0
1.) The proposal is required to corny with the Jefferson County Shoreline Seconuary and
Substantial Development Permit(SDP 05-18) approved November 28, 2005 by the
Hearing Examiner subject to 17 conditions of approval (listed below).
1. Prior to issuance of the Jefferson County Building Permit, the applicant will be required
to submit the following:
i. A small parcel Drainage and Erosion Control Plan as required by the Jefferson County
UDC and described in UDC 3.6.10.f. Once the subject permit has been issued, the
applicant shall fully implement the provisions of the submitted Drainage and Erosion
Control Plan,
ii. This permit does not authorize the removal of any trees. A revegetation plan that
indicates native plant species to be used for the purpose of shore bank retention,
locations of plantings, and timelines for planting. At a minimum this should include
planting of native shrubs and small trees on the top of the bulkhead on three foot
on-centers for a length of 40 feet, as soil permits.
2. Proper disposal of construction debris must be on land in such a manner that debris
cannot enter the water body or cause water quality degradation of state waters.
3. All lumber and other materials treated with preservative shall be sufficiently cured to
minimize leaching into the water or shore bed, in accordance with the Best Management
Practices approved by the Washington Department of Fish and Wildlife.
4. In order to minimize visual impact, the pier, ramp, and float shall be constructed to
harmonize with the local shoreline environment to the maximum extent practicable. This
includes utilizing appropriate color(s), texture, non-reflective materials, and other design
characteristics.
5. Construction shall be in substantial compliance with the site plans submitted to
Jefferson County during the permit process as they exist now or are hereafter amended
by Jefferson County and/or the Washington State Department of Ecology.
6. No fill or other material may be placed in the waters or inter tidal areas of Jefferson
County.
7. Work within the jurisdiction of the Shoreline Program other than as described above
shall receive separate review from this office.
8. Substantial progress towards completion of the project shall be performed within two
years of the issuance of the permit.
9. Prior to construction, the proponent shall contact the Jefferson County Department of
Community Development at(360) 379-4462 with estimated project timelines for
monitoring and plan compliance.
10. Prior to the onset of construction, the applicant shall provide the Department of
Community Development with the name and address of the contractor carrying out the
project.
11. The applicant shall comply with the requirements of the Hydraulic Project Approval
#102549-1 issued on August 10, 2005 from the Washington Department of Fish and
Wildlife. Contact Dave Molenaar, WDFW at(360) 249-1224 with any question.
12. The proponent shall notify the US Army Corps of Engineers (COE) prior to
commencing construction of the pier, ramp, and float to ensure that the requirements of
the Section 10 Permit of the 1899 Rivers and Harbors Act are met. Contact the US Army
Corps of Engineers, Seattle District Regulatory Branch, PO Box 3755, Seattle WA 98124,
(206) 764-3495, for more information.
13. A building permit is required from the Jefferson County Department of Community
Development prior to the constr tion of the pier, ramp, and float. This shall ii ude
engineered stamped plans to ensure that the design of the overwater structure is safe in
this marine environment. This shall also include documenting that the structure has low
flood damage potential, proper anchoring, and elevated or flood proofed utilities (if
proposed).
14. Utility service for the pier and dock shall be on or under the decking. Lighting shall be
shielded to prevent unnecessary glare off-site and to not impact navigation. No overhead
lighting is permitted.
15. Structures, equipment, and materials shall be maintained. Structures, equipment, and
materials shall be removed as soon as practicable upon the cessation of a project's
operation or the structure becomes so dilapidated that it requires total replacement. If the
structure not maintained or utilized for over one (1) year shall be removed regardless of
future anticipated use unless prior permission has been granted by the Jefferson County
Department of Community Development based on the showing of good cause.
16. Boats that are occupied shall not be permitted to moor at private docks, piers, and
floats longer than three (3) days unless pump-out facilities are available in the immediate
vicinity.
17. A joint use pier, ramp, and float is preferred over two individual pier, ramp and floats
located adjacent to each other. If the landowner to the north decide to pursue a pier,
ramp, and float and both parties are in agreement, this proposal may converted to a joint
use pier, ramp, and float subject to permitting requirements. This would be processed as
an amendment to this permit, which would not require the same process as permitting a
new pier, ramp, and float.
2.) In addition to Jefferson County permit conditions, the project proponent shall comply with
all conditions set forth by the Washington Department of Fish and Wildlife through
Hydraulic Project Approval.
3.) Prior to commencing development activity, the proponent is responsible for informing the
US Army Corps of Engineers (COE) in order for COE to determine whether a Department
of the Army permit or review is required. Generally, review is required for construction
and dredging in or around navigable waters of the US and for work or fill in hydrologically
connected wetlands. Contact the US Army Corps of Engineers, Seattle District
Regulatory Branch, PO Box 3755, Seattle WA 98124, (206) 764-3495, for more
information.
4.) Outdoor residential storage shall be maintained in an orderly manner and shall create no
fire, safety, health or sanitary hazard.
5.) The front setback is 20 feet from the edge of the right-of-way of South Point Road (west).
The side setback is 20 feet from the edge of the platted street right-of-way(north). The
side setback is 5 feet from the property line (south). There is a zero setback from the
OHWM (east). The shoreline setback was determined through SDP 05-18,which was a
Shoreline Secondary Use Permit for the Pier, Ramp, & Float.
6.) The project shall adhere to the Best Management Practices (BMPs) to control stormwater,
erosion and sediment during construction. BMPs shall address permanent measures to
stabilize soil exposed during construction, and in the design and operation of stormwater
and drainage control systems.
