CONDITIONS for Building Permit# :BLD09-00071
1.) To help prevent seawater from intruding landward into underground aquifers, all new
development activity on Marrowstone Island, Indian Island and within 1/4 mile of any
marine shoreline shall be required to infiltrate all stormwater runoff onsite.
2.) The property owner shall comply with Water Conservation Measures (per list maintained
by the UDC Administrator).
3.) A Geotechnical Report dated October 23, 2008 prepared by Aspect Consulting, LLC was
submitted in conjunction with this application. The report addressed the stability of the
geologic hazard area.
4.) The applicant shall fully adhere to all conditions and requirements of the eagle habitat
management plan.
5.) In the event that cultural or archaeological resources are discovered, all work shall
immediately stop and all appropriate agencies and tribes shall be notified. Work shall not
begin until the site has been evaluated by a professional archaeologist and approrporate
measures are taken to avoid impacts to archaeological resources.
6.) The project shall adhere to the Best Management Practices (BMPs) to control stormwater,
erosion and sediment during construction. BMPs shall address permanent measures to
stabilize soil exposed during construction, and in the design and operation of stormwater
and drainage control systems.
7.) Prior to commencing development activity, proponent is responsible for informing the
Washington Department of Fish and Wildlife (WDFW) in order for WDFW to determine
whether this action is subject to the Washington State Hydraulic Code (Chapter 220-10
WAC). Hydraulic Project Approval (HPA) is required for all hydraulic projects, which are
defined as construction or performance of other work that will use, divert, obstruct, or
change the natural flow or bed of any of the salt or fresh waters of the state.
8.) Prior to commencing development activity, the proponent is responsible for informing the
US Army Corps of Engineers (COE) in order for COE to determine whether a Department
of the Army permit or review is required. Generally, review is required for construction
and dredging in or around navigable waters of the US and for work or fill in hydrologically
connected wetlands. Contact the US Army Corps of Engineers, Seattle District
Regulatory Branch, PO Box 3755, Seattle WA 98124, (206) 764-3495, for more
information.
9.) The proponent shall notify the Jefferson County Department of Community Development
at (360) 379-4450 forty-eight (48) hours prior to commencing construction in order to allow
monitoring and ensure compliance with permit conditions.
10.) Work within the jurisdiction of the Shoreline Master Program other than as described
above shall receive separate review from this Department.
11.) Construction shall be in substantial compliance with the site plan submitted on March 25,
2009 as it exists now or is hereafter amended by Jefferson County and/or the Washington
Department of Ecology.
12.) No fill or other material may be placed in the waters or intertidal areas of Jefferson
County.
13.) In addition to Jefferson County permit conditions, the project proponent shall comply with
all conditions set forth by the Washington Department of Fish and Wildlife through
Hydraulic Project Approval.
