CONDITIONS for Building Permit# :BLD07-00052 1.) The application was reviewed by the Jefferson County Department of Community Development staff on March 6, 2007 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: fish and wildlife habitat areas, wetlands along the west and north property lines, seismic hazards, and a Type 5 stream buffer along the west property boundary. 2.) A Category II wetland has been identified on the subject property. The Silent Lake Large Lot Subdivision is recorded under Volume 1, page 52 of the Large Lot Subdivision with the Jefferson County Auditor. Per the Silent Lake Large Lot Subdivision, a 35 feet of shoreline vegetation is required as depicted on the plat. A minimum building setback of 100 feet from the shoreline or the upland boundary of its contiguous wetland shall be maintained. 3.) The site plan submitted for the master permit application, which was received by Jefferson County Department of Community Development on May 4, 2007, has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to this site plan shall be resubmitted for review and approval by Jefferson County Department of Community Development. 4.) Reviewed under the State Environmental Policy Act(SEPA) by Jefferson County acting as lead agency. Determination of Non-Significance (DNS) issued on May 10, 2007. 5.) This approval is for construction of a 6-foot-wide by 5-foot-long landing and a 30-foot-long by 4-foot-wide walkway only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 6.) The plan sheet for the landing indicates that treated wood will be used for construction of the structure. Uncured treated wood placed in aquatic habitats has the potential to adversely affect some aquatic species. 7.) Construction-related issues pertaining to over-water development activities (including materials, methods, timing, etc.) will be addressed by the Washington State Department of Fish and Wildlife Hydraulic Project Approval (HPA). 8.) Prior to commencing development activity, proponent is responsible for informing the Washington Department of Fish and Wildlife (WDFW) in order for WDFW to determine whether this action is subject to the Washington State Hydraulic Code (Chapter 220-10 WAC). Hydraulic Project Approval (HPA) is required for all hydraulic projects, which are defined as construction or performance of other work that will use, divert, obstruct, or change the natural flow or bed of any of the salt or fresh waters of the state. 9.) In addition to Jefferson County permit conditions, the project proponent shall comply with all conditions set forth by the Washington Department of Fish and Wildlife through Hydraulic Project Approval. 10.) Construction shall be in substantial compliance with the site plan received by Jefferson County Department of Community Development on May 4, 2007 as it exists now or is hereafter amended by Jefferson County. 11.) No fill or other material may be placed in the waters or intertidal areas of Jefferson County. 12.) All lumber and other materials treated with preservative shall be sufficiently cured to minimize leaching into the water or shore bed, in accordance with the Best Management Practices approved by the Washington Department of Fish and Wildlife. 13.) On Lots 1-12, in the area extending 35 feet back from the Silent Lake shoreline and the upland boundary of its contiguous wetlands, native vegetation (including submerged logs) shall be maintained, except that a trail to the lake shore no more than 6 feet wide and a landing area no more than 10 feet wide formed or constructed from natural materials and extending no more than 5 feet into the lake shall be allowed; understory vegetation may be trimmed down to a height of 6 feet; a minimum of 75% of the trees representative of the size and species composition of the stand and all snags and all trees larger than 21 inches diameter at breast height shall be maintained, except that all retained trees may be limbed up to provide views. 14.) On Lots 1-6, the minimum building setback shall be 100 feet from the shoreline or the upland boundary of its contiguous wetland. 15.) An area 30 feet wide (15 feet win both sides of the lot line) between Lotsd 7, 30 feet wide around the perimeter of Wetlands 1 and 2, and 50 feet wide around perimeter of Wetland 3 as depicted on the plat shall be maintained as open space with no removal of natural vegetation or existing trees. 16.) On each lot, outside of the area cleared for a homesite, a minimum of 50% of the trees representative of the size and species composition of the stand, including all snags and all trees 21 inches in diameter at breast height shall be retained, except that all retained trees may be limbed up to provide views.
