation,without loss of medical benefits, for such time as needed to
make the actual on duty worktime of each Deputy equal under the Shared-Work program.

2.Work Schedule and Job-Share Structure
2.1 Deputies Tamura and Elmore shall work a week-on/week-off rotation, with each employee
working 50% of a full-time schedule.
2.2 The combined hours of both employees shall not exceed 1.0 FTE under any circumstances.
2.3 The Sheriff retains authority under CBA Article 8(Hours of Work)to assign shifts consistent
with operational needs and provided the 50/50 rotation is maintained effectuating the
Department's mission.
2.4 Pursuant to Article 8 nothing in this section restricts the Sheriff's authority to temporarily
adjust schedules for training, emergencies, or operational necessity.
3. Shared-Work Program Participation
3.1 The County shall submit a Shared-Work plan to the Washington Employment Security
Department naming Deputies Tamura and Elmore as participating employees.
3.2 This MOA is contingent upon approval of the Shared-Work plan by ESD/DES. If Shared-
Work is not approved, the Parties shall reconvene immediately to determine next steps.
However, one agreed upon employee shall be in"lay-off status"during the discussions, however
absent a prompt agreement Deputy Tamura shall be laid off.
3.3 Each employee shall comply with all Shared-Work requirements, including weekly claims
filing and reporting of all hours worked.
4.Wages and Benefits
4.1 Wages
4.1.1 Each employee shall receive wages only for hours actually worked and any other Paid
Time Off to which they are entitled as same is approved by the Sherif.
4.1.2 Combined wage compensation costs shall not exceed the cost of one (1)FTE in any one
month.
4.2 Medical Benefits
4.2.1 Deputy Tamura shall continue to Opt-Out of CBA provided Medical Benefits and shall
receive no County medical contribution.
4.2.2 Deputy Elmore shall continue to receive the full County medical contribution as
provided under CBA Article 22 (Health and Welfare).
4.3 Other Benefits (PTO,Sick Leave,Holidays,etc.)
4.3.1 All other benefits(PTO, sick leave, holiday accruals, etc.) shall be prorated based on each
employee's actual hours worked.

4.3.2 Combined accruals shall not exceed the accruals of one(1)FTE.
4.3.3 This section modifies CBA Articles 16-21 solely for the duration of this MOA.
4.4 Seniority
4.4.1 Tamura and Elmore shall continue to accrue seniority under Article 7 during this
arrangement as if each Deputy continued in full employment.
5.Duration and Return to Full-Time
5.1 This MOA shall remain in effect until the earliest of:
• A full-time vacancy or funding for a second security position becomes available and both
employees are able to return to full-time hours;
• The Shared-Work plan expires under ESD's maximum duration rules (12 months) and is
not renewed;
• The Parties mutually agree to modify, extend or terminate the arrangement.
5.2 The County is not obligated to renew the Shared-Work plan after 12 months however such
decision shall be subject to bargaining with the CBA as the controlling document not this MOA.
5.3 Upon availability of a full-time position, Deputies Tamura and Elmore shall be restored to
full-time hours consistent with CBA Article 7(Seniority and Ability).
6.Relationship to the CBA
6.1 This MOA is a limited, one-time modification to the CBA for the sole purpose of
implementing the job-share and Shared-Work arrangement described herein.
6.2 To the extent any provision of the CBA conflicts with this MOA, the terms of this MOA shall
control.
6.3 All other terms and conditions of the 2024-2027 CBA remain in full force and effect.
7.Effective Date
This MOA shall be effective upon approval by the Jefferson County Board of Commissioners.
