To help prevent seawater from intruding landward into underground aquifers, all new development activity on Marrowstone Island, Indian Island and within 1/4 mile of any marine shoreline shall be required to infiltrate all stormwater runoff onsite. 5.) The property owner shall comply with Water Conservation Measures (per list maintained by the UDC Administrator). 6.) A vegetative buffer of 30-feet shall be permanently maintained from the top or edge of the Landslide Hazard Area located outside the 200 foot shoreline jurisdiction. All buffers shall be measured perpendicularly from the top of the Landslide Hazard Area. 7.) A Geotechnical Report prepared by Stratum Group dated September 1, 2009 was submitted in conjunction with this application. The report addressed the stability of the geologic hazard area. 8.) All construction activities shall not encroach upon the landslide hazard area buffer. This includes the storage or preparation of materials. 9.) Critical Aquifer Recharge Areas may require special protection measures to mitigate water quality degradation. The submitted proposal does not require additional aquifer protection measures. However, during construction the project shall follow the Best Management Practices (BMPs) and facility design standards as identified and defined in the Stormwater Management Manual for the Puget Sound Basin. 10.) The project shall comply with Construction Stormwater Pollution Prevention (SWPP) Elements#1 through#12 of the Department of Ecology's Stormwater Management Manual for Western Washington to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. 11.) A Stormwater Site Plan has been submitted and approved by the Department of Community Development. Once the subject permit has been issued the applicant shall fully implement the provisions of the submitted plan and contact the Jefferson County Department of Community Development to arrange a schedule to inspect the property for plan compliance. A Certificate of Occupancy will not be issued until the Department verifies plan compliance. No clearing for roadways or utilities shall occur on the project site until clearing necessary for the installation of temporary sedimentation and erosion control measures have been completed. 12.) Outdoor residential storage shall be maintained in an orderly manner and shall create no fire, safety, health or sanitary hazard. 13.) Not more than 2 unlicensed vehicl.all be stored on any lot unless totally scrSd from view of neighboring dwellings and rights-of-way. Such screening shall meet all applicable performance and development standards specific to the district in which the storage is kept, and shall be in keeping with the character of the area. Screening shall meet the requirements of Chapter 18.30 JCC. Outdoor storage of 3 or more junk motor vehicles is prohibited except in those districts where specified as an automobile wrecking yard or junk (or salvage) yard and allowed as a permitted use in Table 3-1 or Chapter 18.18 JCC, and such storage shall meet the requirements of JCC 18.20.100, Automobile wrecking yards and junk (or salvage) yards. In no case, shall any such junk motor vehicles be stored in a critical area. 14.) A minimum of two (2) on-site parking spaces shall be provided for the single family residence. 15.) Maximum lot coverage is not to exceed 25%. Lot coverage is defined as amount of impervious surface which includes roof tops, driveways, concrete, etc. Pre-existing legal lots of record less than one acre in size in rural residential districts are subject to the stormwater requirements in Chapter 18.30 JCC and must meet the"Area of Impervious Surface Coverage"to the maximum extent practicable as determined by the administrator. Lot coverage is defined as amount of impervious surface, which includes rooftops, driveways, concrete, etc. 16.) The building height is not to exceed 35 feet. 17.) Minimum setback from Orcas View Trail right-of-way shall be 20 feet. Minimum side yard setbacks shall be 5 feet. The site plan identifies a setback of 30 feet from top of bank to the proposed building. Minimum setback from top of shoreline bank is as follows: The standard setback for residential structures, including common appurtenant structures such as garages and workshops, shall be thirty (30) feet or one (1) foot for each foot of bank height, whichever is greater. This setback shall be measured from the bank's edge when the bank's height exceeds 10 feet. When the bank's height is less than 10 feet, the setback shall be measured from the ordinary high water mark. The setback shall not exceed 100 feet. 18.) Exterior lighting for residential uses shall not exceed twenty feet(20') in height from the finished grade, excepting when such lighting is an integral part of a building or structure. Ground level lighting is encouraged. 19.) Lighting fixtures shall be designed and hooded to prevent the light source from being directly visible from outside the boundaries of the property. The intensity or brightness of all lighting, during construction and after project completion shall not adversely affect the use of surrounding properties or adjoining rights-of-way. 20.) The plan calls for dispersion and infiltrating stormwater from the roof into drywells located north and south of the home and at least 30 feet back from the top edge of the bluff. In my September 1, 2009 geology hazard assessment report I recommended stormwater from the roof should be routed to dispersion/infiltration trenches north and south of the home site. The dispersion/infiltration trenches should be located at least 25 feet from the top of the steep shoreline slope. The proposed dry wells are 4 feet by 4 feet. This size should provide adequate dispersion and infiltration that will be equivalent to or exceed the 2005 DOE Stormwater Manual for 10 feet of 6-inch wide trench for every 700 square feet of impervious surface. As noted on my report soils at the site are well drained. In conclusion, the use of dry wells as proposed will not cause any slope stability problems and is an acceptable approach to stormwater management at this site. In regards the setback distance, the steep shoreline bluff slope is a geologically hazardous slope due to erosion at the toe of the bluff and the steep slope conditions. Any home should be located at least 30 feet back from the top of the steep slope. This distance will provide adequate protection to the home over the life of the structure (100 years). However, Jefferson County's Shoreline Master Program (SMP) Jefferson County Code (JCC) 18.25.410j states "The standard setback fro residential structures shall be 30 feet or one foot for each foot of bank height, whichever is greater". An exception from this standard is allowed under JCC 18.25.410j(i) "Where there are existing dwellings within 300 feet on either side of the proposed building site, the setback shall be the average setback of those dwellings or as prescribed above, whichever is less". Homes are located south and north of the proposed home site such that the home can be located 30 feet from the top of the shoreline bluff. At the time of my site visit the line of site from the home on the property to the south to a home to the north corresponded to the 30-foot setback distance proposed. Hence, under JCC SMP the 30-foot setback is applicable. My geology hazard assessment recommends a 30-foot setback for purposes of protecting the proposed home for the 4 tthhMfl • • life of the structure (at least 100 years) and accommodating stormwater and vegetation management recommendations to ensure there are no detrimental impacts to slope stability from development of the site.
