The week began with the revenue forecast for the state operating budget, and the transportation revenue forecast was released 2-days later. Revenue Forecasts: Operating budget: Revenue collections are predicted to increase $827 million in the current two-year budget compared to expectations from November, according to a forecast from the state’s Economic and Revenue Forecast Council. This 1.1% increase reflects early proceeds from the slate of tax increases the Legislature approved last year. Monday’s forecast means projected collections for the current biennium are up $438 million from the numbers lawmakers used to craft the state budget last spring. This puts total revenue expectations at $75.3 billion. Transportation: Transportation revenues are forecasted to total $8.741 billion in 2025–27, $10.747 billion in 2027–29, and $10.273 billion in 2029–31. The enacted 2025–27 transportation budget balanced through 2027–29. The Legislature adopted a revenue package last year that was used mainly to cover shortfalls in existing transportation projects. With the February revenue forecast, transportation revenues for the 2023–25, 2025–27, and 2027–29 period are now expected to be $118.0 million lower than assumed in the 2025–27 budget. According to the forecast, the decline (compared to the November forecast) is due to reductions in fuel taxes (lower consumption) and license and permit fees (lower car and truck registrations). Inflation-adjusted revenues are forecasted to decline each year beginning in 2029. From 2029 to 2035, inflation-adjusted revenues are expected to decline by 11.2%. However, excluding transfers, inflation-adjusted revenues are expected to decline by 2.5% over that period. The House worked on Saturday and the Senate spent most of Monday passing the millionaires tax, SB 6346 <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=d289b709ac&e=850008f825> . Senate Majority Democrats advanced legislation to tax households earning more than a million dollars. Passage of the bill followed a three-and-a-half hour debate. Three Democrats joined all 19 Republicans in opposing the bill, which passed 27-22, and now goes to the House for consideration. It is scheduled for a hearing in the House Finance Committee next Tuesday. On Wednesday, the policy committees started churning through bills from the opposite chamber and will continue to do so until the policy committee deadline on February 25th. The fiscal committees have until March 2nd. Budgets: Finally, we anticipate seeing the Operating Budgets on Sunday and the Transportation Budgets on Monday. Regarding the transportation budget, the House and Senate are rumored to have different approaches concerning whether to bond revenue. The Governor’s transportation budget proposal assumed $3.4 billion in bonding for maintenance and preservation and ferries. Chief Justice John Roberts authored the majority opinion, joined by Justices Neil Gorsuch, Amy Coney Barrett, Elena Kagan, Sonia Sotomayor, and Ketanji Brown Jackson. Writing for the Court, Chief Justice Roberts indicated that, “The president asserts the extraordinary power to unilaterally impose tariffs of unlimited amount, duration and scope. In light of the breadth, history, and constitutional context of that asserted authority, he must identify clear congressional authorization to exercise it. IEEPA’s grant of authority to ‘regulate . . . importation’ falls short. IEEPA contains no reference to tariffs or duties. The Government points to no statute in which Congress used the word ‘regulate’ to authorize taxation. And until now no President has read IEEPA to confer such power.” Transportation U.S. Department of Homeland Security Transportation Security Administration * Funding for the Transportation Security Administration (TSA) lapsed last Saturday after lawmakers failed to reach any bipartisan agreement on Fiscal Year (FY) 2026 appropriations for the Department of Homeland Security (DHS). The American Federation of Government Employees (AFGE) reported <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=04fabba3 7b&e=850008f825> that, if the partial shutdown continues, TSA screeners would receive a 50 percent paycheck near the end of the month and then miss a full paycheck in March. While most TSA agents are considered essential employees and are required to work without pay, DHS noted <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=2d56e771ac&e=850008f8 25> in a statement that “the longer the shutdown lasts, the more severe the impact will be on the Transportation Security Officers (TSOs) and other front-line workers who will have to keep coming to work. This could lead to increased wait times at airports across the country.” In a joint statement, the U.S. Travel Associations, Airlines for America (A4A), and the American Hotel & Lodging Association (AHLA) urged <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=d1e2a3a47d&e=850008f825> Congress to “act with urgency to ensure TSA is fully funded to carry out its critical aviation security mission and pursue permanent solutions to guarantee pay for essential federal workers.” The groups specifically advocated for enactment of