CONDITIONS for Building Permit# :BLD07-00554
1.) Critical Aquifer Recharge Areas may require special protection measures to mitigate water
quality degradation. The submitted proposal does not require additional aquifer
protection measures. However, during construction the project shall follow the Best
Management Practices (BMPs) and facility design standards as identified and defined in
the Stormwater Management Manual for the Puget Sound Basin:
2.) To help prevent seawater from intruding landward into underground aquifers, all new
development activity on Marrowstone Island, Indian Island and within 1/4 mile of any
marine shoreline shall be required to infiltrate all stormwater runoff onsite.
3.) The property owner shall comply with Water Conservation Measures (per list maintained
by the UDC Administrator).
4.) The project shall comply with Construction Stormwater Pollution Prevention (SWPP)
Elements#1 through #12 of the Department of Ecology's Stormwater Management
Manual for Western Washington to control stormwater, erosion and sediment during
construction. BMPs shall address permanent measures to stabilize soil exposed during
construction, and in the design and operation of stormwater and drainage control systems.
5.) Outdoor residential storage shall be maintained in an orderly manner and shall create no
fire, safety, health or sanitary hazard.
6.) Not more than 2 unlicensed vehicles shall be stored on any lot unless totally screened
from view of neighboring dwellings and rights-of-way. Such screening shall meet all
applicable performance and development standards specific to the district in which the
storage is kept, and shall be in keeping with the character of the area. Screening shall
meet the requirements of Chapter 18.30 JCC. Outdoor storage of 3 or more junk motor
vehicles is prohibited except in those districts where specified as an autormobile wrecking
yard or junk (or salvage) yard and allowed as a permitted use in Table 3-1 or Chapter
18.18 JCC, and such storage shall meet the requriements of JCC 18.20.100, Automobile
wrecking yards and junk (or salvage) yards. In no case, shall any such junk motor
vehicles be stored in a critical area.
7.) The road approach permit(RAP03-00261) must be inspected and finaled by the Jefferson
County Department of Public Works prior to the final inspection/certificate of occupancy of
this residence. Contact Terry Duff, Department of Public Works at 360-385-9159 for the
final road approach inspection.
8.) The building height is not to exceed 35 feet.
9.) Maximum lot coverage is not to exceed 25%. Lot coverage is defined as amount of
impervious surface which includes roof tops, driveways, concrete, etc.
10.) Exterior lighting for residential uses shall not exceed twenty feet(20') in height from the
finished grade, excepting when such lighting is an integral part of a building or structure.
Ground level lighting is encouraged.
11.) Lighting fixtures shall be designed and hooded to prevent the light source from being
directly visible from outside the boundaries of the property. The intensity or brightness of
all lighting, during construction and after project completion shall not adversely affect the
use of surrounding properties or adjoining rights-of-way.
12.) Minimum setback from Oak Bay Road right-of-way shall be 30 feet. Minimum setback
from private ingress/egress easements shall be 20 feet. Minimum south and north
property setbacks shall be 5 feet. Minimum west(commercial forest lands adjacent)
property setback shall be 50 feet per approved reduced setback granted on October 3,
2003 by the Administrator.
13.) A vegetative buffer of 30-feet sh•e permanently maintained from the top orile of the
Landslide Hazard Area. All buffers shall be measured perpendicularly from the top of the
Landslide Hazard Area.
14.) PRIOR TO FINAL BUILDING OCCUPANCY, PROPONENT SHALL SUBMIT A WRITTEN
LETTER FROM STEVEN P. MORTA WHO PREPARED THE REVISED SITE PLAN,
SLOPE STABILITY ANALYSIS AND GEOTECHNICAL ENGINEERING REPORT DATED
MAY 6, 2008 STATING THAT THE STRUCTURE AND/OR FACILITIES HAVE BEEN
CONSTRUCTED IN CONFORMANCE WITH THE REQUIREMENTS OF THE
"GEOTECHNICAL REPORT." THE LETTER SHALL BE STAMPED BY THE LICENSED
GEOLOGIST/ENGINEER.
15.) Landslide Hazard Areas and their associated buffers shall remain naturally vegetated.
Should buffer disturbance occur during construction, the Unified Development Code
(UDC)Administrator shall require replanting with native vegetation. No alterations shall be
made to the Landslide Hazard Area or its associated buffer without prior authorization by
the UDC Administrator.
16.) Prior to and during approved construction activities, the perimeter of the landslide hazard
area buffer shall be marked with a temporary sign. The sign shall be placed in such a
manner that it can be directly observed from the construction area. The sign shall contain
the following statement: "Landslide Hazard Area and Buffer- Do not Remove or Alter
Existing Vegetation."
17.) All construction activities shall not encroach upon the landslide hazard area buffer. This
includes the storage or preparation of materials.
18.) The applicant shall permanently separate the boundary of the Landslide Hazard Area
Buffer from the remainder of the subject property through installing logs, trees, a hedge
row, or any other prominent physical marking approved by the UDC Administrator.
