Shine Road Resident
I. INTRODUCTION
I am a long-time resident of Shine Road and a Party of Record in this proceeding. I submit this response pursuant to the Hearing Examiner’s Order Reopening the Record dated January 30,
2026.
This proposal must be evaluated in light of:
The Shoreline Management Act (RCW 90.58);
The Jefferson County Shoreline Master Program (SMP);
SEPA (RCW 43.21C);
Jefferson County Code, including JCC 19.10.075 (Denial of Permits);
The cumulative commercial activity already occurring along the Shine Road shoreline corridor.
The Shoreline Management Act declares that shorelines are among the most valuable and fragile resources in the state and must be protected from piecemeal and cumulative harm (RCW 90.58.020).
That guiding principle is central to this proceeding.
While this submission is made in my individual capacity, it reflects shared concerns among Shine Road residents regarding shoreline character, infrastructure strain, and ecological preservation.
This decision carries implications beyond a single parcel and should be evaluated with heightened scrutiny.
II. UNRESOLVED CODE VIOLATIONS
The Examiner has identified undisputed code violations for which no Voluntary Correction Agreement or Certificate of Correction appears in the record.
Under JCC 19.10.075, permits are not to be issued where civil code violations remain unresolved.
Before any approval is considered, full compliance should be formally documented and verified. Issuing a shoreline permit prior to resolution would undermine enforcement consistency
and public confidence in shoreline regulation.
If violations remain unresolved at the time of decision, denial would be appropriate under the Code.
III. CUMULATIVE IMPACTS AND SHORELINE CHARACTER
This proposal cannot be evaluated in isolation.
Aquaculture activity already exists along this shoreline corridor. Incremental expansion of commercial shoreline use raises legitimate concerns about:
Shoreline character transformation;
Increased vessel and trailer traffic;
Public boat launch congestion;
Noise and operational disturbance;
Ecological layering effects.
The Shoreline Management Act and WAC 173-26-186 require that shoreline permits ensure “no net loss” of ecological function and guard against cumulative degradation.
Shine Road is historically a low-intensity residential shoreline. Gradual approval of additional commercial uses risks converting this corridor into a commercial working shoreline over
time.
The County should clearly demonstrate how approval would not result in cumulative shoreline conversion inconsistent with the SMP and RCW 90.58.020.
IV. SEPA AND INFRASTRUCTURE CONSIDERATIONS
Under SEPA, agencies must evaluate direct, indirect, and cumulative impacts.
The record should clearly address:
Combined effects of multiple aquaculture operations;
Traffic and trailer impacts on Shine Road;
Capacity of local launch facilities;
Long-term ecological monitoring.
Absent thorough analysis and enforceable mitigation, impacts risk being externalized onto the surrounding residential community.
V. REQUEST FOR PROTECTIVE CONDITIONS IF APPROVAL IS CONTEMPLATED
If the Examiner determines that approval is appropriate, I respectfully request that the permit include robust, enforceable conditions to protect shoreline resources and community character.
At minimum:
Full Resolution of Code Violations Prior to Permit Effectiveness
The permit should not become effective until all violations are resolved and documented.
Performance Bonding / Financial Assurance
A bond of not less than 150% of estimated project and mitigation costs to ensure compliance and restoration if needed.
Cumulative Impact Monitoring
Baseline ecological documentation and annual monitoring reports with public availability.
Traffic and Launch Management Plan
Defined operational hours, trailer management measures, and avoidance of peak recreational conflicts.
Operational Limits and Expansion Restrictions
Clear limits on mechanized activity, noise, and prohibition of expansion without new permit review.
Enforcement Trigger Clause
Explicit language allowing suspension or revocation upon documented noncompliance.
Periodic Review Requirement
Mandatory review after 3–5 years to evaluate cumulative shoreline and infrastructure impacts.
These safeguards are consistent with the Shoreline Management Act’s mandate to prevent incremental shoreline degradation.
VI. CONCLUSION
Shine Road is a residential shoreline embedded within a shared ecological and community landscape.
The Shoreline Management Act exists to prevent gradual erosion of shoreline character through piecemeal approvals.
Before approval:
All violations must be resolved;
Cumulative impacts must be clearly analyzed;
No Net Loss must be demonstrated;
Enforceable, meaningful conditions must be imposed.
Absent these protections, denial would be the legally and environmentally appropriate outcome.
