SUBJECT: Partnership with WA State Parks and Friends of Fort Worden for continued noxious
weed control
STATEMENT OF ISSUE:
The Jefferson County Noxious Weed Control Board (JCNWCB) has partnered with Washington State Parks
and The Friends of Fort Worden to provide services for weed control in the park for the last 5 years. In the
432-acre State Park, there are no known Class A Weeds, however there are a handful of Class B Weeds,
such as poison hemlock (Conium maculatum), Old Man's Beard (Clematis vitalba),tansy ragwort (Jacobaea
vulgaris), and spurge laurel (Daphne !aureola). There are also undesignated Class B's and Class C's such as
Scotch broom (Cytisus scoparis), Himalayan Blackberry (Rubus armeniacus), Canada and Bull thistle (Cirsium
arvense, vulgare), among others. With vehicles and people being major vectors for the spread of noxious
weeds, it is important that Fort Worden control noxious weed infestations that may be brought into the
park so that they are also not taken out of the park by visitor's shoes, cars, or dogs.
ANALYSIS:
After 5 years, this partnership has seen some great strides, however, consistency and diligence is required
to control noxious weeds in such a popular destination. This contract is for the next 1.5 years of work at
Fort Worden to ensure that the work already done is not in vain. The timeline is based on the WA State
Parks budget timeline.
FISCAL IMPACT:
This contract has always been financially shared by the Friends, the Park, and the Weed Board. The
financial share of the County comes from Fund #109 and is already budgeted in 2026. Additionally,this
contract will bring matching funds from the Friends and the Park.
RECOMMENDATION:
I recommend the approval of this contract by the Board of County Commissioners.

AND
JEFFERSON COUNTY on behalf of
JEFFERSON COUNTY NOXIOUS WEED CONTROL BOARD
This Agreement is made and entered into by and between the Jefferson County Noxious Weed
Control Board, 121 Oak Bay Road, Port Hadlock, Washington, 98339, hereinafter referred to as
"Weed Control Board"; the Washington State Parks and Recreation Commission herein referred to
as "State Parks" acting through Fort Worden State Park, 200 Battery Way, Port Townsend, WA,98368
hereinafter referred to as "the State Park"; and the Friends of Fort Warden State Park, 200 Battery
Way, Port Townsend, WA, 98368 hereinafter referred to as "Friends". For the purposes of this
Agreement, it is understood that all references to State Parks, or the Weed Control Board also include
their appointed designee(s).
WHEREAS, State Parks operates and maintains Fort Worden State Park in order to provide safe
recreation for people.
WHEREAS, the Jefferson County Noxious Weed Control Board has a stated mission "To protect
lands within Jefferson County from the degrading impacts of noxious weeds by educating residents,
property owners, land managers, and public agencies in how to serve as responsible stewards and
aid in the protection and preservation of the land, water, and natural resources;" and
WHEREAS, the Weed Control Board has identified certain noxious weeds requiring control within
Fort Worden State Park,
WHEREAS, control of noxious weeds on State Parks' lands benefits the State Park through
compliance with the legal responsibilities regarding noxious weed control as described in Chapter
17.10 RCW, as well as reducing the chance of lethal poisoning of people or animals and the buildup
of toxic material; and
NOW, THEREFORE, pursuant to the above recitals, State Parks, the Friends, and the Weed Control
Board (collectively hereinafter "Parties" to this Agreement) acknowledge and agree to work
cooperatively in accordance with the following:
PURPOSE OF AGREEMENT
The purpose of this Agreement is to define the obligations of all Parties related to the control of
noxious weeds within Fort Worden for the term of the Agreement. The Parties agree that no more
than Ten Thousand Dollars ($10,000.00), with up to $5,000.00 contributed by the Friends and up
to $5,000.00 contributed by the Weed Control Board. This amount represents the full financial
commitment of the Friends and the Weed Control Board. State Parks will not make any payments
under this agreement, as State Parks' funds are already obligated under IA 325-060.
SCOPE OF WORK
The Parties shall undertake the work as set out below:
The Friends will, within the limitations of this agreement, perform the following:
A. The Friends will pay all invoices submitted by the Weed Control Board in performing its
obligations under this agreement, up to the amount specified in the Agreement, which is
$5,000.00, over the term of agreement. The Friends shall pay any properly submitted invoice
within thirty days (30) after receipt.