19.) RESTRICTIONS ON PLACEMENT OF DRAINAGE FEATURES, SEPTIC DRAINFIELDS
AND COMPACTED FILLS AND FOOTINGS AND BUFFER AND SETBACKS FROM
LANDSLIDE HAZARD AREAS:
The Geotechnical Engineer requires that ALL SURFACE WATER RUNOFF,
ESPECIALLY FROM DOWNSPOUTS BE DIRECTED INTO THE TWO 3 FOOT BY 3
FOOT BY 20 FOOT INFILTRATION TRENCH LOCATED ON THE BACK SIDE OF THE
SHOP AS INDICATED ON SHEET 1 OF 3 OF THE REVISE[) PLAN DATED MAY 6,
2008.
THE MONOLITHIC FOUNDATION SLAB SHALL BE CONSTRUCTED ON
UNDISTURBED NATIVE SOILS AND THE BOTTOM OF THE MONOLITHIC
FOUNDATION SHALL BE A MINIMUM OF 1 FOOT BELOW GROUND TO PROTECT
THE FOOTINGS FROM FREEZING. THE ENGINEER SHALL BE CALLED OUT TO
THE JOB SITE DURING THE EXCAVATION FOR THE FOUNDATION TO ENSURE
THAT THE MONOLITHIC FOUNDATION IS RESTING ON UNDISTURBED,
COMPACTED NATIVE DENSE SOILS. COMPACTION OF NATIVE SOILS RQUIRES
AS A MINIMUM OF 350+ LB VIBRATORY PLATE COMPACTOR AND 6 SLOW PASSES
PER 12 INCHES LOOSE LIFT.
20.) The lot has already been cleard off of most trees and vegetation. IT IS IMPORTANT
THAT THE REMAINING TREES AND VEGETATION NOT DIRECTLY IN THE BUILDING
FOOTPRINT BE PRESERVED SINCE THEIR ROOT SYSTEM HELPS TO HOLD THE
SOILS IN PLACE DURING HEAVY RAINFALL BUT ALSO HELPS TO DEWATER WET
SOILS THROUGH THE PROCESS OF EVAPOTRANSPIRATION THAT CAN REMOVE
40 TO 60 GALLONS OF WATER PER MATURE TREE PER DAY. ANY REMAINING
BARE SOIL AREAS SHALL BE REPLANTED WITH INDIGENOUS TREES AND
VEGETATION SUCH AS JUNNIPERS, IVY, FERNS AND VINE MAPLE AND OTHER
LOCAL PLANTS THAT THRIVE IN THIS COOL, WET ENVIRONMENT.
21.) PRIOR TO CONSTRUCTION AOJITIES ON THE SITE, GEOTEXTILE SILSION
FENCING SHALL BE PLACED ON THE DOWNHILL SIDE OF THE BUILDING SITE TO
PREVENT SOIL EROSION OF THE EMBANKMENT. IT IS RECOMMENDED THAT
INITIAL CONSTRUCTION TAKE PLACE DURING THE DRIER TIMES OF THE YEAR
FROM MID MAY TO MID OCTOBER AND THAT THE RESIDENCE BE WEATHERED IN
BY THE BEGINNING OF NOVEMBER. IF RAIN IS EXPECTED ALL BARE GROUND IS
TO BE PROTECTED WITH 6 MIL VISQUEEN TO MINIMIZE SOIL EROSION OF THE
BUILDING SITE AND THE RESULTING WATER RUNOFF TO BE DIRCTED AWAY
FROM THE DOWNSHILL SLOPES AND INSTEAD INTO THE 3 FOOT BY 3 FOOT BY
20 FOOT INFILTRATION TRENCH WHERE THE STORMWATER FROM THE
IMPERVIOUS SURFACES WILL BE ABLE TO PERCOLATE BACK INTO THE GROUND
AND EVENTUALLY HELP TO RECHARGE THE ACQUIFER.
22.) THE PROPOSED RESIDENCE WILL BE CONSTRUCTED ON UNDISTURBED NATIVE
COARSE SANDS WITH GRAVELS WITH STEVEN P. MORTA PRESENT DURING
EXCAVATION TO VERIFY THIS. ANY SURFACE WATER RUNOFF SHALL BE
DIRECTED AWAY FROM THE SLOPES AND INTO THE INFILTRATION TRENCH.
IT IS RECOMMENDED THAT AS MUCH AS IS POSSIBLE THAT REMAINING TREES
AND VEGETATION BE PRESERVED TO INCREASE THE STABILITY OF THE SITE
AND PREVENT SOIL EROSION ONTO OAK BAY ROAD BELOW.
23.) THE ENGINEER SHALL BE PRESENT DURING THE INITIAL EXCAVATION PHASE TO
ENSURE THAT THE BOTTOM OF THE MONOLITHIC FOUNDATION IS AT LEAST A
FOOT BELOW GRADE AND THAT THERE IS NO STANDING WATER INSIDE THE
BOTOM OF THE EXCAVTION.
