CONDITIONS for Building Permit# :BLD08-00249
1.) The applicant shall fully adhere to all conditions and requirements of the eagle habitat
management plan.
2.) Flood hazard reduction measures are to be used as required by the Jefferson County
Flood Damage Prevention Ordinance 07-0515-06 (Jefferson County Code Chapter
15.15).
3.) Construction Materials and Methods of Construction to Reduce Flood Hazard
(i) All new construction and substantial improvements shall be constructed with materials
and utility equipment resistant to flood damage.
(ii) All new construction and substantial improvements shall be constructed using methods
and practices that minimize flood damage.
(iii) Electrical, heating, ventilation, plumbing, and air-conditioning equipment and other
service facilities shall be designed and/or otherwise elevated or located so as to prevent
water from entering or accumulating within the components during conditions of flooding.
Locating such equipment below the base flood elevation may cause annual flood
insurance premiums to be increased.
4.) The project shall adhere to the Best Management Practices (BMPs) to control stormwater,
erosion and sediment during construction. BMPs shall address permanent measures to
stabilize soil exposed during construction, and in the design and operation of stormwater
and drainage control systems.
5.) In addition to Jefferson County permit conditions, the project proponent shall comply with
all conditions set forth by the Washington Department of Fish and Wildlife through
Hydraulic Project Approval.
6.) No fill or other material may be placed in the waters or intertidal areas of Jefferson
County.
7.) All lumber and other materials treated with preservatives shall be sufficiently cured to
minimize leaching into the water or shore bed, in accordance with the BMPs approved by
the Washington Department of Fish and Wildlife.
8.) Total float area shall not exceed 160 square feet in size.
9.) Docks and floats shall not extend more than three feet in height above the water nor
exceed eight feet in width. Piers shall be constructed to the minimum height necesssary
above historic extreme high tide and shall not exceed eight feet in width.
10.) Construction of the pilings shall include stops, and the stops shall be designed to prevent
the float from grounding during low tides.
11.) The following conditions also appall the project: •
A. The creosote pilings shall be removed from Mats Mats Channel prior to issuance of a
building permit. Removal is to comply with Washington State Department of Ecology's
suggest best management practices and disposal requirements, as presented in "Focus
on Treated Wood Exclusion" (which is available at
http://www.ecy.wa.gov/pubs/0304038.pdf), or by contacting Dee Williams (Ecology
Hazardous Waste and Toxics Reduction program) at 360-407-6348.
B. Removal of trees and shrubs from the shoreline are not authorized.
C. Boats that are occupied shall not be moored at private piers, ramps, and floats for
longer than three days unless pump-out facilities are available in the immediate vicinity.
D. The structure shall comply with U.S. Coast Guard requirements.
E. Proper disposal of construction debris must be on land in such a manner that debris
cannot enter the Mats Mats Channel or cause water quality degradation of state waters.
F. Erosion control measures must be in place prior to any clearing, grading, or
construction. These control measures must be effective to prevent soil from being carried
into surface water by stormwater runoff. Sand, silt, clay particles, and soil will damage
aquatic habitat and are considered pollutants when discharged to waters of the state.
G. Any discharge of sediment-laden runoff or other pollutants to waters of the state is in
violation of Chapter 90.48, Water Pollution Control, and WAC 173-201A, Water Quality
Standards for Surface Waters of the State of Washington, and is subject to enforcement
action.
H. During construction, all releases of oils, hydraulic fluids, fuels, other petroleum
products, paints, solvents, and other deleterious materials must be contained and
removed in a manner that will prevent their discharge to waters and soils of the state. The
cleanup of spills should take precedence over all other work on the site.
I. All trenches, depressions, or holes created in the intertidal area shall be backfilled prior
to inundation by tidal waters.
J. Prior to issuance of a building permit for the proposal, the applicant shall contact
Margie Schirato with Washington Department of Fish and Wildlife at 360-427-2179 to
ensure compliance with Hydraulic Project Approval requirements.
K. A bulkhead shall not be allowed in the future to protect the pier, ramp, and float
structure, which is a non-essential, non-appurtenant structure.
L. Any damage to the proposed structure shall be repaired or removed as soon as
practicable. At the end of the useful life of the structure, the pier, ramp, and float will be
removed as soon as practicable.
