1.) The project shall adhere to the Best Management Practices (BMPs) to control stormwater,
erosion and sediment during construction. BMPs shall address permanent measures to
stabilize soil exposed during construction, and in the design and operation of stormwater
and drainage control systems.
2.) The project shall comply with Construction Stormwater Pollution Prevention (SWPP)
Elements#1 through #12 of the Department of Ecology's Stormwater Management
Manual for Western Washington to control stormwater, erosion and sediment during
construction. BMPs shall address permanent measures to stabilize soil exposed during
construction, and in the design and operation of stormwater and drainage control systems.

Dear Mr. Nollette:
In response to your request dated May 5, 2008 regarding clearance to proceed with a Building Permit for
the enhancement of the permitted gate at the terminus of S. 6th Street, the Department of Public Works
submits the following comments.
All building permit issues should be directed to the Department of Community Development (DCD).
They can advise you as to the permit requirements for the fence.
Department of Public Works had determined that the right of way for S. 6th Street was considered as
usage, which limits the public right of way to that area commonly used and maintained. Therefore, based
on the plans provided, the majority of the proposed improvements appear to lie outside of the commonly
maintained roadway, which would be considered private property and our department would have no
jurisdiction on those private parcels.
With respect to the public right of way and in the event that you need to do any work within the current
right of way leading to the existing gate, the Department of Public Works would then review the project
activities within the right of way and issue permits as appropriate.
Recognizing the fact that the gate improvements and maintenance thereof are the responsibility of the
cooperating private property owners, we do not anticipate that the proposed improvements will interfere
with the public use and maintenance of the existing roadway at this time. Thanks for giving us the
opportunity to comment on the proposed improvements which lie outside of the public right of way for S.
6th Street. Please feel free to contact me with any comments, questions or suggestions.
