CONDITIONS for Building Permit# :BLD08-00503
1.) Once the Temporary Erosion Control measures has been installed, you will need to have
MacLearnsberry Engineering do a site visit and verify that they have been installed in
accordance with the plan. Once verified and approved, you will need to provide this
Department with a wet-stamped letter that certifies the temporary erosion control methods
have been installed correctly.
2.) PRIOR TO FINAL BUILDING OCCUPANCY, PROPONENT SHALL SUBMIT A WRITTEN
LETTER FROM MACLEARNSBERRY ENGINEERING STATING THAT THE
STORMWATER FACILITY HAS BEEN CONSTRUCTED IN ACCORDANCE WITH THE
REQUIREMENTS OF THE "DRAINAGE REPORT" DATED SEPTEMBER 15, 2008 AS
SIGNED BY MATTEW C. MACLEARNSBERRY OF MACLEARNSBERRY
ENGINEERING.
3.) WATER LINE TO STUDIO MUST BE 10' FROM ANY SEPTIC COMPONENT
4.) To help prevent seawater from intruding landward into underground aquifers, all new
development activity on Marrowstone Island, Indian Island and within 1/4 mile of any
marine shoreline shall be required to infiltrate all stormwater runoff onsite.
5.) The property owner shall comply with Water Conservation Measures (per list maintained
by the UDC Administrator).
6.) A vegetative buffer of 30-feet shall be permanently maintained from the top or edge of the
Landslide Hazard Area for those portions located outside the 200 foot shoreline
jurisdiction. All buffers shall be measured perpendicularly from the top of the Landslide
Hazard Area.
7.) Landslide Hazard Areas and their associated buffers shall remain naturally vegetated.
Should buffer disturbance occur during construction, the Unified Development Code
(UDC) Administrator shall require replanting with native vegetation. No alterations shall be
made to the Landslide Hazard Area or its associated buffer without prior authorization by
the UDC Administrator.
8.) Prior to and during approved construction activities, the perimeter of the landslide hazard
area buffer shall be marked with a temporary sign. The sign shall be placed in such a
manner that it can be directly observed from the construction area. The sign shall contain
the following statement: "Landslide Hazard Area and Buffer- Do not Remove or Alter
Existing Vegetation."

10.) The applicant shall permanently separate the boundary of the Landslide Hazard Area
Buffer from the remainder of the subject property through installing logs, trees, a hedge
row, or any other prominent physical marking approved by the UDC Administrator.
11.) Critical Aquifer Recharge Areas may require special protection measures to mitigate water
quality degradation. The submitted proposal does not require additional aquifer
protection measures. However, during construction the project shall follow the Best
Management Practices (BMPs) and facility design standards as identified and defined in
the Stormwater Management Manual for the Puget Sound Basin.
12.) The identified Fish and Wildlife Habitat Area (Type Ns Stream), shall maintain a
vegetative buffer setback of 50 feet for that portion of the stream located outside the 200
foot shoreline jurisdiction and is less than 20% grade. If the portion of the stream located
outside the 200 foot shoreline jurisdiction is greater than 20%, the the buffer shall be 75
feet. The setback shall be measured horizontally from the Ordinary High Water Mark
(OHWM) to the proposed development.
13.) An additional setback of five (5) feet is required from the edge of the stream buffer area to
the proposed development.

14.) A permanent physical separation along the boundary of the stream buffer area shall be
installed and permanently maintained. Such separation can include installing logs, trees,
a hedgerow, or any other prominent physical marking approved by the UDC Administrator.
15.) Stream buffer perimeters shall be marked with temporary signs at an interval of one per
parcel or every one hundred (100) feet, whichever is less. Signs shall be in place prior to
and during construction activities. The signs shall contain the following statement: "Buffer
- Do Not Remove or Alter Existing Vegetation."
16.) The applicant shall fully adhere to all conditions and requirements of the full eagle habitat
management plan as signed by WDFW on October 16, 2008 and the applicants on
October 17, 2008.
17.) An Engineered Stormwater Plan has been submitted and approved by the Department of
Community Development. Once the subject permit has been issued the applicant shall
fully implement the provisions of the submitted plan and contact the Jefferson County
Department of Community Development to arrange a schedule to inspect the property for
plan compliance. A Certificate of Occupancy will not be issued until the Department
verifies plan compliance. No clearing for roadways or utilities shall occur on the project
site until clearing necessary for the installation of temporary sedimentation and erosion
control measures have been completed.
18.) Outdoor residential storage shall be maintained in an orderly manner and shall create no
fire, safety, health or sanitary hazard.
19.) Not more than 2 unlicensed vehicles shall be stored on any lot unless totally screened
from view of neighboring dwellings and rights-of-way. Such screening shall meet all
applicable performance and development standards specific to the district in which the
storage is kept, and shall be in keeping with the character of the area. Screening shall
meet the requirements of Chapter 18.30 JCC. Outdoor storage of 3 or more junk motor
vehicles is prohibited except in those districts where specified as an automobile wrecking
yard or junk (or salvage) yard and allowed as a permitted use in Table 3-1 or Chapter
18.18 JCC, and such storage shall meet the requirements of JCC 18.20.100, Automobile
wrecking yards and junk (or salvage) yards. In no case, shall any such junk motor
vehicles be stored in a critical area.
20.) A minimum of two (2) on-site parking spaces shall be provided for the single family
residence.
21.) Residential developers and individual builders shall be required to preserve shoreline
vegetation and reduce the associated risk of erosion during construction and any future
activity which may impact the stability of the shoreline.
22.) Maximum lot coverage is not to exceed 25%. Lot coverage is defined as amount of
impervious surface which includes roof tops, driveways, concrete, etc.
23.) The building height is not to exceed 35 feet.
24.) Exterior lighting for residential uses shall not exceed twenty feet(20') in height from the
finished grade, excepting when such lighting is an integral part of a building or structure.
Ground level lighting is encouraged.
25.) Lighting fixtures shall be designed and hooded to prevent the light source from being
directly visible from outside the boundaries of the property. The intensity or brightness of
all lighting, during construction and after project completion shall not adversely affect the
use of surrounding properties or adjoining rights-of-way.
26.) Minimum setback from SR 20 right-of-way shall be 50 feet. Minimum setback from north
and south property lines shall be 5 feet. Minimum setback from shoreline top of bank as
depicted on the submitted site plan shall be 161 feet. Minimum setback from Commercial
Forest lands shall be 250 feet. If an ESA is present, then the more stricter setback(s)
shall apply.