B. The Friends will permit Weed Control Board staff, contractors, or other agencies access to
and occupation of State Park property for the purpose of removing noxious weeds.
C. The Friends will report locations of noxious weeds to Weed Control staff when found and work
together with Weed Board and State Parks staff to determine priorities.
The Weed Control Board will, within the limitations of this agreement, perform the following:
A. The Weed Control Board will contribute no more than $5,000.00 during the term of agreement.
B. The Weed Control Board will provide employees, contractors or other agencies with
appropriate personnel and equipment to control noxious weed infestations effectively, as
described in WAC 16-750-003(2)(a), within the State Park limits, to the extent allowed by the
budget described in this Agreement.
C. If using herbicides, the Weed Control Board will conduct the work with properly licensed and
trained staff or contractors and comply with all applicable laws with respect to the storage and
application of herbicides.
D. The Weed Control Board will provide an annual report to the Friends and State Parks each
year of the Agreement to detail work accomplished, as well as goals and priority sites and
species for the following year, as well as participate in at least one meeting per year to review
deliverables, priorities, and methods.
E. The Weed Control Board will invoice the Friends for work performed under this Agreement,
recognizing the budgetary limits of this Agreement.
The State Park will perform the following:
A. State Parks will not make any payments under this Agreement. Funds have already been
obligated to Weed Control Board under IA 325-060 Amd2 and will contribute toward the Weed
Control Board's costs in performing its obligations.
B. The State Park will permit Weed Control Board volunteer staff, contractors, or other agencies
access to and occupation of the State Park property for the purpose of removing noxious
weeds.
C. The State Park will report locations of noxious weeds to Weed Control staff when found and
work together with Friends volunteers and the State Park staff to determine priorities.

TIME OF PERFORMANCE
This Agreement shall have a term commencing on date signed by State Parks, until June 30, 2027,
unless either Party initiates termination as provided in the Termination clause of this Agreement.
The Parties may agree to extend the term of this Agreement; provided, that any extension must be
executed in writing by the Parties prior to the end of the term of the Agreement
ANNUAL REVIEW OF AGREEMENT
The effectiveness of weed control activities and terms of the Agreement shall be reviewed by the
Parties at the end of each year of the Agreement. The terms of the Agreement may be changed by
mutual written amendment signed by all Parties herein.
PROJECT ADMINISTRATION
Administration of this Agreement for the State Park shall be conducted by the Fort Worden State
Park Area Manager or his designee. For the Weed Control Board, the Agreement shall be
administered by the Coordinator. For the Friends, the Agreement shall be administered by the Board
President.
EMPLOYEES
All employees remain employees of their respective agency at all times and shall perform work under
the sole supervision of their agency.
RIGHT-OF-ENTRY
Weed Control Board staff may enter upon the State Park facilities to perform work and make the
records where work was performed available to State Parks.
JOINT HOLD HARMLESS
Each party to this Agreement shall be responsible for damage to persons or property resulting from
the negligence on the party of itself, its employees, its agents, or its officers. Neither party assumes
any responsibility to the other party for the consequences of any act or omission of any person, firm,
or corporation not a part to this Agreement.
COMPLIANCE WITH LAWS
All work performed under this Agreement shall comply with all federal and state laws, local laws and
ordinances, and applicable permit requirements.
RECORDS AND AUDIT
Each Party shall maintain books, records, documents, and receipts sufficient to demonstrate
performance under this Agreement for a period of six (6) years and shall make such records available
for inspection upon request by any Party or as required by law.
TERMINATION
Any party may terminate this Agreement by giving written notice to the others, at the address first
noted herein, of such termination and specifying the effective date thereof at least thirty (30) days
before the effective date of such termination.
INDEMNIFICATION
Each party shall be responsible for the actions and inactions of itself and its own officers,
employees, and agents acting within the scope of their authority.

SEVERABILITY
Should any clause, phrase, sentence or paragraph of this Agreement be declared invalid or void, the
remaining provisions of this Agreement shall remain in full force and effect.
ENTIRE AGREEMENT
The Agreement merges and supersedes all prior applications, representations, negotiations,
approvals, and understandings between the Parties hereto relating to the subject matter of this
Agreement and constitutes the entire Agreement between the parties.
