HomeMy WebLinkAbout020711_ca18 Department of Public Works o Consent Agenda Page 1 of 2 Jefferson County Board of Commissioners Agenda Request From: Board of Commissioners Philip Morley, County Administrator Frank Gifford, Public Works Director rtPJ February 7,2011 To: Agenda Date: Subject: Execution of Lands License Agreement Statement of Issue: Execution of Lands License Agreement On March 2nd, 2009, Olympic Community Action Programs (OlyCAP) entered into a Lands Lease Agreement (Agreement) with the County for approximately four tenths (.40) of one acre of property located at the Jefferson County Transfer Station Facility. The designated site has been used for storage of delivery-ready cord wood for home heating use as part of an energy assistance program for OlyCAP clients. The Agreement has had no negative effect on the operations of the Transfer Station Facility or the City of Port Townsend's Biosolids Composting Facility; OlyCAP has met all performance standards contained within the Agreement, and; the energy assistance program, aided by this Agreement, has been a net benefit to the citizens of Jefferson County. OlyCAP has requested that it be allowed to utilize the site to prepare larger sections of un split donated wood for storage and distribution. This activity was expressly prohibited in the original Agreement (attached for reference). Public Works is satisfied that this activity poses little additional risk as long as the site continues to be maintained in the orderly manner it has been. Public Works acknowledges the importance of this emergency assistance program and believes that the continuance of this program on behalf of the County's citizens and the Terms and Conditions as set forth in the attached Agreement constitute a good and valuable consideration provided by OlyCAP. Recommendation: Public Works recommends that the attached Agreement between Jefferson' County and Olympic Community Action Programs be approved by the Board of County Commissioners.
