SPECIAL CONDITIONS FOR CASE#BLD07-00188:
1.) The application was reviewed by the Jefferson County Department of Community
Development staff on June 5, 2007 for the potential presence of Environmentally
Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC).
After an initial Geographic Information Systems mapping review and an investigative site
inspection, the following ESAs were confirmed to be present on the subject property:
Conservancy Shoreline Designation, Category II Wetland, Eagle Habitat Area, Level I
Landslide Hazard Area, Susceptible Aquifer Recharge Area and Coastal Seawater
Intrusion Protection Zone (SIPZ).
2.) A Geotechnical Engineering Study dated October 13, 2005 prepared by Geotech
Consultants was submitted with the proposal to address the geohazard area.
3.) A Wetland Determination Report dated March 8, 2005 prepared by Ecological Land
Services, Inc was submitted in conjunction with the application to address the Category II
Wetland.
4.) Aquifer Recharge Areas in Jefferson County are characterized by
formations that allow percolation of the surface water into the soils and the underlying
zone of saturation. Aquifers are geologic formations that contain sufficient saturated
permeable material to yield significant quantities of water to wells and springs. Aquifers
serve as the source of drinking water within most of the rural portions of Jefferson
County.
5.) Susceptible Aquifer Recharge Areas are those with geologic and hydrologic conditions
that promote rapid infiltration of recharge waters to groundwater aquifers.
6.) Geologically Hazardous Areas in Jefferson County are characterized by slope, soil type,
geologic material, and groundwater that may combine to create problems with slope
stability, erosion, and water quality during and after construction or during natural events
such as earthquakes or severe rainstorms.
7.) Buffers are areas that shall be maintained in their natural condition, however, minor
pruning or alteration of vegetation may be permitted as long as the function and character
of the buffer are not diminished.
8.) Among the native conifer species which may be used in buffers or for re-vegetation
include, but are not limited to: Grand Fir(Aibes grandis), Sitka Spruce (Picea Sitchensis),
Shore Pine (Pinus Contorta), Douglas Fir(Pseudotsuga Menziesii), Western Red Cedar
(Thuja Plicata), and Western Hemlock (Tsuga Heterophylla).
Among native tree species which may be used includes: Vine Maple (Acer Circinatum),
Big-Leaf Maple (Acer Macrophyllum), Red Alder(Alnus Rubra), Pacific Madrone (Arbutus
Menziesii), Quaking Aspen (Populus Tremula), Black Cottonwood (Populus Trichocarpa),
Bitter Cherry(Prunus Emarginata), Oregon White Oak (Quercus Garryana), Cascara
(Rhamnus Purshiana), Pacific Willow(Saliz Lasiandra), and Scouler's Willow(Saliz
Scouleriana).
Among the native shrub species which may be used are: Sevice-Berry(Amalanchier
Alnifolia), Red Osier Dogwood (Cornus Stolonifera) Salal (Gaultheria Shallon), Ocean
Spray(Holodiscus Discolor), Indian Plum (Oemlaria Cerasiformis), Pacific Ninebark
(Physocarpus Capitus), Red Flowering Currant(Ribes Sanguineum), Wild Rose (Rosa
Nutkana), Swamp Rose (Rosa Pisocarpa), Willows (Salix ssp.), Red Elderberry
(Sambucus Racemosa), Snowberry(Symphoricarpos Albus), Evergreen Huckleberry
(Vaccinium Ovatum), Red Huckleberry(Vaccinium Parvifolium).

