Erosion Control SEPA:
1. Erosion control-measures must be in place prior to any clearing,
grading,or construction. These control measures must be effective to
prevent stormwater runoff from carrying soil and other pollutants into
surface water or storm drains that lead to waters of the state. Sand,silt,
clay particles,and soil will damage aquatic habitat and are considered
to be pollutants.
2. Any discharge of sediment-laden runoff or other pollutants to waters
of the state is in violation of Chapter 90.48 RCW, Water Pollution
Control,and WAC 173-201 A, Water Quality Standards for Surface
Waters of the State of Washington, and is subject to enforcement
action.
3. During construction,all releases of oils, hydraulic fluids, fuels, other
petroleum products,paints, solvents, and other deleterious materials
must be contained and removed in a manner that will prevent their
discharge to waters and soils of the state. The cleanup of spills should
take precedence over all other work on the site.
4. Proper disposal of construction debris must be on land in such a
manner that debris cannot enter Oak Bay or cause water quality
degradation of state waters.

STAFF:
1. Prior to constructing the structure, the applicant shall obtain a building permit from
Jefferson County Department of Community Development. Stamped and signed
engineered drawings shall be included in the building application submittal.
2. The proponent shall notify the Jefferson County Department of Community
Development at(360) 379-4450 forty-eight(48) hours prior to commencing construction in
order to allow monitoring and ensure compliance with permit conditions.
3. Substantial progress towards completion of the project shall be performed within two
years of the issuance of the permit.
4. Prior to commencing development activity, proponent is responsible for informing the
Washington Department of Fish and Wildlife (WDFW) in order for WDFW to determine
whether this action is subject to the Washington State Hydraulic Code (Chapter 220-10
WAC). Hydraulic Project Approval (HPA) is required for all hydraulic projects, which are
defined as construction or performance of other work that will use, divert, obstruct, or
change the natural flow or bed of any of the salt or fresh waters of the state.
5. In addition to Jefferson County permit conditions, the project proponent shall comply
with all conditions set forth by the Washington Department of Fish and Wildlife through
Hydraulic Project Approval.
6. Prior to commencing development activity, the proponent is responsible for informing
the U.S. Army Corps of Engineers (COE) in order for COE to determine whether a
Department of the Army permit or review is required. Generally, review is required for
construction and dredging in or around navigable waters of the U.S. and for work or fill in
hydrologically connected wetlands. Contact the US Army Corps of Engineers, Seattle
District Regulatory Branch, PO Box 3755, Seattle WA 98124, (206) 764-3495, for more
information.
7. Work within the jurisdiction of the Shoreline Master Program other than as described
above shall receive separate review from this Department.
8. Construction shall be in substantial compliance with the site plan submitted on March
21, 2008 as it exists now or is hereafter amended by Jefferson County and/or the
Washington Department of Ecology.
9. No fill or other material may be placed in the waters or intertidal areas of Jefferson
County.
10. The project shall adhere to the Best Management practices (BMPs) to control
stormwater, erosion and sediment during construction. BMPs shall address permanent
measures to stabilize soil exposed during construction, and in the design and operation of
stormwater and drainage control systems.
11. A bulkhead shall not be allowed in the future to protect the stairs, which is a
non-essential, non-appurtenant structure.
12. All applicable U.S. Coast Guard navigational safety requirements shall be followed.
13. Any damage to the proposed structure shall be repaired or removed as soon as
practicable. At the end of the useful life of the structure or if the stairs are not used for
one year, the stairs will be removed as soon as practicable.
14. Shrubs may be pruned to construct the stairs, but tree removal is not allowed under
this shoreline permit.
15. The design, location, and construction of the stairs, as well as their subsequent use,
shall avoid adverse effects on fish, shellfish, wildlife, marine vegetation, water quality, and
geohydraulic processes. Construction methods shall minimize the use of materials
hazardous to the environment. All lumber and other materials treated with preservative
shall be sufficiently cured to minimize leaching into the water or shore bed, in accordance
with the Best Management Practi approved by the Washington Departmentish
and Wildlife.
lb. The applicant and/or representative shall contact the Development Review Division of the
Permit Center(360-379-4450) regarding a final inspection for compliance of zoning permit
conditions prior to scheduling a final building inspection.

RE: GEOLOGIC SLOPE STABILITY EVALUATION,385 OLD OAK BAY ROAD,
PORT HADLOCK,WASHINGTON
Dear Mr. Coburn:
At your request, we reviewed your plans for stairs to your beach at the referenced site to evaluate
the potential impact of the stairs on slope stability. This letter provides our opinion regarding the
potential impact on the stability of the steep slope above the beach. We understand that
Jefferson County permit review requires an evaluation of the proposed stairs on the stability of
the steep slope. We evaluated the stability of the slope in 2006 for residential development of
the site. We provide this evaluation for the proposed stairs as an additional service under our
original contract.
Our understanding of the proposed stairs is based on a set of hand-drawn plans and a letter you
sent to us dated January 25, 2008. The drawings and letter show that the stairs will be
approximately 55 feet long and 3 feet wide with a vertical rise of about 30 feet. The bottom half
of the stairs will be supported on 8-inch-square wood posts placed vertically in approximately
3Y2-foot-deep holes excavated on the beach and backfilled with concrete. The upper half of the
stairs will be supported on three pairs of 6-inch-square wood posts placed vertically in
approximately 4-foot-deep holes excavated on the slope and backfilled with concrete. The wood
timbers supporting the stair rungs will be supported on the vertical posts a few inches to a few
feet above the slope surface.
Our evaluation of the stability of this waterfront slope is provided in our letter report dated
June 23, 2006. This letter report describes some potential for both shallow and deep-seated slope
movement, with a higher potential for shallow slope movement and a lesser potential for

deep-seated movement. Based on our previous slope stability evaluation and our understanding
of the proposed stairs, it is our opinion that the proposed stairs will not adversely impact the
stability the slope, provided that the applicable risk reduction measures discussed in our June 23,
2006, letter report are implemented. The applicable risk reduction measures include the
vegetation and erosion mitigation recommendations.
While it is our opinion that the proposed stair will not adversely impact the stability of the slope,
it is also our opinion that the stairs will not significantly improve the stability of the slope. The
landslide potential discussed in our June 23, 2006, letter report remains. Therefore, the owner
must be prepared to accept the risk of future instability(shallow or deep-seated) present on this
slope.
Recommendations for design of the stairs are not included in our scope of services and are not
included in this letter. We would be pleased to provide these additional services if requested.
We appreciate the opportunity to provide geologic engineering services to you, and are available
to answer questions regarding our conclusions in this letter.