the Keep America Flying Act (H.R. 5851 / S. 3031), which would provide for continued pay for TSA officers and air traffic controllers during future shutdowns. U.S. Department of Transportation Federal Transit Administration * Federal Transit Administrator Marc Molinaro announced that he would depart the agency today after serving as its leader for the last six months. Media reports <https://watransit.us12.list-manage.co m/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=fa38de8890&e=850008f825> that the former Congressman from New York may be leaving FTA to pursue a seat in the New York State Assembly. In a post on X, the Administrator offered <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=cc591cd341&e=850008f825> that he was “coming home to be closer to my family and get back into the fight.” We will be sure to keep you updated on any succession plans for agency leadership moving forward. Federal Motor Carrier Safety Administration * The Federal Motor Carrier Safety Administration (FMCSA) stated <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=ea6f628de0&e=850008f825> that officials issued 448 notices of proposed removals to commercial driver’s license (CDL) schools found to violate the agency’s standards of safety. A press release stated that “noncompliant schools lacked qualified instructors, used fake addresses, and failed to properly train drivers on the transportation of hazardous materials, among other violations.” The agency added that 109 training providers voluntarily removed themselves from the Training Providing Registry prior to upcoming investigations and an additional 97 providers remain under investigation for compliance issues. Office of the Secretary * The U.S. Department of Transportation (DOT) solicited <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=7df36556d0&e=850008f825> nominations for membership to the agency’s Intelligent Transportation Systems Program Advisory Committee (ITSPAC). The Committee provides counsel and recommendations to the Secretary on intelligent transportation system (ITS) initiatives. The agency specifically seeks representatives from local highway departments; state, local, and regional transit agencies; state, local, and regional wildfire, land use, and resource management agencies; metropolitan planning organizations (MPOs); and national, state, and local transportation agencies and associations. DOT will accept nominations until March 16, 2026. Congress * Yesterday, bipartisan leaders of the House Transportation and Infrastructure Committee and House Armed Services Committee released <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c 22fe2ef2a8361&id=7fca5d07e3&e=850008f825> a new measure to address factors that contributed to the fatal crash between a commercial airliner and Black Hawk helicopter over the Potomac River. The Airspace Location and Enhanced Risk Transparency (ALERT) Act of 2026 <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=40ffb88dda&e=850008f825> is intended to address all 50 recommendations outlined by NTSB and serve as a “thorough and holistic legislative solution to improve U.S. aviation safety,” according to a press release. During a hearing <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=bb41fde014&e=850008f825> last week, National Transportation Safety Board (NTSB) Chair Jennifer Homendy urged Congress to swiftly approve the legislation, arguing that it would assist greatly in preventing similar accidents in the future. * The House Science, Space, and Technology Subcommittee on Research and Technology convened a hearing <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=dc888210f3&e=8 50008f825> to discuss goals for U.S. surface transportation research. In his opening statement <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=7603784c4a&e=850008f 825> , Subcommittee Chair Jay Obernolte noted that the Subcommittee will play a role in developing transportation research provisions in the next surface transportation reauthorization and argued that Congress should advance research into transportation system vulnerabilities, artificial intelligence (AI), and emerging technologies such as digital infrastructure and autonomous vehicles (AVs). * Earlier this week, California Representatives Lateefah Simon and Sara Jacobs introduced <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=35ddae0328&e=850008f825> the Connecting Communities Through Transit Planning Act (H.R. 7298 <https://watransit.us12.list-manage.com/track/click?u=6c70c3a1d76c22fe2ef2a8361&id=f439bf8a61&e=850008f825> ). The legislation would rename the Pilot Program for Transit-Oriented Development (TOD) Planning administered by the Federal Transit Administration (FTA) as the Grant Program for TOD Planning and authorize $375 million for the program from Fiscal Years (FY) 2027 to 2031. It would amend the program to further support predevelopment activities and incentivize housing projects near transit corridors. These Executive Orders and other directives pause some transportation funding; terminate diversity, equity, and inclusion programs; impose new tariffs; and establish priorities for DOT competitive grants.