9.) Marine shorelines and islands are susceptible to a condition that is known as seawater
intrusion. Seawater intrusion is a condition in which the saltwater/freshwater interface in
an aquifer moves inland so that wells drilled on upland areas cannot obtain freshwater
suitable for public consumption without significant additional treatment and cost.
Maintaining a stable balance in the saltwater/freshwater interface is primarily a function of
the rate of aquifer recharge (primarily through rainfall)and the rate of groundwater
withdrawals (primarily through wells). The Washington Department of Ecology is the
agency with statutory authority to regulate groundwater withdrawal for individual wells in
Jefferson County. New development, redevelopment, and land use activities on islands
and in close proximity to marine shorelines in particular should be developed in such a
manner to maximize aquifer recharge and maintain the saltwater/freshwater balance to
the maximum extent possible by infiltrating stormwater runoff so that it recharges the
aquifer.
10.) The parcel is located within a coastal SIPZ (seawater intrusion protection zone) according
to the County GIS map. There are voluntary and mandatory measures identified in the
Jefferson County Seawater Intrusion Policy (Resolution 44-22, effective September 23,
2002)that apply to well drilling proposals and building permit applications on existing lots
of record.
A Coastal SIPZ is defined as: all islands and area within one-quarter mile of marine
shoreline, but no history of chloride concentration above 100 mg/L in groundwater
sources within 1000 feet.
11.) A vegetative buffer of 30-feet shall be permanently maintained from the top or edge of the
Landslide Hazard Area. All buffers shall be measured perpendicularly from the top of the
Landslide Hazard Area.
12.) A Geotechnical Report was submitted in conjunction with this application. The report
addressed the stability of the geologic hazard area. A setback of 30-feet shall be
measured perpendicularly from the top or toe of the geologic hazard to the proposed
single family residence with attached garage.
13.) Landslide Hazard Areas and their associated buffers shall remain naturally vegetated.
Should buffer disturbance occur during construction, the Unified Development Code
(UDC)Administrator shall require replanting with native vegetation. No alterations shall
be made to the Landslide Hazard Area or its associated buffer without prior authorization
by the UDC Administrator.
14.) Prior to and during approved construction activities, the perimeter of the landslide hazard
area buffer shall be marked with a temporary sign. The sign shall be placed in such a
manner that it can be directly observed from the construction area. The sign shall contain
the following statement: "Landslide Hazard Area and Buffer- Do not Remove or Alter
Existing Vegetation."
15.) All construction activities shall not encroach upon the buffer. This includes the storage or
preparation of materials.
16.) The applicant shall permanently separate the boundary of the Landslide Hazard Area
Buffer from the remainder of the subject property through installing logs, trees, a hedge
row, or any other prominent physical marking approved by the UDC Administrator.
17.) A setback of 100-feet, measured perpendicularly from the wetland edge, shall be
permanently maintained as a buffer. No filling, grading, clearing, or other alteration of the
wetland or its buffer is allowed.
18.) Buffer perimeters shall be marked with temporary signs at an interval of one per parcel or
every one hundred (100)feet, whichever is less. Signs shall contain the following
statement: "Wetland & Buffer- Do Not Remove or Alter Existing Vegetation."
19.) A permanent physical separation along the upland boundary of the wetland buffer area
shall be installed and permanently maintained. Such separation can include installing
logs, trees, a hedgerow, or any other prominent physical marking approved by the UDC
Administrator.
20.) Critical Aquifer Recharge Areas may require special protection measures to mitigate
water quality degradation. The submitted proposal does not require additional aquifer
protection measures. However, during construction the project shall follow the Best
Management Practices (BMPs) and facility design standards as identified and defined in
the Stormwater Management Manual for the Puget Sound Basin.

