A Memorandum of Understanding Establishing a Joint Land Use Regulatory Program and Minimum Development Guidelines (MOU) was prepared for ratification by and among the Quinault Indian Nation, Jefferson County and Grays Harbor County of the State of Washington. 2.) The Quinault Indian Nation through Quinault Indian Nation Business Committee Resolution No. 93-06-70 adopted the MOU. 3.) No resolution was found indicating Grays Harbor County adopted the MOU. 4.) The MOU was not recorded with Jefferson County Auditor's office. In accordance with RCW 39.34.040, the MOU is not effective until same is approved by the legislative authority (the County Commission) and recorded with the County Auditor. Applicants question the validity of the MOU. 5.) The validity of the MOU remains in doubt in light of the decision by the United States Supreme Court in Brendale v. Yakima Indian Nation 492 U.S. 408, 109 S.Ct.2994 (1989). According to the Quinault Tribe's web site their entire reservation is "allotted" land rather than "trust" land. 6.) The application was reviewed by the Jefferson County Department of Community Development staff on July 31, 2007 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: Eagle Habitat Areas, Wetlands and Flood Hazard Area. 7.) Staff conducted a site visit of the parcel and determined the proposed building site is not within the mapped Flood Hazard Area. The parcel overlooks the Pacific Ocean to the west, and is located between mile markers 153 and 154 on Hwy 101 between Kalaloch and Queets. The upland portion is roughly flat. The bluff is about 80 ft high. 8.) Washington State Department of Fish &Wildlife commented on the application August 22, 2007 and determined an eagle plan will be required for this proposal. 9.) The project components are more than 250'from the mapped/identified wetland. The requirement for a wetland delineation and report is waived based on maintenance of a 225' buffer from the wetland per UDC Table 3-3. 10.) The project is located in close proximity to an identified wetland and is subject to the delineation provisions of JCC 18.15 Article VI-I. Based upon the proposed location of the project in relation to the identified wetland, the applicant has agreed to maintain a buffer (setback) that exceeds the standard buffer requirements by fifty(50) percent. The applicant acknowledges the additional setback and agrees to maintain the extra 50 percent buffer, therefore, waiving the wetland delineation requirements of the Unified Development Code. 11.) The applicant shall fully adhere to all conditions and requirements of the eagle habitat management plan. 12.) The applicant is proposing to create or add 728 square feet of impervious surface and 4200 square feet of land disturbing activities. JCC 18.30.060 and 18.30.070 require your proposal comply with Minimum Requirement#2 (Construction Stormwater Pollution Prevention) of the Department of Ecology Stormwater Management Manual for Western Washington to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. 13.) The project shall comply with Construction Stormwater Pollution Prevention (SWPP) Elements#1 through #12 of the Department of Ecology's Stormwater Management Manual for Western Washington to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. 14.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i). 15.) The site plan as submitted with the building permit application on July 18, 2007 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated September 24, 2007 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 16.) This approval is for a single famiOsidence only. Any future permits on this are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 17.) Outdoor residential storage shall be maintained in an orderly manner and shall create no fire, safety, health or sanitary hazard. 18.) A minimum of two (2) on-site parking spaces shall be provided for the single family residence. 19.) A septic permit (SEP07-00266) was approved on September 11, 2007 for a system of 480 gallons per day. 20.) The building height is not to exceed 35 feet. 21.) Residential developers and individual builders shall be required to preserve shoreline vegetation and reduce the associated risk of erosion during construction and any future activity which may impact the stability of the shoreline. 22.) Exterior lighting for residential uses shall not exceed twenty feet (20') in height from the finished grade, excepting when such lighting is an integral part of a building or structure. Ground level lighting is encouraged. 23.) Lighting fixtures shall be designed and hooded to prevent the light source from being directly visible from outside the boundaries of the property. The intensity or brightness of all lighting, during construction and after project completion shall not adversely affect the use of surrounding properties or adjoining rights-of-way. 24.) Minimum setback from the edge of Hwy 101 right-of-way is 111 ft (as depicted on the site plan). Minimum setback from the top of the bluff is 117 ft (as depicted on the site plan). Minimum side yard setbacks are 5 ft. 25.) The proposed access to the parcel was reviewed by Washington State Department of Transportation under Access Connection Permit, Permit Number 46725. 26.)