INTRODUCTION
The Felber/Hackenberg project is a single-family home proposed for construction on a
parcel located between Discovery Bay and SR 20 approximately 3/4 miles south of Four
Corners Road. The total parcel area is 36.81 acres. The building site is 21.85 acres in size
and is that portion of Parcel A of a boundary line adjustment recorded under Auditors
File No. 528538 lying west of SR 20. (See enclosed Exhibit"A") The remainder of
Parcel A lying east of the road is not proposed for development in this application.
EXISTING SITE CONDITIONS
The property is presently covered with second growth forest and brush. The cross-slope
of the building site is approximately 25% and the underlying soils are identified as
Clallam gravelly sandy loam(CmD). These are till soils classified in SCS group "C". An
old road grade adjacent to an old railroad grade runs north-south through the westerly
portion of the property. The railroad grade generally runs along the top of bank of the
steep slope, which drops off to the east shore of Discovery Bay. k� ,

PROPOSED DEVELOPMENT
The proposed structures consist of the main residence, a detached garage and two
detached studio buildings. A 12-foot wide gravel driveway, approximately 1,550 feet in
length, will provide access to the site from SR 20. The total new impervious surface area
is 0.65 acres. The vicinity of the residence and associated structures will be extensively
landscaped with terraces, rock walls and plantings. A pond will be excavated in the
southwesterly corner of the building site and will be fed by a man-made stream and re-
circulating pumps. The total land disturbing activity associated with the above
improvements is 1.99 acres.
DRAINAGE PROVISIONS
This project is located within '/a mile of the shoreline. Consequently the Jefferson County
standards require that all stormwater runoff form new development be infiltrated into the
ground if at all possible. A geotechnical investigation was conducted to determine if the
onsite soils in the vicinity of the proposed house and other structures was suitable for this
purpose. (See enclosed report by Northwestern Territories Inc.) The conclusion reached
was that the soils are not suitable for infiltration in this area. Any attempt to infiltrate
farther down-slope, below the old railroad grade, would also be prohibited due to the
proximity to the steep slope along the shoreline. Due to these constraints a tightline is
proposed to convey runoff from the house and associated structures down the steep slope
for dispersion at the toe of slope above the shoreline. This tightline will be a six-inch

diameter fused joint high-density polyethylene pipe laid on the surface of the ground. The
runoff will be pre-treated in a wetpond prior to direct discharge to the receiving water.
Fortunately the soils along the access driveway are permeable enough to allow full
dispersion of runoff from the driveway in conformance with DOE BMP T5.30. More
than 65% of the native vegetation onsite will be preserved and the total new impervious
surface area will be less than 10% of the site.
WETPOND DESIGN
The proposed wetpond will be located down-slope of the proposed house and associated
buildings. Runoff from roof drains and surface runoff, including a portion of the access
driveway will be routed through this facility. The pond is sized to contain the total
volume of runoff from the tributary area during a six-month 24hr. event. A divider berm
is not required in the pond as the calculated volume is less than 4000 cu. ft. A forebay has
been provided to trap sediment and is a factor in determining the volume provided.
Access to the pond is provided via the old railroad grade, which is approximately fifteen
feet in width. A twelve-foot gravel road connection is provided between the access
driveway and the old railroad grade. Pond side-slopes are 3 : 1 maximum and the length
to width ratio exceeds 4 : 1 at the average depth. The maximum depth is 4 feet.

DOWNSTREAM ANALYSIS
Stormwater from the easterly portion of the site,which includes the proposed access
driveway and building site, is towards the southwest. Flows are either directly to a well
defined natural drainage course, which runs along the southerly margin of the site, or are
intercepted by a ditch along the east side of an old road grade. Ditch flows are directed
towards the south into the drainage course. The up-stream drainage basin on the east side
of SR20 is approximately 127 acres in size. Runoff from this basin is conveyed under
SR20 via a 24-inch CP culvert. The culvert discharges into the deep ravine noted above.
At approximately 450 feet west of SR20 flow from the drainage course is conveyed under
the old road grade in a 54-inch steel culvert. At approximately 175 feet west of the old
road grade flows pass under an old railroad grade in a 29-inch steel culvert. The west
embankment of the railroad grade is very steep and drops all of the way to the shoreline
of Discovery Bay at a point approximately 850 feet west of SR20. The outlet of the
culvert was not observed. There is evidence of an old landslide in this area. The property
owner stated that broken sections of the culvert are lying along the lower section of the
slope above the beach. While the culverts noted above have the capacity for large
volumes of runoff, there is little if any evidence of flowing water along the bottom of the
ravine. The only time that the property owner observed any surface flow was during a
heavy rain storm immediately following extensive snowfall in the late 1990's. In
conclusion, it is not recommended that concentrated flows be discharged to the ravine as
this could threaten the stability of steep slope above the bay as well as the old railroad
grade.