21.) To help prevent seawater from intruding landward into underground aquifers, all new
development activity on Marrowstone Island, Indian Island and within 1/4 mile of any
marine shoreline shall be required to infiltrate all stormwater runoff onsite.
22.) The applicant shall fully adhere to all conditions and requirements of the eagle habitat
management plan.
23.) VOLUNTARY MEASURES OF COASTAL &AT RISK SIPZ:
Water conservation measures:
1. Roof and other intercepted precipitation shall be routed to on-site detention ponds
and/or other approved means and allowed to be released to the soil slowly.
2. Water collected from Storm water and roof catchments may be used for watering
lawns and gardens. Unless catchment water has been treated to meet drinking water
standards, there shall be no cross connections allowed between the potable supply and
impounded water.
3. Water withdrawn from wells on each property shall not be used for watering of lawns
and/or gardens.
4. Ground water withdrawn from each property shall be restricted to a rate of three (3)
gallons per minute.
5. Installation of water conserving fixtures such as low flow toilets, faucets and shower
restrictors and other water saving plumbing fixtures.
6. Landscaping plan (xeriscaping, native vegetation with minimal amounts of irrigation).
Please NOTE that the above listed measures are not intended to be exhaustive, but
rather is intended to be illustrative of the types of water conservation measures.
24.) VOLUNTARY MEASURES OF COASTAL &AT RISK SIPZ:
1. Installation of a flow meter.
2. On-going well monitoring for chloride concentration.
3. Submittal of monitoring data to County.
25.) MANDATORY MEASURES FOR COASTAL SIPZ:
1. For proof of potable water on a building permit application, applicant must utilize
DOH-approved public water system if available.
2. If public water is unavailable, a qualifying alternative system may be used as proof of
potable water or an individual well may be used as proof of potable water subject to the
following requirement:
a. Chloride concentration of a laboratory-certified well water sample submitted with
building permit application.
3. If public water is unavailable, a qualifying alternative system may be used as proof of
potable water.
26.) The project shall comply with Construction Stormwater Pollution Prevention (SWPP)
Elements#1 through #12 of the Department of Ecology's Stormwater Management
Manual for Western Washington to control stormwater, erosion and sediment during
construction. BMPs shall address permanent measures to stabilize soil exposed during
construction, and in the design and operation of stormwater and drainage control
systems.
27.) The applicant is proposing to create or add 1482 square feet of impervious surface and
31702 square feet of land disturbing activities. JCC 18.30.060 and 18.30.070 require
your proposal comply with Minimum Requirement#2 (Construction Stormwater Pollution
Prevention)of the Department of Ecology Stormwater Management Manual for Western
Washington to control stormwater, erosion and sediment during construction. BMPs shall
address permanent measures to stabilize soil exposed during construction, and in the
design and operation of stormwater and drainage control systems.
28.) A Stormwater Site Plan has been submitted and approved by the Department of
Community Development. Once the subject permit has been issued the applicant shall
fully implement the provisions of the submitted plan and contact the Jefferson County
Department of Community Development to arrange a schedule to inspect the property for
plan compliance. A Certificate of Occupancy will not be issued until the Department
verifies plan compliance. No clearing for roadways or utilities shall occur on the project
site until clearing necessary for the installation of temporary sedimentation and erosion
control measures have been completed.
29.) Jefferson County determined that this proposal is categorically exempt from review under
the State Environmental Policy Act (SEPA) pursuant to WAC 197-11-800(1)(b)(i).

