HomeMy WebLinkAboutCONSENT Resolution re signature authority, and rescind Res. 61-16 JEFFERSON COUNTY BOARD OF COUNTY COMMISSIONERS CONSENT AGENDA REQUEST TO: Board of County Commissioners(BOCC) FROM: Eric Kuzma,Public Works Director DATE: January 26,2026 SUBJECT: Designation of Federal Fund Administration Signature Authority for Jefferson County Public Works Projects and rescind Jefferson County Resolution 61-16 STATEMENT OF ISSUE: Under the Code of Federal Regulations, 2 CFR 200, Federal award and approved project budgets, annual and final fiscal reports or vouchers requesting payment must include a certification signed by an official who is authorized to legally bind Jefferson County. Jefferson County Resolution 61-16, adopted in 2016, designated the Public Works/Director County Engineer as the primary official authorized to legally bind Jefferson County and the Assistant Public Works Director/Engineering Services Manager as the alternate. This resolution rescinds and replaces Jefferson County Resolution 61-16 due to organizational changes and designates the Jefferson County Public Works Director or the County Engineer as the primary officials authorized to legally bind Jefferson County and the Engineering Services Manager as the alternate. ANALYSIS: This serves to update signature authority related to organizational changes and allows the continuation of the current practice which has proven successful through consistent passing of federal financial audits. FISCAL IMPACT: Efficient processing of grant billings is critical to ensure expeditious reimbursement of funds expended by Jefferson County Department of Public Works on road maintenance and construction projects. Administration of Federal Awarded Funds WHEREAS, Jefferson County Department of Public Works is responsible for maintaining the integrity of the County road system for safety and mobility; and WHEREAS, Jefferson County Department of Public Works routinely applies for and is awarded Federal funding for road maintenance and construction projects; and WHEREAS, the Code of Federal Regulations was consolidated and detailed in 2 CFR 200 `SuperCircular' requiring that, in order to assure that expenditures are proper and in accordance with the terms and conditions of the Federal award and approved project budgets, annual and final fiscal reports or vouchers requesting payment must include a certification signed by an official who is authorized to legally bind the non-federal entity; and WHEREAS, any funding agreement between Jefferson County and a Federal entity is authorized by the Board of County Commissioners (BOCC); and WHEREAS, Jefferson County operates under a Certification Acceptance (CA) Qualification Agreement, signed by the BOCC,and approved by Washington State Department of Transportation(WSDOT)Highways and Local Programs division,allowing the County to operate under full 'CA' status in administering Federal Highway Administration(FHWA) projects; and WHEREAS, Jefferson County Department of Public Works has a Grant Policy which ensures the application of a consistent process when applying for, managing, billing, and accounting for grants; and WHEREAS, it is critical to ensure the efficiency and consistency of payments and reimbursements for funds expended on Jefferson County Department of Public Works road maintenance and construction projects; and WHEREAS, Jefferson County Resolution 61-16, adopted in 2016, designated the Public Works Director/bounty Engineer as the primary official authorized to legally bind Jefferson County and the Assistant Public Works Director/Engineering Services Manager as the alternate; and WHEREAS, the Public Works Director and County Engineer are now separate positions, and the current Engineering Services Manager does not hold the title of Assistant Public Works Director, making it necessary to update the designation of signature authority to reflect current organizational roles; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF JEFFERSON COUNTY STATE OF WASHINGTON, AS FOLLOWS: Section 1. Whereas Clauses are Findings of Fact. The Whereas clauses above are findings of fact for this resolution. Section 2. Purpose.This resolution updates the designation of signature authority to reflect current organizational roles. Section 3. Signature Authority. For Public Works projects, the BOCC designates the Jefferson County Public Works Director or the County Engineer as the primary official authorized to legally bind Jefferson County through signature approval of annual and fiscal reports or vouchers requesting payment or grant reimbursements. The Engineering Services Manager shall be the designated alternate. Section 4. Rescind Jefferson County Resolution 61-16. Jefferson County Resolution 61-16 is rescinded. Section 5. SEPA Categorical Exemption. This recission of Resolution 61-16 and designation of signature authority is categorically exempt from SEPA environmental review pursuant to WAC 197-11-800(19)(a). Section 6. Effective Date. This resolution shall take effect and be in full force immediately upon approval and adoption by the Jefferson County Board of Commissioners.
