A Geotechnical Report was submitted in conjunction with this application. The report was prepared by NTI Engineering and Surveying (dated April 16, 2008) and addressed emergency slope repairs. Engineering plans for the building permit shall be based on recommendations in that report. 2.) PRIOR TO FINAL BUILDING INSPECTION, PROPONENT SHALL SUBMIT A WRITTEN LETTER FROM THE ENGINEER OF RECORD ACCEPTING THE WORK DONE AS INSTALLED PER PLAN. THE LETTER SHALL BE STAMPED BY THE LICENSED ENGINEER. 3.) A re-vegetation plan that meets the recommendations in the April 16, 2008 Landslide Evaluation for Emergency Repairs prepared by NTI must be approved by NTI and submitted to Jefferson County for review and approval. The plan must also comply with shoreline requirements for shore defense works, as specified in JCC 18.25.430(4)(b). THE PLANTS MUST BE INSTALLED PRIOR TO FINAL INSPECTION. 4.) In addition to Jefferson County permit conditions, the project proponent shall comply with all conditions set forth by the Washington Department of Fish and Wildlife through Hydraulic Project Approval. 5.) Work within the jurisdiction of the Shoreline Master Program other than as described above shall receive separate review from this Department. 6.) Construction shall be in substantial compliance with the engineered plan sheets submitted on October 9, 2008 and the letter from NTI on October 20, 2008 as it exists now or is hereafter amended by Jefferson County and/or the Washington Department of Ecology. Project plans may be revised based on engineered plans submitted to and approved by Jefferson County. 7.) The applicant/owner and all future owners are responsible for maintaining and protecting the stormwater runoff tightline to the beach against damage due to normal wear, weather exposure, and/or trees, rocks and debris. If and when damage occurs to the tightline that renders it ineffective, the responsible party must execute the necessary repairs as soon as possible and no longer than 30 days. 8.) The stormwater runoff tightline piping must be composed of durable material that is resistant to weakening and damage due to time, weather exposure (including ultraviolet radiation), and impacts from trees, rocks and debris. The corrugated plastic material used for tightline construction in the past is no longer acceptable. More durable plastic or ultraviolet radiation-resistant flexible rubber material shall be required. 9.) The stormwater runoff tightline shall be designed and placed in order to minimize visual impacts to users of the beach and nearby waters. 10.) THIS APPROVAL INCLUDES ONLY THOSE ACTIONS NEEDED TO ABATE THE EMERGENCY. FOR THIS PROJECT, THE EXEMPTION COVERS CONSTRUCTION OF THE SUPPORT STRUCTURES ALONG THE SLOPE, PLACEMENT OF THE REVETMENT ALONG THE BASE OF THE SLOPE, AND INSTALLATION OF A STORMWATER SYSTEM THAT DIRECTS SURFACE WATER TO THE BOTTOM OF THE SLOPE. 11.) RE-CONSTRUCTION OF THE STAIRS AND TRAIL TO THE BEACH IS NOT COVERED UNDER THIS APPROVAL. 12.) Based on a letter received from Anne Bartow, an adjacent property owner, the emergency repairs may extend 15 feet onto her property. Since the letter was received, the project has been revised to end at the property line. These rock walls were complicated in their location on the hill and at the toe of slope and included a concrete deck between the walls and four tall timber pilings. My first response was emailed to you on Friday, May 15,2009 at 10:10 am. The comment letter from DOE identifies three areas of concern: Shorelands, Solid Waste &Financial Assistance and Water Quality. My comments below are to that of Shorelands. I accept the provisions/recommendations for Solid Waste& Financial Assistance and Water Quality. As a steward of my own land these last two comments are in my best interest. However, 1 have serious concerns about the shoreland recommendation to change my design such that the size of the landings are no wider that the stairway. Shading Impact First of all,the landing at the top is to be constructed at ground level and the one at the bottom will be about 5.5 feet above the concrete base. Neither of these decks affects the shading of the bank. The second deck from the top is to be constructed above an old deck that was built many years ago by the prior owners of the property. After this old deck is removed, the amount of shading will actually be reduced allowing more vegetative growth. This deck combined with the top deck was designed to provide further reinforcement of the bank stabilization features of the structure(i.e. they help to contain sloughing). Because of the distance of decks three and four from the hillside,the flow of sunlight does not shade any particular area for more than a couple of minutes at any one time.The extra width of deck three is approximately 23 ft off the bank horizontally and 26 ft vertically from the concrete base. The extra width of deck four is approximately 15 ft horizontally and 16 ft vertically off the concrete base. The design of the stairs at these two points has the landings on four vertical pilings (two for each landing)which support the stair structure with a minimum of mass. These "stilts" were designed to suspend the stairway structure from the hank to minimize the impact to the hank either from damage due to structural loads or from damage to the environment of the native vegetation which is the specific concern of the I)OE letter. The shadowing effect of the entire staircase is almost identical in nature to that which exists naturally from shade from the random 1 of2 i • evergreens found along the bank from crest to toe. Native lower foliage and ground cover is shade tolerant. The extra width of the landings that only occur on the waterside of the structure adds no consequential shading. Further the extra width of these two decks casts most of the shadows on the stair supporting structure before coming in contact with the bank vegetation. Because of the distance of the stair structure from the bank, the shadow effect of sunlight is present only for a short time during the early morning hours and as the sun moves westward the sun shines behind the structure directly onto the bluff. Any shadowing at that time would affect only the retaining wall and platform below. After about l pm to 2pm all sunlight is indirect on this East facing bluff and as a result any shading caused by the deck design extends out onto the beach without any impact to the bluff. The entire stairway design was conceived to minimize impacts to the bluff and will be very consistent with the kind and quantity of sunlight reaching the bluff prior to construction. Safety Impact The stairway is approximately 50 vertical feet of travel. Because of this distance, the concept of the landings and the additional width of the two landings in question were provided to meet residential code landing spacing and to provide rest stops out of the path of the stairway for people climbing this sizable structure. These rest stops are even more important when considering such things as emergencies, the safety of the elderly or very young and when transporting things like coolers, tables and chairs crab pots etc. for use at the beach. Without these rest stops, the stairway would be far more difficult and dangerous to use. Because of my wife's fear of heights, she would be unable to use the stairway if constructed per the recommendations of DOE. Safety in the design of the deck structure was of paramount importance and this issue was communicated to our engineering team and incorporated into the submitted design. Design Presidence The design of this new stairway was patterned after my neighbors' who is also the architect for the new stairway design. I submit pictures showing that the vegetation for his design is actually flourishing.