30.) The site plan as submitted with the building permit application on May 2, 2007 has been
reviewed for consistency under the UDC, and has been approved by Jefferson County
Department of Community Development. Any modifications, changes, and/or additions to
the stamped, approved site plan dated June 5, 2007 shall be resubmitted for review and
approval by Jefferson County Department of Community Development.
31.) This approval is for a demolition permit only. Any future permits on this site are subject to
review for consistency with applicable codes and ordinances and does not preclude
review and conditions which may be placed on future permits.
32.) Outdoor residential storage shall be maintained in an orderly manner and shall create no
fire, safety, health or sanitary hazard.
33.) Not more than 2 unlicensed vehicles shall be stored on any lot unless totally screened
from view of neighboring dwellings and rights-of-way. Such screening shall meet all
applicable performance and development standards specific to the district in which the
storage is kept, and shall be in keeping with the character of the area. Screening shall
meet the requirements of Chapter 18.30 JCC. Outdoor storage of 3 or more junk motor
vehicles is prohibited except in those districts where specified as an autormobile wrecking
yard or junk (or salvage) yard and allowed as a permitted use in Table 3-1 or Chapter
18.18 JCC, and such storage shall meet the requriements of JCC 18.20.100, Automobile
wrecking yards and junk (or salvage)yards. In no case, shall any such junk motor
vehicles be stored in a critical area.
34.) All debris from the demolition shall be disposed of at an approved landfill location.
35.) All land disturbing activity shall take place within the immediate area of the single family
residence and the accessory structures to be demolished. The proposal shall take care
to preserve shoreline vegetation.
All land disturbing activity, clearing and grading outside the immediate area of the single
family residence and the accessory structures to be demolished requires review by
Jefferson County Department of Community Development for stormwater review and
environmentally sensitive areas.
36.) A septic permit (SEP06-00071)was approved on May 15, 2007 for a system of 480
gallons per day.
37.) This parcel was created through the Thiusands Trails Inc Short Plat under AFN 273608,
filed of record July 27, 1981 in Volume 1 of Short Plats, at page 176-177 with Jefferson
County Auditor's office.
38.) The Development Review Division finds that this proposal is consistent with Shoreline
Management Master Program Section 3.402(6) (JCC 18.25.090(6)), which is normal
repair and maintenance, and is consequently exempt from the substantial development
permit (SDP) requirements. Exemptions from the substantial development permit
requirements do not exempt a proposed development from compliance with the
applicable policies and standards of the Shoreline Master Program or other applicable
Federal, State, or local permit or license requirements.
39.) A building permit(BLD06-00285)was issued on May 25, 2006 to demolish the existing
boathouse. A building permit(BLD06-00286)was issued on July 13, 2006 to reconstruct
the boathouse, an associated shoreline exemption permit (SDP06-00013)was issued on
July 11, 2006.
A building perrmit (BLD07-00253)for a single family residence and attached garage is
currently being reviewed by Jefferson County.
40.) Work within the jurisdiction of the Shoreline Master Program other than as described
above shall receive separate review from this Department.
41.) No fill or other material may be placed in the waters or intertidal areas of Jefferson
County.
42.) Evidence suggests that the bluff area related to the parcel in question is subject to
erosion and mass wasting. Vigilant maintenance of the stormwater runoff tightline to the
beach is important to avoid a negative contribution to bluff instability.
43.) Stormwater runoff tightline piping can be subject to weakening through ultraviolet
radiation exposure and mechanical damage due to trees, rocks and debris. A more
durable material for the tightline will provide greater defense against the elements.

44.) The tightline was proposed due to the recommendation contained in the geotechnical
report prepared by Geotech Consulatnts, Inc on October 13, 2005. The geotechnocal
engineer recommended that stormwater generated from the project shall be collected and
conveyed to the base of the slope.
45.) The applicant/owner and all future owners are responsible for maintaining and protecting
the stormwater runoff tightline to the beach against damage due to normal wear, weather
exposure, and/or trees, rocks and debris. If and when damage occurs to the tightline that
renders it ineffective, the responsible party must execute the necessary repairs as soon
as possible and no longer than 30 days.
46.) The stormwater runoff tightline piping must be composed of durable material that is
resistant to weakening and damage due to time, weather exposure (including ultraviolet
radiation), and impacts from trees, rocks and debris. The corrugated plastic material
used for tightline construction in the past is no longer acceptable. More durable plastic or
ultraviolet radiation-resistant flexible rubber material shall be required.
47.) The stormwater runoff tightline shall be designed and placed in order to minimize visual
impacts to users of the beach and nearby waters.
48.) All lumber and other materials treated with preservative shall be sufficiently cured to
minimize leaching into the water or shore bed, in accordance with the Best Management
Practices approved by the Washington Department of Fish and Wildlife.
49.) The discharge point of the tightline shall be above the Ordinary High Water Mark
(OHWM).

The runoff from cleared areas that are comprised of bare soil, non-
native landscaping, lawn, and/or pasture is considered to be "fully
dispersed" if it is dispersed through at least 25 feet of native vegetation
in accordance with the following criteria:
1. The contributing flowpath of cleared area being dispersed must be
no more than 150 feet,AND
2. Slopes within the 25-foot minimum flowpath through native
vegetation should be no steeper than 8%. If this criterion can not
be met due to site constraints,the 25-foot flowpath length must be
increased 1.5 feet for each percent increase in slope above 8%.

year runoff event. Where flows at a particular ditch discharge
point were already concentrated under existing site conditions
(e.g., in a natural channel that crosses the roadway alignment), the
0.5-cfs limit would be in addition to the existing concentrated peak
flows.
4. Ditch discharge points with up to 0.2 cfs discharge for the peak
100-year flow shall use rock pads or dispersion trenches to
disperse flows. Ditch discharge points with between 0.2 and 0.5
cfs discharge for the 100-year peak flow shall use only dispersion
trenches to disperse flows.
5. Dispersion trenches shall be designed to accept surface flows (free
discharge)from a pipe, culvert, or ditch end, shall be aligned
perpendicular to the flowpath, and shall be minimum 2 feet by 2
feet in section, 50 feet in length, filled with 3/4-inch to 1%2-inch
washed rock, and provided with a level notched grade board (see
Figure 5.2). Manifolds may be used to split flows up to 2 cfs
discharge for the 100-year peak flow between up to 4 trenches.
Dispersion trenches shall have a minimum spacing of 50 feet.
6. After being dispersed with rock pads or trenches, flows from ditch
discharge points must traverse a minimum of 100 feet of
undisturbed native vegetation before leaving the project site, or
entering an existing onsite channel carrying existing concentrated
flows across the road alignment.
Note: In order to provide the 100 foot flowpath length to an
existing channel, some roadway runoff may unavoidably enter the
channel undispersed. Also note that water quality treatment may
be waived for roadway runoff dispersed through 100 feet of
undisturbed native vegetation.
7. Flowpaths from adjacent discharge points must not intersect within
the 100-foot flowpath lengths, and dispersed flow from a discharge
point must not be intercepted by another discharge point. To

the flowpath shall not exceed 15%slope, and shall be located

Roof surfaces that comply with the downspout infiltration
requirements in Volume III, Chapter 3, are considered to be "fully
dispersed" (i.e., zero percent effective imperviousness). All other roof
surfaces are considered to be "fully dispersed" (i.e., at or approaching
zero percent effective imperviousness)only if they are within a
threshold discharge area that is or will be more than 65%forested(or
native vegetative cover) and less than 10% impervious (total), AND if
they comply with the downspout dispersion requirements of BMP
T5.10, and have vegetated flow paths through native vegetation
exceeding 100 feet.
• Driveway Dispersion
Driveway surfaces are considered to be "fully dispersed" if they are
within a threshold discharge area that is or will be more than 65%
forested(or native vegetative cover) and less than 10% impervious
(total), AND if they comply with the driveway dispersion.BMP, —
BMP 5.11 and BMP T5.12 -and have flow paths through native
vegetation exceeding 100 feet. This also holds true for any driveway
surfaces that comply with the roadway dispersion BMPs described
below.
• Roadway Dispersion BMPs
Roadway surfaces are considered to be "fully dispersed" if they are
within a threshold discharge area that is or will be more than 65%
forested(or native vegetative cover) and less than 10% impervious
(total),AND if they comply with the following dispersion
requirements:
1. Roadway runoff dispersion is allowed only on rural neighborhood
collectors and local access streets. To the extent feasible,
driveways should be dispersed to the same standards as roadways
to ensure adequate water quality protection of downstream
resources.
2. The road section shall be designed to minimize collection and
concentration of roadway runoff. Sheet flow over roadway fill
slopes (i.e., where roadway subgrade is above adjacent right-of-
way) should be used wherever possible to avoid concentration.
3. When it is necessary to collect and concentrate runoff from the
roadway and adjacent upstream areas(e.g., in a ditch on a cut
slope), concentrated flows shall be incrementally discharged from
the ditch via cross culverts or at the ends of cut sections. These
incremental discharges of newly concentrated flows shall not

BMP T5.30 Full Dispersion
Purpose and Definition
This BMP allows for"fully dispersing" runoff from impervious surfaces
and cleared areas of development sites that protect at least 65%of the site
(or a threshold discharge ara on the site) in a forest or native condition.
Applications and Limitations
• Rural single family residential developments should use these
dispersion BMPs wherever possible to minimize effective impervious
surface to less than 10%of the development site.
• Other types of development that retain 65%of the site (or a threshold
discharge area on the site) in a forested or native condition may also
use these BMPs to avoid triggering the flow control facility
requirement.
• The preserved area should be situated to minimize the clearing of
existing forest cover,to maximize the preservation of wetlands
(though the wetland area and any streams and lakes do not count
toward the 65%forest or native condition area), and to buffer stream
corridors.
• The preserved area should be placed in a separate tract or protected
through recorded easements for individual lots.
• The presery area should be shown on all property maps and should
be clearly marked during clearing and construction on the site.
• All trees within the preserved area at the time of permit application
shall be retained, aside from approved timber harvest activities and the
removal of dangerous or diseased trees.
• The preserved area may be used for a�ssive recreation and related
facilities, including pedestrian and bicycle trails, nature viewing areas,
fishing and camping areas, and other similar activities that do not
require permanent structures,provided thatclkared_areasandareas_Qf
compacted soil associated with these areas and facilities do not exceed
eight percent of the preserved area.

11. Best management practices will be maintained on a regular basis especially prior to
forecasted storm events and after storm events. Also BMPs will be inspected before
weekends and holidays.
12. The minimum amount of disturbed area will be created at one time. Areas that are at
final grade and outside of the proposed house construction will be stabilized with
final cover.
2.b. The west portion of the site drains into a swale and then a culvert crossing of a
driveway. The culvert discharges into a category II wetland. The southwest portion of the
site drains in a dispersed manner into Hood Canal.
3.b. Minimum Requirement 8—Wetland Protection. This requirement is met using BMP
T5.30 Full Dispersion in agreement with Jefferson County.
4. Because of the large slopes and the site soils, consisting of silt to silty sands, the potential
for erosion is high. Attention to minimizing disturbed area and also quick stabilization of
disturbed areas will be a priority to minimize erosion onsite.

Stormwater Site Plan Changes.
If the designer wishes to make changes or revisions to the originally approved Stormwater Site Plan, the proposed revisions shall be
submitted to DCD prior to construction. The submittal shall include substitute pages that include all proposed changes, revised
drawings showing any structural changes, and any other supporting information that explains and supports the reason for the change.
Final Corrected Plan Submittal
If the project included construction of conveyance systems, treatment facilities, flow control facilities, or structural source control BMPs
(not standard on-site stormwater management BMPs), the applicait shall submit a final corrected plan ("as-builts")when the project is
completed. These should be engineering drawings (stamped by a licensed civil engineer) that accurately represent the project as
constructed.

5. Water enters the site in a dispersed manner and drains into a ditch along the existing
driveway and is conveyed to the Category II wetland to the west. Water generated onsite
flows in a dispersed manner to the west and the southwest. The west portion drains into a
ditch along the existing driveway and eventually into the Category II wetland. The
southwest portion drains directly into Hood Canal.
9. The proposed drainage system during grading will collect water uphill of disturbed slopes
and convey it to the existing drainage system or will be dispersed in accordance with BMP
T5.30 Full Dispersion. All other areas will be handled with full dispersion.
10. We will be incorporating BMP"1-5.30 Full Dispersion on the site to provide treatment.
11. At this stage of the project BMP T5.30 Full Dispersion will be implemented to restore
runoff conditions to predeveloped levels. During the building permit process a system will
be developed to meet runoff requirements detailed in the Washington State Department of
Ecology Stormwater Management Manual for Western Washington.
12. Full dispersion will be implemented to provide flow control on the site at this stage.
18. Permanent seeding BMP C120 and landscaping will be used to provide final stabilization
of disturbed areas that are not paved.

1. Clearing limits will be delineated with a high visibility plastic fence (BMP C103)
2. Construction road/parking area stabilization (BMP C107) will be provided.
3. Full dispersion (BMP T5.30) will be implemented onsite.
4. Silt Fence (BMP C233) will be installed on the downhill side of the proposed
disturbed site.
5. Disturbed areas will be stabilized in a number of different ways depending on final
use. Stockpiles will be covered with plastic covering (BMP C123). Slopes will be
seeded or landscaped in accordance with (BMP C120). Temporarily unworked areas
will be mulched in accordance with BMP C121.
6. Slopes will be protected with interceptor swales (BMP C200). Check dams (BMP
C207) will be installed in onsite swales. Level spreaders (BMP C206) will also be
provided where concentrated water needs to be dispersed.
